and the latest announcement that rod rosenstein 's classified interview with the house judiciary and oversight committees, congressman matt gates, member of the house judiciary committee. congressman, great to have you with us. here we go again! what is up with this postponement? not coming this time from rod rosenstein but from the four elders of the congress, the house who were playing this game. what do you make of it? >> we make being a member of congress so much harder than it has to be. all we need to do is tell the truth, hold open hearings, show the american people what is really happening. i am so frustrated that we are now weeks after rod rosenstein, we learned that rod rosenstein made statements about wearing a wire on the president and we have not had him in an open hearing under oath to answer questions. i'm hopeful the fact that we've ended this little like behind closed doors pattycake game between the committee chairman and rod rosenstein, in fact we dispense with that. it means we will have more transparency in the process and more openness. but you know what? frankly, sometimes our own

house judiciary impeachment inquiry staff. gathering evidence at the request, direction of the house judiciary committee to determine whether richard nixon should be impeached. you could not make my life out. -- make my life up. i will just tell you that. so i was very -- i was very young. i was working with superb lawyers. and i will tell you what was most significant to me is that there was no prejudging. we were told the way we had to proceed was to collect facts, and the facts would lead to other facts, which would lead to conclusions. we were not to jump to conclusions. in those days, this was obviously pre-computer. the way we collected artifacts -- our facts was on index cards. we had thousands and thousands of index cards. i so respected both the democratic and republican lead lawyers in the way they conducted themselves. you know, richard nixon is in many ways a tragic figure. there were many things he did that i think were again, quite laudatory. the environmental protection agency, the legal services corporation -- he started a lot of institutions within washington. he was willing to look at problems and try to fix them.

i have seen this world as a former federal prosecutor, as a white house judiciary committee aid, and ite house lawyer. what did you think about the scope of what this white house gave the fbi looking into judge kavanaugh? guest: there is a lot that is not understood about the background check process. thought because i i should lay it out as someone who's been on both sides of this . background checks are not full-fledged criminal investigations. the fbi is a tool to look into the background of potential nominees. they serve a double purpose. first they help the president assad who to nominate. -- the president decide who to nominate. everyone has a basic fbi background check. of documents, and the fbi takes those, interviews people, and produces a background report. the president uses that, whoever the president is, as part of his dossier on who to nominate. then that file goes to the senate and forms the basis for the senate's advise and consent function. it's never a full-fledged criminal process. you can't use a subpoena. you can't compel people to interview. it is all voluntary.
