circle trying to plan out what their next move is going to be when they are going to rally here at sproul plaza next. police tore down about 20 tents last night including the artwork on the plaza. protestors say first they came on a loudspeaker and said if you're not a student you will be arrested and students were supposed to show their student ids, they gave them a five- minute warning. even though it was a peaceful raid, students weren't happy. >> there wasn't any violence. but, uhm, they destroyed all our tents and all our pretty artwork and that's really upsetting. >> i think it's pretty excessive to use 150 cops for 30, 40 protestors and a couple of tenths. >> reporter: we have heard at least two people have been arrested. rumor is one of them is a cal student and one of them was from "occupy oakland." and another person has been detained. there are about 40 students here at the time of the raid this morning. they are now planning a general assembly meeting tonight at 6 p.m. that is if they don't decide to rally earlier today. the decision is still being made. >> thank you, anne makovec.

this is sproul plaza.ou can see there is a line of officers here about 100 police officers from several different jurisdictions on the scene right now after this raid that began at 3:30 this morning. you can see large pile of debris. some of it looks like a defunct classroom because that's what students had set up here. that was part of their "occupy" protest. and it is now all taken down. so the police, according to protestors, came in at around 3:30 and started talking on a loudspeaker. if you are not a student, you will be arrested. they started asking students to show their ids. at least two people were arrested. one person detained. don't know if that person is going to be charged. quickly after that police tore down the tents, created the pile and now they are bringing in trucks -- workers looks like either university workers or city workers now doing the clean-up. they are bringing in these trucks and trying to load all this debris which according to the students was artwork, as well. they say this

anser hassan is in berkeley with a developing story at sproul plaza this morning. anser, good morning. >> reporter: good morning, frank. yeah, the mood has really begun to change just over the past hour here at sproul hall at berkeley. a lot of students are going back to sleep. live pictures right now, police have ordered protestors just minutes ago that this is an unlawful assembly. they are not allowed to clean up. it's not a dispersal order. they just made that announcement minutes ago but students still plan on staying. the order it disperse official one came at 2 a.m. but students voted and they voted to stay. alameda sheriff's office is assisting. no one is dressed in riot gear so they probably don't plan to move in yet. students say that the tents and going to sleep are actually a big part of the "occupy" movement. they say that it's about taking back public space in a show of solidarity. so far, much of the evening has been peaceful and the "occupy" cal protestors say they intend to keep it that way. >> i think today has been an amazing show of solidarity a

makovec reports with the clash at uc-berkeley. >> reporter: look at the scene here behind me at sproul plazau can see there are several tents and a line of police behind them allowing a small encampment to have formed here on the plaza. also several other students in sleeping bags and on cardboard boxes. police said they wouldn't allow that, but they are having some level of tolerance as you can see. they are really trying to prevent a full-on "occupy" camp something like we are seeing at the oakland city hall. this was the scene though as police moved through the crowd around 9:30 last night. at that point, they were bent on removing the tents that had been put up. several students complained of excessive force saying they were injured by jabs from officers' batons. 32 people were arrested in this confrontation with officers from the campus, sheriff's officers and the oakland pd. they confiscated the tents and supplies. this was the second big melee of yesterday. the first one happened around 3:30 p.m. [ screaming ] >> reporter: and this is youtube video from inside that confrontation. poli

let's show you live pictures at sproul plaza and uc-berkeley campus. most the students seem to be hanging out now. i spoke it a few of them this morning. there doesn't seem to be any clear plan at the moment as to what to do next. but the students are determined to stay. there's about 20 or so police on scene, as well. they are not dressed in riot gear, which suggests they are not about to raid the tents, at least not yet. students have been out here since late last night. but at 1:30 a.m., campus police arrived on scene and they ordered them to disperse by this morning. the 150 or so students were still here, held a meeting and decided they're staying. the uc campus police have called on alameda county sheriff's department for assistance but again, no one is dressed in any riot gear and i would think they would also need a larger group of officers to clear the students out of the plaza. but the school has made it clear, the students cannot stay. >> 1,267 people voted yes for the encampment. 88.5%. >> the campus policies are clear that you can't set up

"today in the bay's" christie smith joins us live from berkeley with the latest. >> reporter: good morning to you. the demonstrators are up this morning, walking around, talking. they have their tents out this morning, at least a dozen, maybe more. some of them have sleeping bags out here. they are sleeping, waking up -- now last week this led to a big clash with police. students are saying what's going on here proves that they can reoccupy the campus and there are about as many tents as there are officers out here from both the university and the alameda county sheriff's department, plus demonstrators from occupy oakland who had their encampment raided this week at frank ogawa plaza. the demonstrators say they were excited to hear former labor secretary robert reich at sproul last night and decided early on to try to set up an encampment again. officers tell me that some tents have come down overnight, some students saying they'

