[ singing ] >> reporter: some sang songs as police moved in to arrest them. >> reporter: police arrested 33 people. no violence or any injuries. the mayor who first resisted said the conditions badly deteriorated. >> it was no longer about the financial system, closures, unemployed, it good b came a police where we had violence and this week a murder. we had to bring the camp to an end before more were hurt. >> reporter: officials made another decision to keep the frank ogawa plaza open for peaceful protests around the clock but no sleeping or camping. >> we don't have any reason to keep people

a ktvu news crew took these pictures just before 6:00 a.m. you can see demonstrators urging port workers to turn around. there were some tense moments when protesters used metal fencing to try to block the drivers. port officials say the port was back open after a few hours. >>> protesters released a letter for mayor quan. the vandalism, business losses and general fear is not an acceptable condition for our great city. what is your plan? >>> today oakland police blamed a splinter group for the overnight vandalism. officers fired tear gas to disperse protesters who broke into a vacant building and set fires in the street around 16th and broadway. police say in all they arrested 101 people after midnight. 25 women, 76 men. 32 are from oakland, 46 are from other bay area cities. most of the protesters were arrested for misdemeanor unlawful assembly. one man from elk grove is facing felony vandalism charges and an oakland man was arrested on assault with a deadly weapon. >>> and now protesters are trying to determine how to counter the violence.

and ktvu has more on the court's decision and also the town's reaction. rob? >> reporter: frank, it happened right in this crosswalk, the two-year-old girl was struck and killed by a driver who was texting. today, 11 months later that driver learned she will be going to jail. 19-year-old dunaway walked out of the sonoma county superior court hearing her sentence, five days in jail, 115 days of home detention. she wouldn't comment, but the father said it was the wrong sentence. >> i don't think it was enough time in jail. i think there should have been more time in jail. but i don't get to make that choice and it hurts. >> reporter: last december, dunaway was texting a friend during the drive. cali murray was walking home with her mother, she was killed, her mother still recovering. >> the photo albums lay next to her every night. and so in the middle of the night i'll wake up sometimes with her looking there and crying. >> reporter: before the sentencing, dunaway told the court if there was anything i could do to take back what happened and take back the pain

we begin with ktvu's david stevenson. he's live at ed lee's election coverage. >> reporter: i'm actually standing outside the restaurant in a moment. more on that in a moment. about a half hour ago, mayor ed lee essentially declared victory on this with more results to be coming in. but essentially he said that the city wants more of what his administration has had to officer. here is a look at more video we shot from inside. you can see supporters, ed lee family's joining him on stage as people celebrated the early results coming in as you mentioned. the mayor's appearance came after those early results indicated he had obtained about 30% of the mail in ballots. but again not quite enough to avoid triggering the other process that's going to take place in this with ranked choice voting. joining us right now out in the parking lot at the victory party is mayor ed lee. we want to thank you for making time for us. you ended upcoming out here because there was quite a bit of crowds with reporters a lot of questions pressing
