jade hernandez is live with a look at the clues that investigators have in this case. good morning, jade. >> reporter: good morning. i'm in front of the parking garage where the woman says she was sexually assaulted. this was an afternoon attack. this garage is near city hall. oakland police want residents and visitors to the city to not only be vigilant but keep an eye out for a man police say is responsible. a woman wag reportedly sexually assaulted thursday afternoon lunchtime in in 1414 clay street. she contacted police earlier this week when she spotted her attacker wearing head phones and dark large sunglasses near lake meritt. we have a description of the attacker to share with you. police are describing him as an african american man in his early to mid-30s, about 59th, 59th -- about 5'9", 200 pounds.

i'm jade hernandez. we're live in oakland where we just learned that ac transit riders may experience some delays today. that's despite a judge's decision yesterday. we'll explain what all of this is about. >>> a local musician is killed in a tragic accident while on tour. >>> we have an important warping for commuters right now -- warning for commuters right now. let's get to jade hernandez. >> reporter: we just learned that ac transit riders may still experience delays today. that's according to an ac transit spokesman. he told me that about 150 drivers called in sick today. according to that same spokesman we learned that the board of directors has not decided on whether or not to make an appeal to the judge's decision and that decision came down yesterday. they will wait for ap already scheduled meeting on august 18th. that may take a while for bus drivers to get back to their regular bus schedule. riders have seen delays over the past few weeks over ac transit's imposed contracts which change driver

jade hernandez is at the courthouse now with that ruling will be handed out later today. good morning, jade. >> reporter: good morning. a decision is expected later their afternoon right here at the federal building sometime between 1:00 and 3:00 this afternoon. there are a lot of things we can expect to see later today. supporters asked the court yesterday even if they lose not to allow same sex marriages to resume until they appeal. attorneys have said they are confident any such ruling in favor of lifting the same sex marriage ban would be overturned on appeal. they said same sex marriages wouldly licensed under a cloud of uncertainty and should they succeed on appeal marriages would be invalid. but advocates are hopeful about the decision today. >> american tradition doesn't always get it right the first time but eventually justice does prevail for all people, so i know in my heart that it is our generation's obligation and honor to see this through and to see this into the history books. >> reporter: keep in mind the question the judge seeks to answer today is califor

jade hernandez joins us now with more on the third shooting, which is at the recreation center. ing, jade. >> reporter: good morning. we contacted oakland police this morning and right now what we do know is this that the shooters left behind shell casings from several different weapons in this specific shooting. police don't have a motive just it. in fact we are live in front of oakland police headquarters this morning where they are investigating and we can show you this morning paramedics taking away two teenaged victims to the hospital. both teen boys are treated for multiple gunshot wounds. they were shot several times just before 9:00 last night outside the recreational center inside the community park in east oakland. the teens are 15 and 17 years old. we understand one of the teens may be in critical condition. knee other is listed in stable condition. we don't know the extend of his injuries. we don't know he he is doing this morning. we don't have much information about them or even if they knew their shooters. policer a not releasing what led up to the shooting but the

jade hernandez is out there. what is happening now, jade? >> reporter: well, about a half- hour ago the battalion chief told me he pulled his firefighters 100 feet away from this home because he was concerned about a ruptured gasoline. i want to take you to the sky, news chopper 2 cab show you this burning home. i understand from the captain i spoke to a few minutes ago he told me they are still concerned about that ruptured gasoline and pg&e are not here just yet so many of the residents have been told to say inside their homes. the vice-president of the neighborhood association came here and was shoeing people back into their homes. the fire broke out around 5:40 after a possible explosion in the garage. san jose firefighters were already fighting another fire less than two miles away so the battalion chief said their response time to this fire was much slower than they wanted it to be. the woman who lived inside the home did get out safely this morning but only one of her three dogs survived. the woman's neighbor immediately knew somethin

jade hernandez joins us live from oakland with the latest on this story. hi, jade. >> reporter: good morning, claudine. riders have experienced delays for days now. we told you that a judge had been expected to make a decision in this case on friday but on friday a new judge was appointed because the other judge had to go on vacation, so this case has been dragged out a little longer. the new judge said a decision could come as early as today but it could be made later. now, if a judge decides in the union's favor bus drivers would go back to their regular work schedule. for those of you not familiar with why ac transit bus riders have been upset lately, well this is a contract dispute between ac transit and its union. the union's contract ended june 30th and after three months of negotiating talks ended as soon as the union forced arbitration, ac transit decided to impose a contract the da after arbitration was made which changed schedules for some of the 1100 drivers within this system. arbitration is expected to begin later this month but the union has s

