we'll check back in with nbc bay area's christie smith. new information for us, chris e christie? >> reporter: good morning. it looks like this has come to some sort of conclusion because in the last two minutes or so, we've seen oakland police putting their weapons back into their trunks and basically it looks like they're dismantling the scene here. we're on 79th, a block away from ritchie street. exactly how this ended is still unclear. a police spokesperson is around the corner. we're hoping to leave here at some point and go talk to her. what we know is at about 9:45, they got some sort of call about a domestic disturbance. i guess they got information about one of the people inside the home, a man that may have been a suspect in a home invasion robbery and that there may have been another person, perhaps a woman, inside the home. they think this started as a domestic incident. they don't think the woman was being held against her will. but they came here, tried to make contact with that man and it's unclear how that ended. but we didn't hear any shots fired or neighbors tell

christie smith joins us live at the scene she's been gathering information all morning. what do you know now, christie? >> reporter: i just spoke with an amtrak police officer and he says what happened here this morning is that a worker at a steel plant were on 3rd and camelia parked his pickup too close or on the back end of the train track. that was here when we arrived this morning. but since then, they've been able to get the train off the tracks. the train involved is being moved forward. what they did a couple of minutes ago is they brought in another train and moved the passengers who have been stuck here since about 4:45 on to another train so they could carry on. this is a capital corridor train that was going from oakland to sacramento this morning. what happened just a couple of minutes ago they're telling me is that the engineer on the train that was stuck basically said that he was fired. he called for backup and they brought in a second engineer, a second train to carry on this morning and get those passengers moving. so you can see at this point the train i

"today in the bay's" christie smith is live in san ramon where police are trying to track down three other suspects who are part of this botched robbery. christie, good morning. >> good morning to you, marla. the store owner's daughter says her family is not the type to stand around and be victimized. and when four men stormed into this jewelry store in san ramon late yesterday, well, one of them was shot and police are still looking for the other three who got away possibly in a white four-door 1990s model sedan. this is really bold. 4:30 in the afternoon on san ramon valley boulevard at gold and treasures jewelry store. it was closing time. now police aren't saying who fired that shot either an employee or the owner, but they did say there were no customers inside at the time. but the would be robber ran outside after he was hit and collapsed. he was taken to the hospital where he later died. san ramon police are reviewing surveillance tape, but they're still asking for the public's help. if you know anything about the three who got away. reporting live in san ramon, christie smith,

christie smith is live for us. good morning. >> reporter: good morning to you, marla. you know, ross mirkarimi has faced the ethics commission before. but today he's expected to learn more about how this whole hearing process will work and what the rules are as he fights to keep his job as san francisco sheriff. mayor ed lee suspended him in march after he was convicted of misdemeanor false imprisonment tied to an argument new year's eve day with his wife. her arm was bruised in that incident and the neighbor that taped her tearfully recalling it. he's facing permanent removal from his job. the five-member ethics commission has to decide a number of things, including what type of testimony to allow, live testimony or written and how long this hearing might last. attorneys for both the city and mirkarimi are expected to have a very long list of witnesses. mirkarimi has been out and about at events and appearances trying to save his job. and the ethics commission will eventually decide and make recommendations to the board of supervisors about what to do. it would take 9

christie smith just arrived on the scene. she will bring us an update on the entire situation in just a few minutes. >> new developments in another police activity we have been covering all morning long. stand-off in richmond involving a suspect wanted in connection with an attempted murder has just ended. the police had surrounded an apartment around 11:00. a man barricaded himself inside. we are told just within the hour he has surrendered and now has been taken into custody. also happening right now, live look at a wildfire burning about 80 miles from phoenix mere the town of crown king, arizona. the fire started tuesday. firefighters say today is crucial because the flames are moving so fast, past a pyre line. they have a big bull acknowledge the terrain that could cause that fire to spread very rapidly in several directions. if that happens, firefighters will certainly have to pull out the hot, dry conditions in arizona. they were reporting temperatures of upwards of 106 degrees. a tough fight there. we will continue to

