right now we have five votes for andy biggs. we have three votes for the person's here jim banks of indiana, jim jordan and another person getting the vote as well. so the more votes that have a mccarthy does not get my name and someone doesn't vote present, that is bad news for him here that is why early on in the vote we know this is going to go 22nd ballot for the first time as you say and 100 years. the reason why they are going through this vote right now, it is the first order of vote in the house of representatives once they determine a quorum and everybody into the chamber for the first vote at noon they have a speaker. the first order of business and a new congress is electing a speaker. that is why the house is frozen, paralyzed until it gets a speaker you cannot vote on legislation and you can't put people on committees and you can't start investigation and the hunter biden's laptop, none of that. they can't swear the members and cured right now all of these people you see sitting on the house floor are technically re

jason: and we're back with arizona congressman andy biggs with.ay 16th, that case against michael sussmann is actually going to trial. what's thest that you're hearing? >> well, hearing that there's some e-mails that durham has found that again show that sussmann lied to the fbi and that he also lied and misrepresented regarding the connection of all of this with dnc, which is the democrat national committee, and the clinton campaign and who paid for his bogus, you know, information that he was throwing out there. so it is pretty interesting to see, and i'm not sure that the clinton campaign folks or the democrat party wants to see this go to trial and air their dirty laundry even further. jason: the allegation is that michael sussmann got in with a meeting with the general counsel there will at the federal bureau of investigation by representing that he wasn't representing anybody, but there's other documentation and flow of money and laws and what not. that's why this is a case that is important, because these people have this incestuous relatio
