the fate of obamacare being really at the top of that list. as you mentioned, that's expected to come up, back to the supreme court the week after the election. and democrats feel confident that healthcare was a motivating issue for them in the 2018 midterms and that this could be potentially a motivating issue for them in this election cycle. the other key issue i would say is abortion rights. we know from polling that joe biden has had somewhat soft support among some younger voters. this is a galvanizing issue for a number of young women voters in particular. and you look, look, i know fund-raising doesn't always -- it is not a clear equivalent with enthusiasm, but we look at the numbers from act blue, which is an online democratic donor site, and they recorded record fund-raising yesterday, over $70 million. they told us over $90 million just since 8:00 p.m. friday when the news broke of ruth bader ginsburg's death. so i mean i look at that, i look at the massive crowds of people gathering around the supreme court, and it certainly looks l

the likelihood of obamacare being tossed out is quite high, right? >> ruth bader ginsburg was a key vote in 2012 to uphold the affordable care act. and it was then upheld in 2015, but this time around, it is a whole new court, and, john, what my story wanted to emphasize was that there is a big difference between a 5-4 court and a 6-3 court. it is not just a matter of a simple vote, because the four liberals used to be able to pick off a conservative here or there just as they did when they persuaded john roberts to uphold the affordable care act back in 2012. it is going to be nearly impossible this time around. the case will be argued on november 10th, but i do want to caution, it is not a done deal it is going to be thrown out. there are several off ramps that the court could take here, but as a judge and as an academic, amy coney barrett has certainly, certainly expressed skepticism for these kinds of government programs, for government regulation and what she wrote about chief justice john roberts' vote and legal reas reasoning to uphold the aff

the president likes to say that obamacare is dead because inpenalty for not having insurance is gone.ugh the health insurance exchanges are getting along surprisingly well without that penalty. >> that's right. there's a lot of people who are on there. i wuntder if the supreme court hears the trumped administratios case, there could be a new justice by then. so, we could see the aca entirely struck down. what happens for real people who have health insurance and coverage through obamacare, what happens if it goes away? >> it would be an enormous mess and not just the 20 million who directly get it through the exchanges or expansion through the medicaid program. it's basically everyone who uses health care in this country. it was a huge sweeping law. there was not a ton of concern, as of a couple of weeks ago, because it's not considered very strong and figured chief justice roberts would stand with the liberals. but if there's a new conservative justice, even if chief justice roberts votes with the liberals, there could be votes to strike down the entire law. it is a live possibility.