"today in the bay's" christie smith live with the latest. christie?> reporter: good morning to you. well, right now investigators are on the scene. i want to step to the side to show you what it is they're looking at. this burgundy pickup truck here and the amtrak train. they're not sure exactly how this happened. i spoke with one worker on scene and he said mainly the pickup was parked a little bit too close. one thing i do know is that parking right now -- there are at least four cars that are parked very close to these tracks. so, again, investigators haven't spoken with us yet, but that's what one worker said he believes may have happened. i spoke with the berkeley fire department this morning and what they're telling me is that there were no injuries involved. and at this point, though, it is impacting -- this is a capital corridor train here on 3rd and camilia street. service is impacted this morning. i do have calls into amtrak and union pacific, as well to try and see when they might have an eta of when this might be cleared up. i haven't hear

christie smith has talked to the suspect's family, but we start with bob redell who is at the sheriff's news conference an hour ago or so. he has the case here against antolin garcia torres. >> reporter: good morning, jon. there was a revelation from the news conference the the sheriff's office considered him a suspect since march and have been following him since. the mother sent him a message. >> a plea to the perpetrator, please give the information that you have to lead us to sierra to help end this nightmare. >> reporter: so far, antolin garcia torres has not given investigators a location of sierra lamar. this morning, we learned it was her bag of clothes found two miles from her home, two days after her disappearance march 16th, that led to his arrest. on march 28th. a crime lab linked dna found in the bag to garcia-torres. they began and continued round the clock surveillance in hopes they would lead them to a body. >> it is my hope this was random. it was an absolute stranger abduction. there's no information we have of any type that the two know each other, have had any contac

"today in the bay's" christie smith is live at that scene. stie, good morning. >> reporter: good morning to you. absolutely they're shaken up. we're hearing that the autopsy may happen today. but i spoke with the coroner's office this morning and they're telling me even when it's complete that there is a press hold on this case meaning that they won't be releasing information. it'll come from where we are here at the pleasanton police department after a very gruesome discovery late yesterday morning. a decomposed body found in a trash can on dublin canyon road near the stone ridge mall if you know the area. a caller reported a can that seemed out of place in some shrubs and looked different than the other cans that are normally issued by the city. police immediately taped off the area and searched for drews. investigators believe the body is a woman, the age and race, though, is unknown. the swarm of activity quite a shock for neighbors. >> this is the most action i've seen on the property for a long time. >> reporter: pleasanton police say th

"today in the bay's" christie smith is live with the details of this hearing. morning, christie. >> reporter: good morning to you, jon. what's happening today doesn't sound that important on the surface, but it really establishes the direction of this hearing as suspended sheriff ross mirkarimi continues his long fight to keep his job. will there be live testimony or just written testimony? and exactly how long will this hearing take? attorneys for the city and mirkarimi are expected to have a long list of witnesses. san francisco mayor ed lee suspended him without pay from his job as sheriff in march after he pleaded guilty to misdemeanor false imprisonment after an argument with his wife on new year's eve. she ended up with a bruise on her arm. the mayor believes he's unfit to be sheriff, but mirkarimi disagrees and has been out and about at events and trying to work hard to get his side of the story of events out to the public to try and save his job. now the hearing is before the ethics commission which then makes recommendations to the board of supervisors

but we begin with christie smith and what she just learned from the suspect's sister. christie?: yeah, good morning to you, laura. i just got off the phone with a woman who says that she is antolin garcia-torres' sister. she says that she is in complete shock this morning. i asked her how the family found out about this arrest. and she says that they found out by watching the news just like everyone else and since then the phone has been ringing off the hook and they've been trying to make sense of what's been happening. i asked her if she was aware of the sierra lamar case, had been following it, if there were in ties between her and her brother or anything. and she said she didn't know. she said she knew that the girl was missing but she specifically has no ties to her, did not know her. she says that she hasn't been able to talk with her brother since his arrest and that the family is now looking for an attorney for him. but she thinks that what's going to come out is in her opinion that this is all a big mistake. she says that he's been looking for work and in the past had w

