many felt gm had to build plants like orion.was modernize or be run over by the auto business of the 1980s. how does gm, or any business decide what will be profitable? we asked economic analyst richard gill. essentially what gm had to do in considering this investment was to compare the expected rate of return with the cost of money needed to finance the investment-- the interest rate. how does one calculate this expected rate of return? let's consider a simple case. a firm is considering putting $1 million into a new piece of machinery. this machinery lasts only a year. during that year the businessman expects this machinery will add enough to output to increase revenue by $1.2 million. the ra of return is 20%. the way we would calculate it is by this formula. r is thexpected rate of return. in numbers... if the interest rate is below 20% the investment will be profitable. if it is above 20% it will be unprofitable. in real life it is more complicated. the new plant and equipment would last many years. guessing the expected ra

he recognized that gm had actual knowledge through 24 gm upper management attorneys. gerri: how is this a different company? >> it is not. you hit i had on the head. gm says you did it. we were responsible. that is when we were called old gm you can blame us. but can only blame us wearing the old gm hat. now because there is bankruptcy. we have on our new gm hat. it is our fault but it is our fault when we were the old gm. so we are not responsible. gerri: goes away with the bankruptcy is the view. >> that's right. gerri: tell me quickly, how many people do you think are in that old gm bucket, that might have brought case that might have brought actions who got hurt? >> we know there were about 130 cases filed in the bankruptcy, including 20 deaths that were waiting for the decision and probably hundreds more. you know i heard from one of those clients yesterday, gerri who lost his pregnant wife. he just couldn't understand it. he knows what bankruptcy is supposed to do but he said, look they committed fraud. my wife died. now i have no right to sue them? gerri: all r

that was the year gm was reinstructored in bankruptcy the ruling could save the company as much as $10illion from potential claims. mr. hillyar thank you so much for your time. how many clients had claims are that were pre-2009 that will now be blocked? >> there were about 180 claims filed directly in bankruptcy court, including over 20 deaths. the devastation to them as one of my clients told me yesterday, he has lost his pregnant wife due to one of these defective vehicles was that he believes this wasn't an ordinary bankruptcy. the judge yesterday, though granting gm its relief and protecting them from these claims, he acknowledged -- the judge did acknowledge that gm kept this issue from its customers while they knew of the defect. and so my client asked me well how can they get protection, if they committed fraud? he said i lost my wife and now what do i do? so he and, you know, another 180 victims are going to receive a letter from me that sadly explains to them unless we can get this reversed on appeal you know they will be prevented from ever going in front of a jury and showin

by the time the depression started in 1929, sloan and gm had overtaken ford.. ford brought out a new car the model a, that offered colors and options like gm cars did but it was too late, ford had to settle for second place then for third place behind the new company of former gm executive walter chrysler. we live in a world of change but not all that much has changed in the auto industry since general motors pushed ford from command. gm is still in first and consumers still watch the advertising and choose among cars that vary more in color and cachet than in costs. when economists talk about supply and demand, they're usually talking about price competition. but the battle between general motors and ford wasn't over who had the lowest price. we asked economic analyst richard gill if that holds for the rest of the economy. what you have in the case of the american automobile dustry especially in recent years is competition between a relatively small number of firms. we don't have a monopoly which means a single firm in control of the industry. we don't have p

you think that's probably a huge win for gm. >> absolutely. if you are a gm shareholder, you're looking at this bankruptcy judge's finding and you're rubbing your hands here. so what we've heard from the judge is that yes, gm can be shielded because of the bankruptcy from potentially billions of dollars of lawsuits related to this ignition switch issue. good news for shareholders. perhaps not so much for those who are looking at litigation against gm at this point. it is worth pointing out, of course, that gm has set up a fund with mr. fineburg which is focussed on compensation payouts to those who feel they have been injured as a result of the ignition switch issue. moving you on and it's a theme this morning we're talking compensation claims. of course the 2010 oil spill by bp still very much a live story and bp coming out and saying they have paid around $5 billion so far out in compensation payments to some 62,000 claimants. it looks according to their own figures as though this will rise to near $10 billion before it's done here. a couple

what do you think, gm or no? >> no. i would sell gm. face it, fx headwinds, a headwind for gm.ig tailwind for japan. production is constrained right now with gm. car sales are flat. silverado a big overreliance on that right now. it is trailing f-150 by a lot. liz: like another car company, better, larry. >> i like ford better. they went through the transition back in september, going from steel to aluminum bodies for the f-150. that is factored into the market. i believe once production rolls out, they have 20% room to roll this out we'll see the price fly and profits catch up. liz: adam lives and breathe cars. general motors would you go with this one. is a cloud lifted or forget it, batchingage. >> i will not make comments about designs and what they're doing i would sell gm. they're getting ready to expand their reliance on suvs. i realize gas is cheap right now. but that got them into trouble, along with a lot of other things a while back. here is the biggest factor they face. nye 19 nephew said the ford fusion looked cool. i haven't heard any 19 say even the corvette look

gm does say that trucks suvs, vans and pickups were up 14%.we're seeing the same theme develop with larger vehicles driving some of the strength there. overall passenger car deliveries down 21%. now gm's head of sales for north america did say that higher demand dovetailed perfectly with launches of the new full sized pickup trucks and suvs and low fuel prices and successful launches of the chevy colorado and trax models made us bullish. trucks suvs and pickups, vans everything large those types of vehicles up 14%. that's where the real gains came from. passenger vehicles guys carl down a bit, about 21% here in terms of overall march this time around. back over to you guys. >> we're not getting a payback how weak february was. >> no. remember the stocks trade much more on overseas sales because that's the delta for gm not u.s., because they make a lot of money on what they are selling. but i continue to think march was weak. i'm glad that they didn't take precipitous action. a lot of people came on the shows saying the fed's behind the curve.

a federal judge has ruled today that gm is entitled to that shield. anybody who had a loved one or was involved in an accident involving a defective ignition switch before general motors declared bankruptcy, they're likely not going to be able to sue general motors because of that shield. as a result of this decision, this is highly anticipated, watch shares of general motors tomorrow, because people will be sitting there saying all right, at least gm can now define its exposure in terms of the defective ignition switches. accidents after the bankruptcy are still open for lawsuits. anything before bankruptcy, which is the bulk of when most of these accidents happened they're not going to be going to court. guys, back to you. >> i definitely want to talk about the stock. i'm confused by the after-hours trading. it seems to be moving lower here. like phil says it's a positive. >> it almost went flat. there we go. >> that makes more sense. >> there we go. >> yes. >> i mean i think the one thing gm has to be very careful about here is the negative pr surr
