katie marzullo joins us with the story. katie? >> this is a great neighborhood, big million dollar homes, quiet families live here but this morning at 7:00 a.m., shocking violence rang out at a home just around the corner from where we are standing at the crime scene. police say officers were called to the home just after 7:00 a.m. and two officers arrived on the scene. the shots rang out shortly after that. a man was wounded. he lives in the home. that is all we know officially at this point. neighbors heard at least two or three shots. the man is in surgery at the medical center and is expected to survive. the police chief wrapped up a news conference says this began with several 9-1-1 calls but in each case the callers hung up. >> two of the officers responded to the locion on their arrival, they approached the residence, the subject came from the home with a knife. the officers order the subject to drop the knife. several minutes later, shots erupted from the officers. >> it is a friendly family as far as i know, more friendly

abc7 news reporter katie marzullo is at the starbucks. >> customer-wise it is quiet. we have some employees inside getting the starbucks ready. in a couple of hours we will hear from the san jose police department, the major outstanding question this morning. why? why would someone do this? police think they know who did it and were able to arrest a suspect yesterday after the incident. she is 50 years old. she is not suspected of working with anyone else or any group and they do not think she has done this anywhere else. it happened at starbucks in san jose. she walked in, sat two bottles of orange juice on the displace with the others and left the store. customers would saw her do it were obviously suspicious and they brought it to the attention of employees who smelled something training coming from the bottles and they called 9-1-1 and the fire department came out and investigated. they believe one of the bottles was a mix of orange juice and rubbing alcohol and the other orange juice and nail polish remover. one employee was able to get the woman's license plate

good morning, everyone, i am katie marzullo here for kristen sze this morning. we begin with developing news. chevron has released a report into the cause of the refinery fire. the company admits the august leak that led to the fire was caused by corrosion that damaged a steel pipe. they say the damage was not appropriately documented in inspections in 2002 and 2011. the report also says fire teams did not recognize the risk of rupture and ignition when the leak was first discovered. chevron is not implemented new procedures to prevent -- they now are, including enhancing inspection procedures, trentening communications, reviewing training programs and implemented new protocol for evaluating leaks. >> a somber morning at san lorenzo high school after a classmate was hit and killed by a train during an ill fated game of chicken. abc7 news reporter amy hollyfield is at the scene of the accident near the school. amy hollyfield? >> the principal is dealing with traumaized students saying they have placed decorations around his locker and they have asked it stay like

abc7 news reporter katie marzullo is in the newsroom. dzhokhar tsarnaev has been moved from the hospital to the prison. we have these aerials above the facility. the u.s. marshal identified the facility as in massachusetts, a medical facility of the prison. it is a fairly small building. he was moved under a convoy and the transfer took place without incident. it is not clear whether he was flown or driven there. we learn this morning that his father is not leaving for the united states today or tomorrow from the lawyer. we don't know why the trip is delayed. this morning, we get to hear from the man who was carjacked by the brothers on thursday before tamerlan was killed in a police shootout. the victim is 26-year-old entrepreneur who said he thought he was going to die but he escaped when they stopped for gas. dzhokhar tsarnaev had to pay cash and tamerlan put down the gun he took off the seatbelt and were order the door and ran barely escaping his reach. another victim, 11-year-old aaron hern of martinez has been in a boston hospital

abc7 news reporter katie marzullo joins us with the reason the chief is backing away. katie? >> the chief says that after tightening the policy for how the tasers could be use the, usage was too restrictive. the chief has heard a lot of public suggestions on how and when officers should be allowed to use tasers such as you cannot use a taser on an elderly person, a child, a very thin person or any person too close to traffic so when he added up the limitations he worried officers would give too much pause to if they should use the taser and it would put them and the public at more risk. the chief proposed the tasers in july after police shot and killed a man armed with a box cutter in the financial district. he was on the run after stabbing co-workers. in august he told the commission he wanted to prevent another deadly shooting like this. >> you cannot do anything about the last person but my idea was to do something right now, tonight, about the next person. >> the police commission has rejected tasers twice over the past three years. out of the 20 launchest metro areas in
