comey's concerns about the president.nting to show that this was james comey, who leaked classified information. for which, he could be charged with a federal crime. that investigation, to our knowledge, has not been closed. >> okay. so that investigation is still going. and i guess this is the thing, paul. you know, every administration has these leaks investigations. you know, none of these administrations like leaks and they have gone to varying degrees and gotten in various degrees of hot water for trying to root out reporters' sources. what should the current doj be doing to alter this? president biden came out and said this is unsaebtable, not going to happen. what can be done to clean this up? >> just follow the rules, joy. by design, it's very difficult for prosecutors to get approval to seek records from journalists. even before they go to a judge for permission, they have to follow the doj procedures that require prosecutors to, first, exhaust all-other investigative steps. if they can't investigate the case, an

>> you look at comey.re on the receiving end of some attacks from the president. it was always -- and i guess this is clear. it was always projection. i mean, he is the one who is under potential criminal prosecution for his conduct. what was sort of the theory of the case on the inside about his maniacal obsession with criminalizing national security investigations? >> well, the trouble with what trump did was it took an environment where you might have legitimate violations of the law and it put it into this hyperpoliticized environment where it was clear that trump was going after people he perceived to be his opponents and i was on the receiving end of his accusations of treason and his idea that i should be put to death and it doesn't get old, the sort of outrage upon hearing that. but here's the issue, nicole. separate and distinct of what trump said and may have wanted, there were legitimate leaks of classified information to the media by people who weren't authorized to do it, so at the end of the

so the justice department has been investigating james comey basically since 2017 for whether or notwas leaking information to the media. the investigation itself took on many different forms over the years. investigators looked at things could mr. comey be charged for leaking memos about his encounters with donald trump and they landed also on whether or not he had anything to do with a memo that came into the hands of reporters at the "new york times" that talked about sensitive intelligence obtained by dutch intelligence sources given to the fbi and then "the new york times" learned about it. now again, this investigation into james comey and whether or not he leaked to our knowledge has not been closed even though it began in 2017, even though prosecutors in the u.s. attorney's office in washington, d.c., advocated for closing it, the fbi did not want to for several reasons, including they felt it was necessary to at least try to interview james comey, but to your point, this is part of a long running leaks investigation and as part of it the justice department did seize the reco

comey nominally was a republican and he got away. in many ways it's the deep state, who you know and your connections and the institutional prerogatives of the fbi and the doj. it shouldn't come as a surprise that the doj and the fbi are hesitant to prosecute leaders of the doj and fbi. with respect to the derr report i don't know when it's coming out. i would be interested to hear the report but durham was hired to presumably investigate and prosecute the worst corruption scandal in american history which is the obama targeting of trump and the continuation of that targeting by his allies after trump came into office. so the report, you knew, that and a quarter will get you a cup of coffee. where are the prosecutions? let alone where is the questioning as i said? there is no evidence in my view that durham has done any serious investigation of the matters he was asked to investigate. >> any indication of when that report is coming out? >> i have none. it's now june. he was appointed in april, i think, of 2019. there was one prosecut

even the things we're finding, even against comey, we can't make the case. how often was it that you guys would say, keep looking, keep looking, just keep looking? >> anyone who has served in a leadership position in the fbi or the department of justice will tell you that your job as a leader is to oversee these investigations, listen to what your investigators tell you, to process the facts as they are uncovering them. and to take the recommendations of your investigate teams in terms of the steps you're going to take going forward. so on the day they come to you and say, we think we're done, you may question -- ask a few questions and make sure that all of the "t"s have been crossed and "i"s dotted, but when they say there's no case here, that's the time to stop investigating a private citizen. what you had here was william barr throwing a hail mary pass to try to generate some sort of information, to put some of the president's enemies in jail. i know this from personal experience. in some really sad way, i'm not surprised with some of these revelations.