ktvu's jade hernandez is on the scene with more on the story. good morning, jade. >> reporter: good morning. at this hour we know that a man stumbled and collapsed along this sidewalk in front of an apartment building. we're live in the 9300 block of ban i don't have covet. paramedics rushed the man to the hospital where he died. homicide investigators were called to the scene. the coroner's office told me half an hour ago the police department is with holding the release of man's name and age. that officer with the department also explained there's been no update on a reason for the stabbing. ironically oakland police are holding their second day of a gang prevention summit later this morning. just hours before the summit began on tuesday homicide investigators were called to several scenes which left behind two victims. the summit is being held to gather together many of the top law enforcement officials in the region. coming up we'll have more on the summit and recent homicide investigations. this morning's death marks the 55th homicide this y

jade hernandez is in place san ton right now with more on this story. morning, jade. >> reporter: good morning. we are live at foothill high school here in pleasanton. this high school is holding football class -- or football practice at 6:00 a.m. in order to keep kids out of the extreme heat. it is expected to reach 102 degrees right here in pleasanton later today. we watched parents at he high school come to the school yesterday for late registration, parents noted then their students are coming back to school just when the weather is heating up, which is usually not the case. parents and coaches are taking precauses to keep their athletes safe as the heat rises to normal scorching temperatures, at least one soccer practice has been cancelled today. due to temperatures which are expected to hit 107 in concord afternoon jim nas tigs classes have been cancelled at one gym in that city. these are a few spots where practices have been rearranged to take weather into account. we traveled all of the area yesterday and found ourselves at a high school asking

ktvu's jade hernandez is there on the scene with more on the story. good morning, jade. >> reporter: good morning. firefighters say this fire started in the garage and it's easy to see that this morning. you can see the car inside and everything near the garage has been destroyed. a temporary fence has been put up this morning to keep people away from this home. this home is located in couper tino. an older woman who lived inside did escape. but authorities were worried because she is a diabetic. we know right now that the woman is okay and that's pretty amazing when you see what's left of her home. the fire broke out at 11:00 last night and quickly engulfed the woman's house along cold harbor avenue. neighbors told us they heard an explosion before the fire broke out. but in many house fires firefighters told us before the sound of explosion can often be windows breaking, tires popping, anything that might explode due to the fire. the car inside of the garage that might be the case this morning. but we can tell you the cause is still under investigati

jade hernandez has more. >> reporter: good afternoon. hayward police are being cautious abs they investigate this indent -- as they investigate this incident. the reason for the ncaa's concern, the building has been vandalized twice within a week. these are pictures for the most recent attack which left a hole in the window and quite a bit of damage behind. hayward police sent out a sergeant and a detective this morning to gather information because this office was struck by pellets a couple of weeks ago leaving behind a shattered window. in that incident. a nearby business and a bank next door were shot by similar bbs. >> i'm just concerned that this is happening to the ncaa office. my concern is why is it happening to this office. >> that is a great concern. >> reporter: police don't want to label sunday's incident anything other than vandal right now. but they are very concerned about both incidents and don't want to go on camera until they have more information. police did provide as much nfg as information about the incident as they

jade hernandez is on the scene. >> reporter: good morning. we are live near where officers believe this hit-and-run accident happened. in fact, right here at the off- ramp, the 27th street off-ramp. the california highway patrol said the man did not have identification with him but they did find a backpack near the scene. officers could not find physical evidence of a hit-and- run accident but his injuries are consistent with a car hitting him. officers discovered the man on westbound 980 on the 27th street off-ramp last night. he suffered major head injuries and is at a hospital in critical condition. the chp hopes to talk to him at some point if possible because as i mentioned, they have very little to go on this morning. several drivers noticed the young man lying on the side of the freeway around 11:30 last night and cree hp wants anyone who may have seen this accident to call authorities immediately. reporting live in oakland, jade hernandez ktvu channel 2 news. >> 5:04. >>> the investigation continues into a deadly high rise apartment f

investigators interviewed a 13-year-old boy overnight after his brother [ audio problems ] -- jade hernandez is at the oakland police station this morning with the very latest on the investigation. good morning, jade. >> reporter: good morning. we are live at headquarters this morning where police wrapped up talking with that 13- year-old. we were live in oakland this morning. the young boy that you see wearing a white hoody in this footage is the victim's brother. we watched him leave the police department last night. oakland homicide investigators questioned the 13-year-old and then released him into the custody of his parents. we know the brothers were together at the time of the shooting and that the incident happened before 8:00 last night near san pablo avenue at the boy's aunt's house. what we don't know is how the boys got hold of a gun. after midnight police went back to the aunt's house and pulled out what looked to be a vest and nun chucks. coming up we'll have more on what they have to say about the 15-year-old son who did not survive this late night shooting. live in oakland, ja

