. >>> i'm eric thomas. next stop for stadium project may be a courtroom. 30 million dollars is in jeopardy. santa clara is considering suing the county to get it back. katie marzullo is in santa clara with more. >> reporter: this morning might mark the beginning of a legal battle over the new 49er stadium. to many people's surprise santa clara county pulled 30 million dollars in funding that was earmarked for the new stadium project. why? the oversight committee an designed look at that money after the governor took way the redevelopment agencies said the money should go to education and schools and other institutions for the community. the problem is, it was in 2010 that voters approved 40 million dollars in redevelopment money to be spent on the 49er stadium, 10 million dollars of that was spent and out in remaining 30 million dollars is apparently being revoked many at least one councilman is confused about the whole deal. >> we backed everything so the 49ers would be on the hook. we are in good shape. i

i'm kristen sze. >>> and i'm terry mcsweeney in for eric thomas. berkeley a house fire has taken a person's life. katie marzullo joins us live from the scene. >> reporter: the house is still standing and you can see behind us there are investigators coming and going from the building even in the attic. the look from the outside doesn't reflect the tragedy that happened inside early this morning after 2:30 fire crews got the call arrived at this three story house basement, main level and attic space. in the attic a young woman thought to be in her 20s was kill. crews were able to get her out and did try cpr on the scene but it was too late. two others were taken to the hospital with burn injuries and smoke inhalation. >> i know some of them. some of them, they are students so they come and go, very nice young people. >> fire starts in the basement, end up in the attic in seconds then you end up chasing these fires. >> reporter: fire investigators don't know the cause of the fire or exactly where it started that is what they are on scene trying to de

i'm eric thomas. >>> and i'm kristen sze >> a deadly shooting occurred less than two hours ago. amy hollyfield is there live. what is the latest? >> reporter: it happened at a karaoke bar a crowded one we've seen groups of witnesses gathered around police cars as officers try to talk to them. behind me the scene is still very active. officers with thrash lights out, looks like they are searching for something in this -- parking lot. there are several police cars here. we've seen them trying to talk to groups of witnesses. this happened about 2:30 in the morning. a 24-year-old man was shot and killed. police don't know why. this is in the 2100 block of center road in san jose. police are trying to talk to the witnesses about what happened. a lot of them scattered. looked like it was a bit of a chaotic scene after the shooting happen. many did not want to talk to us. police tell us they are not releasing the name of the victim. they are still trying to work on notifying his relatives. looks like this is going to be an active scene truth the morning. we will be here. stay with us f

. >>> i'm eric thomas. >>> and i'm kristen sze. developing news. san francisco homicide investigators are in the ingleside neighborhood where a man was shot and kill overnight. terry mcsweeney is live at the police station. >> reporter: just for clarification the police station investigators are working that case over in the ingleside district and what we have is a man find shot shortly after midnight and investigators are saying he has died. take a look at pictures from the scene. according to the police the shooting took place shortly after midnight. a neighbor called it in 12:20. there were three shots, a pause and five more shots. police arrived at the scene, firefighters, emergency crews, there was an effort, we are told, to revive the victim, but it was too late. he passed away. described only as a man in his 20s. police don't have a lot more than that right now because again, it is maybe four hours ago that this transpired. interesting, this happened near niagara, a couple blocks from city college san francisco, the same street where five pe
