"today in the bay's" marla tellez with the latest developments.d morning. >> good morning, laura, yeah. that is certainly the big news of the morning. the san mateo county d.a. is confirming that his office has decided not to file charges against 20-year-old deshon marman. of course he was pulled off that us airways flight back in june, june 15th, almost a month ago for refusing to allegedly pull up his sagging pants. joining me live is the d.a. himself, thank you for your time this morning. this news just came out this morning. why did your office come to this decision? >> our conclusion was after reviewing all the facts of this incident that this was a case that we don't think belong in a courtroom and we think a jury would tell us that if we did take it in the courtroom. with the all congestion in the courts we don't need to clog up the courts with a case that's presented here. >> a statement your office released, we believe the officers on scene acted appropriately and professionally, we do not believe criminal charges are warranted. so you do

marla tellez joins us live with more. good morning. >> reporter: good morning, laura. talk about an emotional roller coaster for the stow family. they were elated when the lapd made the announcement they made an arrest in the case. well, now this major development. late last night nbc bay area confirming with the lapd they have in fact arrested two new suspects in the bryan stow beating. the question this morning is what does this mean for giovanni ramirez. you will until this point he has been deemed the main suspect in the beating. he was the one lapd arrested in may. ramirez is serving a 10-month prison sentence in san diego for an unrelated parole violation. he was never formally charged with the stow beating. his attorney contending ramirez was never at dodger stadium march 31 t day stow was nearly beaten to death following a giants/dodgers game. >> this is a true lesson of the judicial system in this country, the fact that everyone should be assumed innocent until proven guilty. when i jumped in to the case it was the opposite. >> reporter: for the suspects, l.a.

marla tellez joins us live this morning with a preview. good morning, marla. >> reporter: good morning, laura. later this morning chief anthony bass is going to give details to the plan to reshuffle his department and those changes are going to be implemented very soon, this weekend, in fact. in the wake of budget cuts the police chief says the department needs to be reshuffled because it currently has 638 officers. that's almost 200 less than its peak strength of 832 officers. that was back in 2008. a year ago budget cuts forced 80 officers to be laid off. what's worse, attrition has his department losing six officers a month for the next two years. the chief says the major feature of his reorganization plan is to divide the current bureau field operations into two bureaus, each to be led by a deputy police chief. now, how this is actually going to affect public safety and what this means, we're going to have to wait to hear what he has to say today. in a letter to oakland, residents chief batts writes -- the president of the police union

thank you, marla tellez live from san jose airport. pretty clear shot there, what about across other parts of the bay area. i want to check the forecast with christina. >> if you are trying to catch a flight out of sfo right now we don't have delays but we have some very, very low cloud ceilings so we'll keep watching that. could see delays. people trying to get in to sfo. you can see we're dealing with an interesting weather pattern out there. high pressure. you see that clockwise rotation, all of the showers moving 18 clockwise fashion. that's monsoonal moisture. it's going to feel sticky, muggy in the south bay and we could see a couple of thunderstorms, a couple of those cumulonimbus clouds developing later today. you can see where the showers are. they haven't made their way in but we're fair game for that. we'll be watching that. looking pretty good. on shore flow is pushing that ridge to the east. so maces in the north bay and everywhere north of the golden gate bridge will likely stay nice and dry. 56 in napa, 54 in oakland, he

marla tellez is live in san jose this morning. such a brazen attempt, marla. >> reporter: laura, it's really hard to even imagine. this is the neighborhood where it all unfolded. the closest main intersection is park and meridian, we're on park this morning on the 1200 block where it happened. now, in this neighborhood it's a mix of small businesses, some pretty nice homes, some apartment complexes, and in fact, we're only about a mile away from the rose garden down the way behind us here. the attempted kidnapping happened monday night about 9:00. police say 26-year-old myra flores approached 3-year-old jasmine and her 14-year-old sister denise. flores tried to lure jasmine away by offering to buy her candy. her teen sister knew better so she took her sister inside their second story apartment. flores actually followed them, forced her way inside and tried snatching jasmine, convinced that jasmine was her own daughter. >> she said like no, that's my baby. then she tried to grab her. yeah. and my mom tried to stop her and then like

