bob redell live in san franci o francisco. bob, muni workers can't legally strike. that's not allowed. sickouts are the next best thing. but even the protest leaders can't publicly say don't come in. the union representing didn't organize yesterday's sickout, it appears that was something done on behalf of the workers. a proposed labor contract and they are doing it again today. the second day in a row. this according to muni they're telling us that about 300 transit operators have called in sick for today. that is fewer than who called in yesterday. yesterday around 400 and today around 300. that still not enough to get the transit back to full service because they typically have around 600 transit operators in the bay. so, be running around half capacity. so, you do have some buses leaving here from the bus barn here at mariposa and bryant but not the complete number you'd have on a tuesday morning. as a result, the muni is telling you that there will be a major impact to service today again. in an effort to discourage the sickout, they did release this memo to it

nbc bay area's bob redell is in the newsroom with the latest from the state capitol. bob, what happened? >> we just listened to an audio feed on this thing. good morning, sam. audrie pott's parents and proponents of the bill were hoping they would move forward audit audrie's law, but they have pushed the vote on this until next tuesday. so no decision today. audrie pott's mother was afraid this was going to happen which is why she and her attorney held a news conference yesterday to counter the opposition to the bill. if you're not familiar with her daughter, audrie, she was a 15-year-old high school student who was sexually assaulted and photographed. she committed suicide after those photos were circulated. senator jim bell proposed audrie's law. this morning at the hearing, lawyer's groups and at least two of the seven assembly members on the committee opposed the mandatory minimum, calling it ineffective, too arbitrary, saying that the juvenile justice system should be focused less on multiple and more on rehabilitation. audrie's mother thinks the law isn't strong

"today in the bay" bob redell is live in san jose near that area where police are looking for clues. what's the latest, bob? >> within the past half hour the homicide unit with the san jose police department has arrived out here to this location to try to figure out what happened to this man. what they know or at least what they're telling us appears to be very limited. they do tell us that someone saw his body down the road from where we're standing. officers arrived around 1:20. they found the man unconscious, not breathing with obvious injuries. the fire department declared him dead on the scene. whether this was a hit or run or something else. if you're not familiar with this road, this is a two-lane road that runs right up against the foot hills of san jose. as you can see, it's not lit and any street lights and it is very dark and it's our understanding that pd will have this road shut down for quite some time well into the daylight is what one officer told us. this is not a road that is going to be opening up any time soon. but, fortunately, this is a local road and not a road

bob redell has been out along that road since it was dark out. evidence at the scene indicating it could be a deadly hit and run. what do you know? >> definitely suspicious. the man found dead here down around the bend there on piercy road is where he is located right now. the police do not know if he was murdered or he was killed in a hit and run accident. someone called 911 early this morning to report the body. when they arrived around 1:20, the officers, that is, they found the man face down, unconscious, not breathing. obvious injuries to him. fire department declared him dead on the scene. police say there are tire marks nearby that indicate this could be a hit and run, emphasis on could. not 100% certain on that. the coroner was able to turn him over and get a better look at his injuries. >> he's laying face down and maybe some other injuries that give us other indications as to the extent of what happened here as a result of maybe that he was hit by a car or they may discover something else. again, too early to determine. >> officers did

bob redell is live in san jose. how much more water are people using? >> reporter: good morning, kris. we just spoke with the san jose water company which delivers water to around 1 million people here in the city of san jose. they tell us the water usage is up 3% to 4% when you compare the first quarter of last year, with the first quarter of this year. that's in spite of the company sending customers their inserts in their bills asking for a voluntary 20% reduction in use. the agency blames the increased useage on an extremely dry winter. but all agencies had an extremely dry winter, yet some saw their customers cut back on usa usage. the public utilities commission, we spoke with them this morning, they say it's 180,000 customers cut back by 8% over the past three years prior to may. but they are still falling short. they admitted their voluntary cutback of 10%. east bay, they serve 1.3 million people and they tell us their customers have met their cutback challenge by reducing their water usage by 10% since february. that brings us back to san jose

"today in the bay" bob redell joins us live from the camp where workers are getting ready to receive campers and, bob, it must have taken a lot of work to get to this point. >> a lot of coordination. good morning to you. if you were here in this spot it would have been an inferno. the camp site that burned to the ground, nothing but a shell. as you can see, the san jose family camp has rebuilt this camp site along with 16 other camp sites as you look around the camp ground here. now, what is remarkable is how close they were to possibly losing the entire camp site, which includes around 65 tents. because if you look at the ridgeline up there where the sun is coming up, that's where the fire was and then extended all the way around in a horse shoe pattern around the site here, the san jose family because of the efforts of cal fire and by having the luck of having some roads nearby, they were able to establish fire lines and keep this fire from expanding to much greater area in this particular spot. it was in january that san jose family camp brought on a new manager to be tasked with r

nbc bay area's bob redell is live in san jose. and bob, this doesn't just apply to the unincorporated parts of the county, as is sometimes typical of the county. >> it is. good morning to you, kris. and this is in response to the fact that there has been little or no regulation of what some refer to as the wild west of new cigarette technology. so, just moments ago, within the past 15 minutes, the santa clara county board of supervisors set up new ground rules to be governing electronic cigarettes. in a unanimous vote, the board passed an ordinance that will essentially treat e-cigs just like regular tobacco. so wherever regular tobacco use is prohibited by law, a restaurant, bar, motel, office, e-cigs will be prohibited in those places as well, in unincorporated santa clara county. except for in private units and apartment and condo complexes. the new ordinance will also require e-cig retailers to obtain permits and follow the same requirements as regular tobacco retailers, again, with one exception. they would still be able to se
