restaurant. tara moriarty joins us now. we understand neighbors say this restaurant has been a magnet for violence. >> reporter: that's true. neighbors say this is one of the only places to eat when the bars let out at 1:00, 2:00 in the morning and therefore, a lot of people come here inebriated. this area is pretty small inside and outside as well. there's a lot of tension, people say, in this area. if you come in here and you -- over here and you look at this sign, it will show you that this particular jack in the box has been shut down since december 6th. that's on the heels of an incident involving a cal firefighter here. 29-year-old albert bartel got into a brawl with another customer at 2:30, thanksgiving morning at the jack in the box off 11th and geary. police say that customer followed bartel to a nearby gas station and ran him over with his suv. bartel a former marine and single father has been in critical condition with a traumatic brain injury ever since at a bay area hospital. on his facebook support page his mother says that she's hoping for a miracle. now, police discovered that the jack in the box is operating without the proper extended hour permit. the fact that the place is ordered to shut its door between 2:00 and 6:00. now the neighbors are trying to get the permit but some maybes are fight -- but some neighbors are fighting it because of the base and wants to transform the base into a state of the art facility that would manage the flow of cargo in and out of the port of oakland. the group says the new business would create thousands of year. two key reasons are, a hedge fund manager calls the company a potential buyout product and it's still growing. >> i just -- got off the phone with the e pm a looking into allegations of polluting the bay. now the metal recycling company sims metal management is located at the port of redwood city. this is new video. the company shreds roughly 300,000 cars a year along with appliances and other metal products. epa says recent inspections found high levels of toxic material including pcbs lead and mercury in the sediments near the plant and at redwood creek. some of the levels are off the chart. pcbs are up to 10,000 times than what they should be. lead was up to 11 times more than what it should be, mercury, 100 -- 10 -- 110 times. the company is cooperating with the epa. and they've agreed to cease and desist. it will take a significant operational change but that sims metal should be able to make those changes quickly. now the bay area air quality district fined this same company $20,000 for a huge fire five years. the flames then sent a huge plume of black toxic smoke. this is video of the fire. that was back in april of 2007. i'll have more comments from the e.p.a. in the -- in the next hour. reporting live from the newsroom, i'm pam cook. >>> right now the ntsb is holding the hearing on a -- on the safety of a popular summertime activity. airshows and air races. the pilot and ten other people died in that crash. regulators say there have been 150 accidents at races and shows in the last 30 years but this one was the first time spectators have been killed. the ntsb wants to protect both pilots and their fans. a las vegas man claims a united airlines employee threaten him at san francisco international airport. ivan gonzalez was trying to check in his 6-year-old son for a flight to boston on january 2nd. mr. gonzalez said the airline employee said he had not paid the fee to allow his son to travel alone. he recorded the conversation on the cell phone and he posted it on the internet. the conversation got heated amount would. -- a bomb can be heard saying "i get off at 9:30. why don't you meet me outside." united airlines said they apologized to gonzalez and offered him compensation which he refused. >>> airbus unveiled the 525 passenger a-3 0 model back in 2007. quantas and sing ga pore say they repaired tiny cracks on at least >> reporter: yes. that suv ended up in the front yard and i will hear from the woman who owns that house. i want you to see the progress they are making here between camden and baskem. they just said they are -- almost finished. they this have to cut the lines up. we just shot this within the half-hour. there are cars lined you top quite a -- lined up for quite a distance. they are all trying to get to the freeway which is half a mile west from here. they are being turned around by san jose police and that's creating quite a mess and will stay that way until the crews are done doing what they are doing. leslie brady is the woman who lives on camden. she actually had the suv end up in the yard. thank you for joining us. what did you hear when this sound -- sound exploded in your front yard. >> first it was a great, big explosion and then the lights flickered and another explosion and the flights -- and the lights went out. i lan to my front -- i ran to my front door and -- i could see all of the dust. arking of the wires. the wires were down. and people whether yelling watch out for the -- were yelling "watch out for the wires" and when i went out, there was a man talking on his cell phone. i thought he was a passerby. but he was the driver of the car. >> he was okay? >> he was okay, just standing there talk on his phone. he must have had to crime out of that -- climb out of the car. >> this is the first time this happened to you? >> no. one time a telephone pole ended up in my yard and he ended up face down in his truck. we lost a car. too. >> reporter: that accident happened around 8:00 last night. pg&e worked through the night. they got most people back online now. they say that most people will be back online by noon but there is a school called -- called camden academy. i talked to a supervisor earlier today he said that school will not be back online by noon. that will take an additional eight to ten hours. reporting live, kraig debro, ktvu channel 2 news. >>> 8:03. in overnight news, the search continues for the driver involved in a fatal hit-and-run crash near oakland's eastmont mall. it happened around 11:30 on 73rd and bancroft avenue. allie rasmus is at police headquarters. what has a friend of the victims told you about the crash. the man was crossing the street. it was a busy four-way intersection and he was in the middle of the intersection when a car came and hit him and the car just kept driving right after that. let's show you the video of exactly where in happened. this happened over at 73rd and bancroft as you mentioned around 11:30 last night. now, that is located just a couple of blocks away from the oakland police station. they don't have a lot to go on. according to the police report, there were no witnesses at the time who were there that could describe what the victim looked like even with the -- even the friend who was with the man couldn't get a look. >> i saw my friend laying on the ground. i called for help. >> reporter: the man was rushed to highland hospital where he died from very serious injuries. we don't know his age or identity. surveillance cameras were mounted on the gas station right next to this crosswalk where it happened. there is the possibility of some of what may have happened may have been captured on video. we asked to speak to someone from the traffic division and have not heard back from them. san ralph -- in san rafael, police say a woman was assaulted after she walked in on burglars in her home. this happened around 1:30 on woodland avenue. police say the 27-year-old victim interrupted three burglars. she was knocked unconscious after one of them punched her in the head. she was table to call police later after regaining conscious nbc. but by then, the suspects had escaped. if you have any information about this, contact san rafael police. >>> 8:05. time may be running out. business and labor leaders in san francisco are still not giving up. and today they will meet to try to keep the 49ers in the city of san francisco. the group still thinks it can convince the team to move into a home at hunter's home near candlestick park. that calls for an all-weather stadium with a retractible roof and shows off gorgeous views of the skyline. the 49ers are moving forward to move into a billion-dollar stadium, possibly as early as 2014. the 49ers are getting ready for the big playoff game against the saints here. san francisco lee is arranging a bet with the mayor of the rival estimate he is prepared to offer up crab, chocolate and sourdough bread. lee would like some big easy crawfish if the 49ers win but he's still waiting to hear back from the mercury. >> the mercury -- the complaint filed says hospital officials would not allow the state and conciliation service to count the votes -- to vownt the votes to decertify the union. the hospital has campuses in both mountain view and los gatos. a sailboat running ashore led to a lot of proems ble. this happened on friday. both became stuck in the low tide. the marin county told the marin i.j. that sausalito police found ricky extremely intoxicated. he wouldn't believe the boat and then there was a standoff. p after about an hour police tasered him, pulled him off the boat and took him to jail. >>> 8:07. we want to check in with sal for an update on the commute?
