terry mcsweeney is live. terry, what happened? >> the problem is that officers in the field cannot communicate with dispatch. in other words, they can't call in for additional officers or medical help and that was the situation last night following a high-speed chase. take a look where the incident that brought this to our attention all began. it began on walkwood street. no one was hurt when two men in a car opened fire. nobody hit by the gunfire there but then the chase of 85th avenue. it was a ten-minute chase. for half of that time police say they had no communication with dispatch. so when the passenger of the vehicle was shot by police, officers could not call an ambulance. regional park police happened to be listening to the radio. they called for help. police say it is a well-known problem. >> officers can hear each other but we have no contact with the dispatchers who are life lines to safety out here. it's a problem that the city is aware of and currently working on. >> the driver of the get away car was arrested. he was

live in hillsborough, terry mcsweeney, abc 7 news. >> terry, thank you. it's 5:34.t oakland where police are investigating a fatal shooting that occurred last night, that victim was found near 16th and center streets just before 10:00. emergency crews administered cpr but the victim died at the scene. police went door to door in the area hoping to locate witnesses. so far no suspect information is being released and no motive either. >> it's 5:34 now. people who donated money to a special fund for the san bruno fire victims are upset to find out that none of that money has been distributed. the san bruno city council takes up the issue next tuesday. last night two council members hosted a public meeting to get input how best to spend the $400,000 that's been collected since september's deadly pipeline explosion. the funds are being held in a special account but the city must first come up with a way, a fair way to distribute it. fire victims say they need the money now. >> i don't have medical benefits so i've been paying all the money out and i don't have any money

terry mcsweeney is live there with her with details. terry?mayor quan is going to be asking for the same things that councilwoman quan was asking for last year. she wants police to contribute 7% more of their pay to the pension plan. it's something that police say no, period, that's all there is to say. take a look at mayor quan yesterday. talking about going from one end of the spectrum to the other. from chinatown to the fox theater, she was inaugurated as oakland's first female, oakland's first asian mayor. very different reception here at police headquarters this morning. you have to think 7% pension kopt bution plan -- again, this is not a new issue. the city needed that money to deal with the $40 million deficit where there has to be layoffs and the union said we're not gonna do it unless you give us a guarantee there will be no more layoffs. they couldn't get the guarantee and officers were laid off. police union leaders say they've done all they can do. quan saying she's still interested in working together. here's what she has to say.

terry? needs to have an accurate number of the homeless to turn it into the federal government to qualify for millions of dollars but above and beyond that the county is in a ten-year program to put an end to homelessness. a very lofty goal. let's take a look how it worked a couple years ago here in contra costa county as they went out and counted the homeless. the county helped services, staff and volunteers do the counting. they're starting at 6:00 this morning until 8 a.m.. they're collecting data on the homeless population, an effort to make sure the county receives adequate federal support for the homeless and programs. i mentioned a ten-year plan to end homelessness. the federal government had a plan that began in 2000, here we are 11 years later and that program didn't work. the homeless program provides case management, abuse treatment, employment training and the most important aspect of all this according to the homeless, the folks at the homeless services permanent housing. now, t

terry?s one especially disturbing because they say this mountain lion attacked a deer on robin wood lane in hillsborough yesterday in daylight hours. that suggests there is something wrong with that mountain lion. take a look at video we shot a couple hours ago out here at robin wood lane. you can see lots of trees here, lots of places for animals to hide. that is really the concern out here. they're saying, state fish and game is saying that this animal, the mountain lion probably injured or sick if it is hunting in the day time. these are nocturnal animals. it's weird it's doing something in broad daylight. the warning is this: keep an eye on small children and small pets in the backyard area, especially trees and call 9-1-1 if you see a mountain lion out here. the warning was also issued last saturday in redwood cities emerald hills area. that is where a mountain lion was spotted again in the day time. there have been some nighttime spotting of mountain lions. those are not that much of a

