the f.b.i.'s evidence response team, virginia state police, montgomery county police, bedford county sheriff's office spent many painstaking hours in very rough terrain, in very heavy, heavy cold, snowy weather up on the mountains looking for forensic evidence in this particular case. during these investigative efforts and searches, neither a whimp or whine was heard from any of the investigators. their bulldog tenacity in achieving justice for the lyon family and their profound loss never wavered and it never will. in october 2014, common wealth attorney randy crantz began presenting evidence relating to this case to a bedford county multijurisdictional grand jury. the grand jury was -- has remained in session continuously since it was impaneled and remains so today. as a result of the evidence presented before the grand jury, indictments were handed down in this case on friday, july 10, 2015, in bedford county, virginia. the indictments were sealed at that time but are now being unsealed today.

tonight the f.b.i. says dylann roof should never have been able to get the weapon. f.b.i. director says a background check failed because of a breakdown in paperwork between police department and counties. roof told investigators he attacked black church members in charleston to start a race war. former virginia governor bob mcdonnell's appeal has been denied. the court upheld public convictions against him and mcdonnel was sentenced to two years in prison but was free on bond in the appeals process. northern virginia bureau chief jeff goldberg is live with the impact of today's decision. jeff? jeff: this is a huge blow for governor mcdonnel. it looks like he will begin serveing a two-year prison sentence. the appeals court reaffirming the conviction finding quid pro quo payments in place and governor mcdonnel acted with corrupt intent. here is one of the more memorable passages from the 89-page ruling from the appeals court today. saying that the appellants mcdonnel received a fair trial and was dually convicted by a jury of the fellow virginians. former governor bob mcdo

reporter: the f.b.i. concluded a press conference in downtown chattanooga where they tell the danger that the officers put themselves in to take down abdulazeez. the police chief fletcher says the officers first encountered the suspected shooter after he shot up anail recruitment center. they chased abdulazeez to reserve center and exchanged gunfire. the officers had to pull one out of the firefight after he was shot before finally taking abdulazeez down. >> let me reiterate the bravery the officers demonstrated. it's apparent looking at the crime scene that the officers were around tremendous amount of gunfire from the individual. yet, they continued to move forward against this target and engage him. abdulazeez is accused of killing four marines during the fire fight at if naval reserve center. they have found no link between abdulazeez and the terror organizations like isis but they say they are investigating to see if that is a possibility. maureen: now we just learned at least one of the marines knew
