pete? >> well, i think the only red flags out there obviously are news based because when you look at the way the markets are trading without ukraine, without some of the things going on globally we can see exactly what the markets want to do. they want to go higher. look at the big cap techs. microsoft, ibm, intel. the risks are still there. folks are willing to have risks on the table. look at the amazon, facebook, netflix, twitter. when you see oil going down, transports moving to the up side, there are so many movements in the marketplace. the participation is broad, very strong. i think without some of this negative news in the marketplace right now there's nothing but up side. we could easily get to 2,000 but that's all based on the news. >> you mentioned transports. nasdaq we should mention ended at the highest level since 2000. do you like the technology group? >> i do, but i think to pete's point, you never short a dull market, right? i think that's what we're seeing now. we're in

pete, what do you see? >> well, it's newcorp.ok at the six-month chart, it's been churching for quite some time. between about 49% and 52%. we talked about under the radar. steel, iron ore. really starting to move. in the last month, scott, take a look at how in august we've watched nucor move to the upside. the calls have already doubled. then on wednesday they started buying the september 55 calls. october 52 1/2 calls. today they're buying the october 55 calls. so this is really interesting to see. three times in the last week, scott, we are seeing upside activity. stock has been moving to the upside. now the stock's up and through 53. can it break through those 52-week highs? somebody's betting that it can. are you doing it? >> i am in this name. >> equity? options? >> just the options, i am long calls. i expect the stock to continue over the next couple weeks. i think it looks to me like the steels are breaking to the upside. joe pointed out u.s. steel, all kinds of names moving to the upside. >> what about the holding perio

joining me is pete williams.hat can you tell us about what the justice department actually plans to do? >> well, in fact, senator mccaskill and the attorney general have now talked. he also talked to other members of the congressional delegation. first of all, in terms of the investigation itself, the justice department on monday opened a civil rights investigation that is led by the u.s. attorney out there and the fbi. and normally in situations like this, you see the fbi open these investigations, keep a close eye on what the local police are doing but not be too aggressive on their own at this stage. but this situation in ferguson is different, we're told, that the fbi has already been doing interviews with witnesses. one official says the fbi has interviewed the young man who says he was with michael brown at the time of the shooting. so you see a little more forward-leaning response by the fbi in this situation. now, the fbi can't, quote/unquote take over the investigation because there is no federal murder