. >> reporter: i just talk a walk out on sproul plaza, there are three, four people sitting on the steps later today they are going to try to set up tents again. last week when they tried to set up tents they weren't up long police moved in and tore down the tents and arrested 40 people. a group call by any means necessary is suing on behalf of those 14 arrested. the university has granted amnesty to all of those arrested. today's walk-out organized in part by refund california. the purpose is to bring attention to a host of issues. >> we still have a lot of -- [ inaudible ] availability of classes restricted. [ inaudible ] >> disrupting will not change the outcome on budget cuts. they need to go to the regents hall or sproul hall right here. >> reporter: fall-out from this regents were scheduled to meet in is and thursday because of threats of violence that meeting has been cancelled. today's rally set for this afternoon, signs all over campus. a lot of people hoping for a different outcome than what we had last week. terry mcsweeney, abc7 news. >>> 4:30 five now. right now in new york

anne makovec is at sproul plaza with the students who say they are not going to stop. >> reporter: the crowd has been ebbing and flowing through the plaza today meeting in small groups like you can see up there on the steps. they're talking about how they are going to be protesting the cuts to education in the system as well as standing with the "occupy" movement worldwide. they are preaching nonviolence after a rough night here last night. >> reporter: scenes of police using batons to break up some of the hundreds of protestors trying to protect abutting "occupy" encampments near sproul hall. [ screaming ] >> reporter: after police warned them that they wouldn't allow tents in the area, protestors set them up anyway and in the clash that followed, demonstrators say several of their own were injured. >> straight-up police brutality. just people standing there kind of like looking at each other talk and then they get a billy club to the stomach. it was ridiculous. >> reporter: in this melee at around 9:30 last night, more than 30 protestors were arrested and this was the second confront

katie marzullo is live at sproul plaza with the latest. >> reporter: good morning. at this hour the scene is this, maybe 100 protesters here. most are awake. a handful are on their feet. there are also a handful of police officers here. but, nothing is technically happening. as eric said, there have been announcements, at least two from police asking the protesters to pack up tents and leave. the lieutenant with the uc berkeley police department tells me they've been announcing camping is illegally, unlawful his words and nonstudents will be subject to arrest after midnight. students got the message but say they are not leaving. >> basically, people have voted to stay and resist encroachment under camping. we want to keep the tents, moving into a smaller area so we can link arms and face the police if they try and take tents away. >> reporter: there are fewer than 20 tents here. you are looking at video of last night the same location, very different scene. maybe 5,000 protesters here former secretary of labor and uc professor dr. robert reich spoke to the group and

so far the university police have taken a hands-off approach and have not remove the tents from sproul plaza. >>justine: more now on the occupy protest the police said they were forced to release pepper spray on occupy protesters in seattle. officers said they were attempting to arrest a woman that swung a stick at them when the protesters intervene. what we are watching now is milk being poured on the eyes of people being sprayed with pepper spray. they say a 19 year- old pregnant girl and an 84 year-old woman were among the people being sprayed. at least six demonstrators were arrested there. now we will talk to hear -- talk to erica because it looks like we have a one day left of pretty nice weather. >>erica: good morning justine, that as he take a closer look at your weather had live for today, we are dealing with some patchy fog up into the valley that should only be the case until sunrise. as we head closer to the afternoon we will see a lot of clear conditions and sunny skies with temperatures in the '60s a like already mentioned as we head towards the latter part of the week we have

there are hundreds of students at sproul plaza as part of a new occupy protest. ktvu's john sasaki is in the middle of it. john? >> reporter: we are standing outside sproul hall. this is the middle of a heck tick day here outside sproul hall. if you can look right here, you see there are a couple of tents set up here. these tents went up, you can see inside, people enjoying their time therein, this all went up here after an extremely big conflict between these students, a thousand people here protesting the 99% versus 1%, this is "occupy cal" as they call it. i want to tell you, at one point the police officers told the students they could not set up tents so they came in riot gear and told them to remove the tents or they would be removed with force and that's exactly what the police did here. it was 3:45, 4:00 that that went down. students were complaining about police brutality, saying the officers used more force than they needed to. joining me now is peter, a chairman of one of the department. which department? >> dance and performance studies. >> reporter: y
