let's get some insight from former cia counter terrorism official phil mudd.this video of the suspect in the alley behind the headquarters there in washington. there's the suspect with a backpack. what does it say to you that this guy is still on the loose? >> it says a couple things. if you look at the video and the timestamping he won't be on the loose forever because they know when this was planted, they can look at video from a neighborhood, they can try to determine whether this person took the metro into this area based on video from metro stations, timestamp it and find people in the same area from the riot at the same time and ask them for identification but it says one more thing to your point and that is this person took some effort to obscure themselves. you are looking at someone who tries to ensure that their face doesn't appear on video. in my judgment that's purposeful. contrast this, for example, to what we have seen in the past in the boston bombing when people didn't do that. so i think the person probably thought about what they were doing b

with me now, elliott williams and counterterrorism official phillip mudd. great to have you on. elliot, just flat out, could the president of the united states actually face any charges here? >> he could. at a minimum you could have an investigation of the president for what would be inciting a riot. literally there is a federal riot act, for lack of a better term that lays out when you have a group of individuals engaging in acts of violence. the problem is just going to be tricky to convict him of it. like i said, you could investigate him for it, but you're going to have to prove the specific acts of violence were at the behest of the person who urged them. now, the president can certainly have the defense that, well, i was urging people to protest as is their right under the 1st amendment, but those guys who were engaged in violence, that wasn't me. it's going to be harder to prove, but you could certainly charge it and you could certainly investigate it. >> phil, all these people, as i mention the, not wearing masks so they're easily caught on video. t

i want to go to phil mudd, also former cia, and our political analyst. in light of what evan said there, all 50 states and the capitol in washington. all 50 states. how concerning is this? >> i tell you, there's questions that you just heard about the fbi, those would not be the questions i would raise. look, there are fewer than 15,000 fbi agents across 50 states. the concern i would have is a facility that is the u.s. congress, the u.s. capitol that has its own police force that had warning of a threat, couldn't manage the mob of people who overwhelmed the capitol police. multiply that by 50 times. you're telling 50 states, sheriffs and local police, because the fbi can't secure this, look, there is a chance that not only people, but armed people, will show up at your capitol and try to overrun your capitol as the u.s. capitol was overrun. the problem i see, erin, is a problem of numbers. you cannot coordinate a national response to secure 50 state locations that's too many space simultaneously. you can't do tit, erin, you jus can't. >> which is pretty