marla tellez joins us live in san mateo with the latest. good morning. >> reporter: good morning. behind me the end result, this is what happen you slam into a fire station. a pile of debris, and then inside you can see there is damage in the interior. i should explain this is station 27 off deanza boulevard. what we're told this is the off ramp from 92 westbound. the driver allegedly took this off ramp, lost control, then crossed the street and slammed into this fire station. we have the video from last night. you can see the white gmc yukon and all of the fire personnel. no firefighters or personnel hurt but the two people in the suv, there were two in that msu. the extent of their injuries not known. this has not been confirmed but what wer hearing it was a female driver, a mother potentially driving drunk and her 17-year-old daughter was the paelg. the 17-year-old grabbed the wheel as she could see her mother was losing control. this is not confirmed but we have put in calls to the san mateo police department. they are investigating this accident. we're waiting to get that inf

marla tellez joins us live in san mateo with an update on the case this morning. good morning. >> reporter: good morning, laura. that is absolutely correct. we are awaiting official word from the san mateo d.a. in redwood city. official word is they have decided not to file charges against deshon marman. this has not been confirmed yet. this is a talker of a story we reported a month ago when marman was arrested at sfo. marm marman was arrested. he was pulled off for refusing to pull up sagging pans. he was arrested for battery of a police officer, resisting arrest and trespassing. just yesterday more than 100 people rallied at san francisco city hall, including his mother donna doyle in support of her son who plays football for the university of new mexico. she says this is a race issue and she wants her son's record cleared and an apology from the airlines. >> this is awesome that you are taking the time out of day to come out and support my baby. >> us airways says it does not have a dress code but expects passengers to dress in an appropriate manner that does

"today in the bay's" marla tellez on how they captured the suspect. >> good morning.n park where the stabbing took place is a popular spot for people to come with their dogs and go for a stroll. we've seen a couple of people doing that bright and early this morning. it was on the same property as erickson elementary school behind us near almond and branham. it's hard to believe he was stabbed while walking his dog in the park. it was still light outside, just after 5:30. the boy was approached by two teen boys. they asked him if he was in a gang. he said no. they began punching him and stabbed him in the back several times. he survived. in fact he's expected to be release freddie valley medical center in the next couple of days. that's good news there. mark hernandez, he lives nearby. we stopped him this morning as he was walking his dog. he said hearing the news is alarming. >> shocked, i guess. i have two young kids and they come here all the time and play in the park. i told them they can't come over here anymore. we have noticed more increase of people hanging out

i'm marla tellez. this morning a driver is in the hospital with severe injuries after slamming into a big rig earlier this morning. the car plowed into the big rig around 2:15 on westbound 580 in livermore just east of spring town. you can see here the car was dragged along the highway before the rig came to a stop. the chp reopened all lanes of that freeway at 4:15 this morning. no word yet on what caused that accident. this morning vallejo police searching for the person who shot and killed the 30-year-old woman at a hotel parking lot. this happened late last night. a hotel guest called 911 about 11:30 last night to report hearing shots fired at the deluxe inn on solano avenue. so far they are not releasing any information about the possible suspect or suspects. >>> now turning to your forecast, we turn to meteorologist christina loren with a nice layer of overcast in the city behind us here. >> actually we're only seeing that fog and low cloud cover over the bridges. we have a beautiful clear start

marla tellez is monitoring the situation in florida from here in the bay area. lots of people want to watch what's going on. she joins us live from nasa ames research center with the latest. good morning. >> reporter: good morning. we're inside the nasa ames exploration center at moffett field giving you a look inside, i sound hollow now because we're inside a training module. this is a scientific laboratory that folks can check out if they visit the center here. and then across the way allen is going to give you a look at the theater where about 600 people are expected to be this morning to watch the final launch of space shuttle "atlantis." right now it is still a go. the latest word is the weather is improving, so good news there. the forecast still calls for only 30% favorable conditions. just yesterday lightning struck about 500 feet from the launch pad. fortunately, nothing was damaged. "atlantis" is scheduled to make its final ascent to the space station with a four-person crew at 8:26 a.m. pacific time. one of the crew members is a uc-berkeley grad and s

i'm marla tellez in for her. tgif. christina loren says it's going to be close to perfect though fog, huh? >> yeah. we got a little fog this morning. we're blowing the fog horn. the good news it's not quite as foggy as it was at this time yesterday. throughout this afternoon our temperatures will be cooler, stubborn area of low pressure is providing that foggy start. right now it's not that bad, over the next hour, you're getting ready to hit the highway could be a factor. >> clearly it's tgi fog then. we're looking here, the north bay construction, that's causing the unusual slowing. look at that into san rafael. we've seen the speed shift. the construction crews should be picking up over the next half hour. slow in some spots reduced to one lane out of 137 down to central san rafael. that's an unusual slowdown. we'll watch the rest of the commute coming up. >> it's almost two months since nursing student michelle le was last seen. the search will continue for her this weekend. christie smith joins us live in hayward