terry mcsweeney, abc 7 news. >> terry, thanks very much.e search for four-year-old giuliani and his suspected kidnapper has moved knead a different stage. divers officially ended the search of the canal on saturday. last friday they pulled out the car that belonged to the suspect rodriguez but the vehicle was empty. officials are relying on a plane and sheriffs patrol along the canal bank to look for bodies in the water. they're asking the public to report any information that could help with the investigation. rodriguez grabbed giuliani from his mother's arms january 18th. the boy's mother still believes her son is alive. tonight the family of a dublin girl who disappeared 22 years ago will hold a candle vigil. eileen was 13 when she vanished january 30th 1989 when walking from school to ice skating lessons. her family and other supporters will walk along the route eileen was taking when she was last seen. she was walking to wells middle school in dublin. >> counselors will be available at a san rafael high school after the body of a popul

terry, thanks. state lawmakers have a new plan to restore child care subsidies cut by governor schwarzenegger late last year. john perez will announce today they found a way to keep helping 55,000 low income families. they scraped together $60 million to fund through march then the program's funding will be fully restored in april under governor brown's proposed budget. supporters argue eliminating the subsidies will force many parents to quit their jobs and cost taxpayers more in welfare. >> dale steinberg has yanked the chairmanship of the city from a republican lawmaker who told reporters the state budget is the democratics' problem. they told report earth after republican members with governor brown on tuesday that no one in there is ready to support extra taxes. the budget is the democrats' problem and they own it. each member of the senate has the responsibility to address the challenges facing the state. >> 5:07. by friday, a lot of us feeling a little fog by but this morning? >> seeing fog,

terry?> yeah, firefighters telling abc 7 news that the source of the carbon monoxide is two rooms here at the marriott hotel on the 4th floor. two flight attendants overcome by the carbon monoxide poisoning and telling us this is not the first time they've been down here at this hotel for this exact same problem. take a look at pictures last night. you're going to see a whole lot of lights flashing firefighters public health. the reason they were down there in such numbers is because a yellow alert was issued, meaning that there was a possibility of a large number of casualties. that never happened. two people flight attendants we are told, were overcome and had to be taken to the hospital. two other people were affected treated at the scene and released. the firefighters say that they were up on that 4th floor when the call came in. they immediately sensed it was a carbon monoxide problem. they took up their monitoring devices and determined that it was. they also found out it was confined

other top stories in the east bay, let's toss it over to terry mcsweeney. terry?> good morning, amy. it's going to be a meeting at north gate high school at walnut creek. school board meeting this evening about 5:30. an advisory committee is going to produce a list of three schools it's recommending for closure. take a look at some of the reaction. this is pictures from silverwood and concord. a rally to keep its doors open. but silverwood is one of the several schools the district is considering closing to save $1.5 million out of $12 million it needs to cut from the budget. enrollment is declining. parents and teachers are saying is there some other way. 5:30 this evening the advisory committee will produce a list of three schools that should be closed based on capacity and other things. five elementary schools and two middle schools. three will be chosen. it's going to be a whole lot of emotion out here. parents and teachers from four schools will be considered the winners and the three other schools the losers. although this is not a final decision. the school

i'm kristen sze. >> i'm terry mcsweeney.have been shot this morning in a safeway parking lot. leslie brinkley joins us live from that city with the latest. leslie? >> i can tell that you this is a very unusual scene in novato to have a safeway parking lot turned into a crime scene. police are here after two men in a parked car were shot multiple times. >> our officers took the call about 12:13 this morning about a shooting at safeway in southern novato. flight arrival officers with two victims in the parking lot. >> the rear window of the white toyota was completely shattered. police say both victims, a 27-year-old hispanic male, and a 23-year-old white male, were both taken to area hospitals with life-threatening injuries. there have been no arrests so far. investigators are on scene working with what they say are very vague descriptions of the suspects who possibly drove away in a gray prius. they won't say if it's one or more suspects they are looking for right now. they are also investigating an possible gang connection
