griff jenkins live in washington. what's this lawsuit about? >> reporter: it's about suing the military for failing to report the criminal history of service members and significant members to the fbi's national criminal background check system thus allowing some of those members to purchase and possess firearms when they should have been disqualified. the suit centers on the case of that tragic shooting in november in southerland springs texas when devan kelly was able to get a gun after the air force failed to report the 2012 conviction and court-martial for domestic violence. new york city mayor bill deblaiseio said in a statement this failure has led to the loss of innocent lives by putting guns in the hands of criminals and those who wish to cause immeasurable harm. this comes as the pentagon inspector general acknowledged that across all branchs of the military they failed to fully report in about 30% of the cases last year. the air force specifically 14% of the cases. jon? >> the lawsuit is also looking for court oversight over the penta
