he is the man accused of killing cashapp co-founder bob lee. after days of testifying, the defense rested its case and the defense's final witness was a former san francisco police sergeant. he told jurors lee may have been stabbed when he wrestled with zenni for the murder weapon, a knife police found near the crime scene. prosecutors claim that he stabbed lee on april 23rd last year over an issue related to one of his family members. but the defense has claimed it was lee who came at alemany and their client just defended himself. but many also testified he had no idea bob lee had been injured when he left him. lee ultimately died on a san francisco street, and now the prosecution will be allowed to call rebuttal witnesses. legal analyst steven clark says those witnesses could be key for the prosecution's case. they're going to hammer on the forensic evidence again to show that it was his dna on the handle of the knife and bob lee's dna on the blade. and that is a centerpiece of the prosecution's argument. closing arguments in the month long t

in that text, momani mentioned bob lee for the first time. that text happened two days after lee was killed and several days before momeni was arrested for the murder. legal analyst steven clark says her testimony might have actually hurt the defense. if this was self-defense, why didn't mr. momenti call the police? why didn't he render aid? why did he throw away the knife? all of those things. the prosecution are going to say consciousness of guilt. and now you have a text exchange between mr. momeni and a friend in which mr. lee is now dead. but there's no mention of this. the next key witness for the defense is doctor john marraccini. he's a former medical examiner in miami and palm beach, florida. on the stand, doctor mary chino was asked by the defense about their theory that it was bob lee who had the knife, and nima momeni was able to redirect it to first stab in the back hip. and then two times in the chest. doctor marraccini testified it is possible. the prosecution immediately began asking him if that was simply a theory. he said it

the dna evidence on that weapon is going to be important to solve the mystery of what happened to bob lee that night. in court, we learned lee's dna was collected from a blood sample. nima momeni dna sample came from two mouth swabs collected by police on the stand. criminologist oyefeso testified there are some conclusive results for the handle of the knife and its blade. according to the testimony, the sample from the handle of the knife had two possible contributors. the first person contributed 99% of that sample, the other only 1%, and when matched to nima momeni dna sample, it matched by a factor of 1.66 septillion. that's 1.66 and 22 zeros. the other 1% didn't have a conclusive match. lee's dna was a match for the blade by a factor of 2.89 octillion. the defense did try to raise questions about these conclusions, including asking about fingerprints on the knife during prior testimony. an investigator said they didn't bother trying to get fingerprints off the handle, because they didn't want to spoil the chance to get a dna sample. the defense also tried to raise some questions abou

but it's the prosecution that stands with proving their case that momeni deliberately attacked bob lee beyond a reasonable doubt. a task that's proving more difficult with a lack of tangible evidence. >> bob was completely anti-violence. he was about empathy and about lack of violence, about preventing violence. >> reporter: bob lee's family poking holes in witnesses called by the defense including the defendant himself, nima momeni, who lee's brother says can't be trusted on the stand. >> and he's trying to rewrite the history, but it's not true. >> reporter: in a unique twist inside the courtroom, the judge allowing all 17 jurors to submit questions for momeni to answer within the scope of the law. questions including whether momeni was intoxicated and whether he gripped the knife. even sew it leaves many questions unanswered, including how the knife could have ended up in his hand. it puts the credibility of his testimony in doubt. >> and the knife just appears on main street. nobody has testified about him taking it or handling it. that is a huge hole if you want to show intent. >>
