i'm jonathan lemire. thanks for starting your day with us.ll begin with a major defeat for former president donald trump. a federal appeals court ruled yesterday that a judge's order appointing a special master to review documents seized from trump's mar-a-lago home and club ore the summer should be dismissed. the ruling made by a three-judge panel of the 11th circuit court of appeals lifts earlier restrictions on the justice department's examination of classified documents and other records as well as allowing investigators to proceed with the probe more quickly. the panel stated that u.s. district judge eileen cannon's order to appoint a special master and, therefore, preventing the government from using the trove of documents that were retrieved with the search warrant back on august 8, that ruling was incorrect. in september judge cannon, a trump appointee, selected this man, judge raymond dearie, to review the materials retrieved from mar-a-lago after trump's team argued it couldn't rely on a so-called filter team at doj to set aside any

here's bring in house of "way too early", jonathan lemire, donna here with us and tim miller. you want to give the official response, what the santos response is, by his lawyer to this story that has enveloped him over the last 48 hours. let's get that response on the record from you, and then we'll go from there. >> well, john heilemann, first of all, i'll say i now have new questions about your own resume, now there's pressure light of the accusations against mr. santos. the lawyers, they're not saying much. they have issued a statement that really does not address or take on any of the accusations from, we should note, this terrific reporting in "the new york times". but all sorts of questions are now being raised about exactly who this person is. it seems that most of his resume has been fabricated. his team disputes that but they're not going tick by tick through his dossier, if you will, nor are they offering much in the way to corroborate who he is. this is, we should note, would be a big deal at anytime, but i think it is certainly raising a lot of anger and frustratio
