the louden county prosecutor's say he they cannot prove voluntary manslaughter beyond a reasonable doubt. in the death of five-month-old tristan schultz. schultz was killed a year ago yesterday when a car hit him as his mother was pushing him across the street in a stroller. the driver, john miller, was indicted by a grand jury in that accident. his trial is set for october. he remains charged with reckless driving and that carries a maximum penalty of a year in jail and a $2,500 fine. >> new today the white house appears to be pulling back on president trump's threat to shutdown the federal government after over the border wall, at least for now, president trump is threatened to force a shutdown in october if the next expanding billoe post, the white house has signaled to congressional republicans that there will be no shutdown coming in october. however, the administration says that the building -- building the wall matter, is still a top priority for mr. trump. the president also promising to announce a decision soon on the fate of so-called dreamers. >> his decision will effect hundr