"today in the bay's" christie smith live where deputies have been on the scene for 12 hours. good morning. >> good morning to you. this could be castro valley's first homicide of the year. i'll step aside so you can see what is going on here this morning. a dead body found at a home on the 4300 block of omega avenue. but the circumstances are still a mystery this morning. but an entire portion of the block is behind crime scene tape this morning. so neighbors will be waking up to quite a scene. i spoke with one deputy with the alameda county sheriff's department this morning who tells me this investigation started about 12 hours ago at 6:00 p.m. they wouldn't say exactly what brought them here but arrived and found a victim down. they're not saying if this is a male or female or if this started with a disturbance call, shots fired, that sort of thing. but they've got at least eight units here from the alameda county sheriff's department plus the mobile command center and homicide detectives also crime lab technicians here taking many pictures of the lawn. and one particular h

nbc bay area's christie smith is live in oakland with all of the latest details. good morning, christie. >> reporter: good morning, john. oscar grant's family is upset and got emotional. they say they should have been notified that he is trying to appeal the conviction. instead, they found out on the news like everyone else and started to get phone calls and didn't know what was going on. his mother, uncle, family and friends spoke on the steps saying they filled out victim's rights forms that should have covered notification about this. they pointed to the d.a., state attorney general and other agencies. oscar grant was shot and killed in oakland in 2009 by then b.a.r.t. police officer meserle who appealed his conviction in san francisco. his attorney argued he made a tragic, horrible error mistaking his gun for a taser, but it wasn't criminal negligence. the case was transferred to l.a. because of intense coverage in the bay area at the time. grant's family attended in southern california, say they would have been here if they knew. >> there was no mistake made.

nbc's christie smith is live with all of the latest details. good morning. >> reporter: good morning to you. the courtroom here in hayward is packed with people carrying signs in fact, have been warned not to flash them during the court proceedings. these are defendants and supporters of occupy the farm. what's going on is that a judge has already issued a temporary restraining order, and it could go ahead with a preliminary injunction today that could bring things a little farther to prevent more than a dozen defendants from any activities at the track in albany until this goes before trial. members of occupy the farm are waitsing now for their attorney to speak to judge hunter. it's brought by the university of california, the activists for urban farming were removed from the property owned by the university earlier this month, many arrested for trespassing. they had been farming the land since april 22nd upset with possible development there among other issues. the university warned them they would have to leave. the university needed the la

nbc bay area's christie smith is also in oakland where a news conference was held this morning dealing with that very subject. christie, good morning. >> reporter: good morning, jon. this is a covert operation that's been going on in oakland with some big results. oakland police announcing they have been working with federal agents. the bottom line here, federal charges against more than 60 people. many they say are career criminals with ties to robbery rings and drug rings in the streets of oakland. the u.s. attorney, a congresswoman and the oakland mayor and the police chief made the announcement today with a number of others inside a federal building in oakland. this, they say, a four month investigation, called operation gideon 3. oakland police asked for help and got it with undercover atf agents trying to dismantle organized crime and robbery crews. they are heavily armed to rob drug houses or high risk locations. police seized 92 guns. charges include unlawful gun dealing, drug trafficking, and assaulting federal agents. >> as a result of this operation, a significant number of

christie smith is live in san ramon where police have a possible description of the get away car. christie, good morning. >> reporter: yeah, there are still a number of questions about what went on inside of this store after four armed men stormed the jewelry store yesterday afternoon. and with the intent of robbing it. but one of them was shot and killed possibly by the store owner or an employee. the other three got away. and san ramon police are still looking for them this morning. this botched robbery happened in broad daylight. 4:30 in the afternoon. the four men ran into the gold and treasures jewelry store, but the tables turned quickly as one of them was shot and ran into the street during the evening commute looking for help. he was taken to the hospital where he later died. police didn't say who opened fire, but they did say no customers were inside. the daughter of the owner says she doesn't know if there's a gun in there but her family isn't likely to just standby. >> i know my parents were fine, that was about it. >> now, there are reports that some men tried to rob th
