christie smith has the latest on the search. christie? >> good morning. sheriffs investigators are concerned and say this was a sexual assault and a home invasion. a woman home alone in her apartment in her 20s. they are not sure how the man got in. this is happening at the same complex where similar assaults have been happening since late june. the park regency apartments. the latest was reported last night around 6:00 p.m. it doesn't appear that anything was taken from the woman's apartment and so far they are not releasing suspect descriptions this morning. three other assaults happened here since late june, but investigators don't think they are related to this last one. prosecutors say dna did link a berkeley man to the assaults and he is charged with two attempted rapes. we should mention she still in jail this morning. he has pleaded not guilty. meantime women of course being urged to be careful and watch their surroundings and report anything they think is suspicious. live in walnut creek, christie smith in the east bay. >>> and rob joins us with

christie smith is live at the landfill with the latest on this investigation. good morning. >> reporter: good morning to you. we are told investigators will be back out at that landfill in pittsburg this morning in about 90 minutes. they're focusing specifically on a one acre area that they cordoned off inside the landfill where they believe the body of frederick sales may be. he could very well be the fifth victim tied to this bizarre killing spree last week. the 35-year-old nursing aide has not been seen since august 26th. that was the time his father was beat ton death by efren valdemoro at the hercules home they rented from valdemoro's girlfriend. an suv driven by one of the victims in all this was found at a hercules business park and valdemoro once worked at that business park and trash there ends up at the keller canyon landfill. this weekend there was vigil for all of the victims of this including valdemoro's girlfriend, cindy tran. >> she's a very devoted mother. >> it's heartbreaking. it's very heartbreaking. >> reporter: efren valdemoro was shot and

christie? >> reporter: good morning. it looks like the framework includes about $7.5 billion in cuts, much less than the governor and republicans were backing. they were looking for a number closer to $12 billion. it's slightly less than democrats were looking at which is closer to $8 bill glon cuts. the so-called big five spent a second day in los angeles. the governor was not feeling well and unable to fly to sacramento. they are trying to solve california's $19 billion budget deficit. some of their plan relies on federal dollars that haven't quite been promised yet. the lack of a budget meant stalled project for cal trans and teachers not getting paid. certain checks are not going out. >> it's a good sign for the venters who are not getting paid by the state and college student who is don't have the loans to pay for the books. we are far from a final agreement. >> reporter: the state has been without a budget for 86 long days, that's the longest in state history. we are told negotiations should return to sacramento wi

christie smith is live with an update on the repair work. christie? >> reporter: i just got off the phone with the manager and the natural gas leak is capped. the problem is there big holes where crews have been digging. they are working on filling that. they are waiting for a flagger to come and help direct traffic around downtown. there is limited access. around 11:15 and the city manager told me an outside contractor was working on a paving project and hit a pg&e gas line with a back hoe. you can actually hear the hissing sound overnight. initial reports were that this was a six-inch gas line. neighbors in about a dozen homes were asked to leave because no one knew how bad it might get. >> when the call came in, it would have been a typical response. the fact that everybody is station around to make sure that nothing goes wrong is probably due to the heightened sensitivity due to what happened in the city of san bruno. >> it turns out this was only a two-inch gas line. people were allowed to go back home quickly. no injuries and no explosions. thin

christie smith has a break down of who is using what and why. >> reporter: good morning.urvey is of americans 12 and older and shows that attitudes are changing, particularly among young people. less than half believe that marijuana use is harmful and the government reports also blamed increase marijuana use for a spike in overall illegal drug use, including methamphetamine and ecstasy. the national drug policies are believed young people are being exposed to a mixed message that marijuana is medicine. the obama administration is opposed to marijuana legalization and the survey is being released as california voters consider a november ballot issue on legalization. prop 19. advocate said it's more proof that the government's war on marijuana failed and it's time for sensible laws. here's how the drug use shakes out. marijuana use is up along with ecstasy, methamphetamine and prescription drug abuse. on the flip side, apparently fewer people are smoking cigarettes or abusing cocaine. it doesn't distinguish between medicinal marijuana or recreational marijuana use. live in
