it's of course home to aurora, where we've had two mass shootings in aurora. the one most recently this past summer. but it was newtown that happened in connecticut that seems to have changed the national discussion around this issue. did what happened in newtown change what was possible in colorado, or do you think you might be doing this without that having happened? >> i think that aurora had a big impact, and this is the first legislative session that we've had. we started january 9th. since the aurora shooting. but i agree with you that newtown really seared the consciousness of this country and that includes colorado. and so i think that has made it possible to do the things we're doing now that might not have been possible even in november after the aurora shooting. i think some of this we would have tried, but it's great to have a comprehensive package and actually have a shot at getting it done. >> the other thing practically that is making this possible, we know that democrats have control in the state senate and democrats have control in the state h

in the spring of 2011, in aurora by coincidence, there were officer shootings. there was great concern that we were about to embark on a summer of violence, so to speak. with other chiefs in the metropolitan areas, we convened a group of law enforcement folks, atf included, and enacted a summer initiative aimed at aggressively reaching out and arresting felons and other criminals who were attempting to get the guns or were trying to buy them. there were a total of 85 criminal prosecutions and convictions. they were a mix. there were a substantial number that we took stateside, so to speak. that was the most effective way to approach the case in a particular area. to go to your question about trafficking, part of the difficulty we had and part of the reason we have asked the committee to consider and the president has proposed a stronger gun trafficking law, is that we are currently basically trying to prosecute those under u.s. code 92286. those cases are difficult. many times, a judge or a jury may see that kind of prosecution as more of a paperwork violation r

in the aurora shooting case.rs just responded to an offer from the defense team for the accused shooter james holmes to plead guilty to the shootings that killed 12. jim spellman is going through the documents. jim, what have you learned? i know you haven't had a lot of time. what have you learned? >> reporter: let me set the stage very quickly for you, erin. a couple of weeks ago james holmes was in court and expected to enter a plea. he said i'm not ready. we will not enter a plea. the judge entered a plea for them of not guilty. monday the prosecution in the hearing right behind me here will announce whether they're going for the death penalty or not. so yesterday the defense put out a document saying that we are ready to accept an offer that takes the death penalty off the table. so many of us read that and we thought something's cooking here. we could have an -- we could have a deal in the offing. the prosecution today filed a very nasty, very, very harshly worded document saying we are not in any way ready

but the shootings in aurora profoundly effected him. especially after attending so many funerals.to ask you, is that what it takes to get changes to the legislation passed? i mean, should we send every member of the house of representatives to the next series of funerals when there's a mass shooting so that they can actually feel the profound impact of these weapons on the life of ordinary citizens of this country? >> well, i sure hope it doesn't take that but i think that clearly the shootings here in colorado have had an effect, an understandable frankly predictable effect. to julian's point, every major poll in this state has shown that since that has happened there's been an upsurge of public support for sensible gun laws. you would really hope, and really pray, frankly, that politicians don't have to see dead children, don't have to actually physically be there to see dead children in order to make this conversation about gun regulations more pragmatic. the problem really is though that the conversation isn't in many parts of the country a rational conversation. >> right. >>

we have seen it in universities -- the man who went into and aurora theater. we have seen it in universities. the time has come to step up and ban these weapons. the other important part of this bill is to ban large capacity ammunition feeding devices. those that hold over 10 rounds. we have federal regulations and state laws that prohibit hunting ducks with more than three rounds, and yet it is legal to hunt humans with 15 round, 30 round, even 150 round magazines. limiting magazine capacity is critical, because it is when a criminal, a drug dealer, a deranged individual has to pause to change magazines and reload the the police or brave bystanders have the opportunity to take that individual down. we saw this scenario happen in tucson, arizona. a madman who shot our former colleague, gabby giffords, was taken down when he had to change magazines. my view is, how could i stand by and see this carnage go on? members, this is not going to stop. it is going to continue on. we have a chance to do something about it. i cannot tell you how much -- i was mayor of sa