firefighters are casting their votes in san jose this morning on the city's latest contract propose a jade hernandez here now with an update on the labor dispute. good morning, jade. >> reporter: good morning. mayor chuck reed here in san jose defended the city's decision to layoff 49 firefighters. the city says it is willing to reinstate those firefighters at a cost. we are live in san jose this morning. the city says the firefighters can be reinstated if the union agrees to take an almost 9% cut in wages and benefits. firefighters met in this hall yesterday to vote on whether or not to make those concessions. voting ends today. ironically on thursday three fires broke out within a two hour period, pushing response times up. from eight minutes to 10 minutes, which is two minutes longer than the department's target goal for response time. two of those fires were within two miles of each other. firefighters point to this very situation as one which could have turned deadly had anyone been trapped inside hen the fires broke out. city councilman pete constant says the department doesn't have concrete e

jade hernandez is out there right now. jade, what's happening? >> reporter: i can tell you 905 rock dale drive that's where we are. that's where one of the fires is burning here in san jose. firefighters out here this morning. but first we want to take you to news chopper 2 where i can show you the 3-alarm fire happening at 910 dell monty place. both broke out around the same time. as you can imagine firefighters are very busy right now. i understand that the dell monty place fire has about 70 firefighters there right now. this is a three-alarm fire. we don't have a lot of details coming from that fire just yet. but i've been told by the san jose battalion chief out here on rock dale drive that someone should be able to update us in about 10 or 15 minutes. i want to bring you back to where i'm live. this is a two alarm fire with about 50 firefighters on scene right now. i spoke to the homeowner. he told me that his pit bull, poke coy, actually woke him up this morning. they didn't hear smoke alarms or anything. his dog saved the entire family. an

jade hernandez joining us live in san francisco with a look at whether this case will make it all the to the u.s. supreme court. jade, good morning. >> reporter: good morning. it is a bit early for same sex couples to head down to city hall to pick up a marriage license. but that could change tomorrow. we are live in san francisco this morning. soon after chief u.s. district court judge vaughan walker overturned a ban on same sex marriage or prop 8, there were a few couples who came to city hall to see if they could get married. judge walker already granted supporters a temporary stay against performing any marriages. he gave both sides until tomorrow to submit written responses as to why the temporary stay should remain or be lifted. supporters of the voter approved proposition 8 had argued even before the judge's decision was released yesterday. any same sex marriages which would be performed after the ban was lifted could be complicated by rulings and appeals farther down the legal road. the 136 page opinion issued is headed to the ninth circuit court of appeals now where if judge

ktvu's jade hernandez is in oakland with a look at how the buses are running this morning. i know you're getting reaction from commuters as well. good morning, jade. >> reporter: good morning, dave. that's right. riders can expect their bus schedules to return to normal today. that's a largely in part due to a judge's decision yesterday. but ac transit warns those very same riders they may see some cuts at the end of the month. riders have already dealt with an 8% cut in service and have had to pay higher fares. but ac transit claims employees working without a contract the agency deficit will grow at a rate of $300,000 a month. the reason the alameda county superior court judge ruled yesterday in favor of the union's request to lift the contract imposed by ac transit on its union members. ac transit has until august 10th to carry out the judge's order. the agency imposed a contract on its employees when talks broke down between the two sides and a judge ruled the meater wife to go into arbitration to force both sides to come to an agreement. they would have to adhere to a n

jade hernandez joins us live in oakland with that story. good morning. >> reporter: good morning. we told you a judge was expectthat decision was postponed. we are live in oakland this morning. you can see ac transit buses, there is bus stops right there. we are at the corner of 14th and broadway this morning. as i mentioned a decision was postponed at least until today. this is a contract dispute between ac transit and its union. the union's contract expired june 30th and after three months of negotiating the union went to a judge, looking to force both sides into arbitration. ac transit decided to impose a contract, which took effect july 18th. now that brings us to today, august 2nd. for several weeks as the union waits for a judge to decide whether or not to lift the newly imposed contract some bus drivers have called in sick. up to 20% each day since the new contract has been put into place. we spoke to a bus operator this morning. here is what she had to say about this. >>> now we do understand as i mentioned we spoke to a bus driver and we don't have -- actually i have been
