i am matt lower along with savannah guthrie.urt, and the justices weighing in on divisive action. and let's get right to our justice correspondent, pete williams, who is outside the court that will tell us about the decisions. >> reporter: the supreme court has given the lower courts in this case an incomplete and told them to try again to decide whether the affirmative action is constitutional. affirmative action can be allowed constitutionally only in narrow circumstances, so it basically raised the hurdle for the university of texas to clear. it's an unusual program, it admits the top 10% of all high school graduates in the state and that gives a certain amount of racial diversity because some high schools in texas are predominantly minority enrollment and then the university used race as a plus factor in filling the rest of the class. what the supreme court said is be careful when you do this, a firmtively action is when you give one race an advantage over another. it's an 8-1 decision. that's one of the most surprising thin

couple of days ago in the northern areas of oklahoma that was actually yesterday afternoon around guthrieas on t$e ground for 30 seconds. did damage in the 30 seconds and then lifted again and then miles later. that is often the case with the rotation in these tornadoes and that is why we can't say for sure with the run crossing over interstate 35 that there is contact with the ground at this point. >> shepard: we are waiting for more iñformation out of st. louis where we know there is a tornado warning but you i have just got then. the st. louis cardinals announced their game with the san francisco giants this afternoon is being postponed because of the forecast of the approaching extreme weather and they got this recommendation from public safety officials. the cards and giants postponed due to what is now a tornado warnen in the st. louis area. can you give us any more on st. q9louis? >> i'm glad to hear this they canceled that. the national weather service office in st. louis had to be evacuated and take shelter because the tornado potential tornado was headed directly towards them. i

guthrie: you hear stories like that all the time at home. we have someone who was developing a chaven restaurants in new england, he was before the committee, he said, he had eight restaurant it's and planned to, this was his testimony, to open a ninth answered decide he had to wait because he has no idea what this health care bill is going to cost him when he has to provide health care for his employees. and he said that, of his net income, of his eight restaurants, he has estimated if he can come up with it, because as we know, you still know exactly what has to and what the health care bill's going to look like or -- we know what the bill looks like, we don't know what's really in it because the rules have not come out to say what you have to provide your employees. and this is supposed to happen in october and be ready for january 1. and so he's decided just not to open a restaurant. until this gets implemented. so he can move forward. and he said it's going to take half of his net income, what he's estimated, if what's in the rules come

guthrie for five minutes for questions. >> thank you, mr. chairman. first couple of questions for dr. throckmorton. i'm from kentucky and we've been really aggressive trying to do with the drug problem in our area and the tamper resistant technology has been important. in your written testimony there were two recent determinations from the fda on different formulations for oxycontin and upon a er. can you explain what there's two different determinations of those cases about the drug resistant technology? >> sure. i'll speak in general terms. in both cases we looked at the available data on that product and then in comparison with the earlier formulation originally developed in us questions about whether or not the new technology promise to reduce abuse. we think it's terribly important that this power of concluding something deterrent behind to be worth developing come and make it something we can reward in labeling terms to make those products attract different manufacturers to take the time and money to develop. in the case of oxycontin when we loo
