mayorkas.e is joined by his republican you're doing great, scott. yeah, wonderful. >> hello, everyone. hello, thank you for coming out today. thanks for being here and appreciate my colleagues behind me and members of the press. my name is andy biggs. i represent arizona's fifth congressional i also serve as district. the co chair of the congressional border security caucus. with my friend from texas brian babin. today we have former senior officials from u.s. customs and border protection, ice, the border security caucus and members of congress from across the country. first secretary mayorkas has failed to maintain operational control of the border as required under the law, the secure fences act of 2006 requires the secretary to achieve and maintain operational control of the border. it defines operational control as quote, the prevention of all unlawful entries into the united states, including entries by terrorists, other unlawful aliens, instruments of terrorism, narcotics and other contr

mayorkas: not at all. first of all, let me make an important point with respect to c.b.p., customs and border protection, and immigration and customs enforcement, inch c.e., when you talk about their size. their work is far broader than immigration. customs and border protection works with trade and travel. immigrations and customs enforcement combats intellectual property theft, child online sexual exploitation, combating human traffic, countermarkets. so the breadth of these agencies is for a greater than the immigration portfolio. the immigration system, our law have not been reformed for more than 40 years. the problem from administration to administration, regardless of party, is the fact that we are fundamentally working within a broken immigration system. and that is the foundational challenge with respect to the border. now, what we are experiencing at the border today is unique because of the fact that what we are experiencing is not something exclusive to our southern border. it is not something

secretary mayorkas. are the biden ministration's policies encouraging and increasing the pull factor for unaccompanied minors, you a, ceased come into this country? >> congresswoman, a few thoughts, if i may. first of all, thank you very much for capturing the vulnerability of unaccompanied children that migrate from their countries of origin and seek safety. not only in the united states but elsewhere in the hemisphere as i said. at the very outset and i don't -- >> i want to be respectful. i have a limited time. >> this is a challenge that we are experiencing throughout the hemisphere. i also want to thank you for recognizing the bravery of the border patrol. >> thank you very much, i'm gonna relate back to my instances of appearing at the border and hearing directly from people crossing the border that the administration's policies in fact are a pull factor. given that, what actions are being taken at the department to keep these kids safe and stem the flow of a -- stem the flow of uacs crossing illeg

mayorkas? >> i concur with that. i should say, congressman, we have a very, very well exercised and trained methodology to address major events. and that is throughout the inter-agency. and the federal government and we work very closely with state and local partners. this is a very involved architecture that we have built that others learn from the. and we, of course, are in an ongoing learning process. >> my last 67 seconds, i would ask all of you really that -- ask of you which is what else can we do as a committee to make sure that we're coordinating with our allies and friends and maybe even our unfriends around the world to make sure that we stop catastrophic events like 9-1-1. we talk about border security. 9-1-1. the terrorists that perpetrated 9-1-1 entered this country illegally. we continue to focus on the border, on refugees. and the bigger issue is working with our allies around the world and other un-friends to make sure we stop those threats from happening again. what do you need from us to make sure t

now, mayorkas, says that the surge is a global problem., he told the el paso times that the u.s. is experiencing a quote challenge of migration throughout the hemisphere. a challenge that critics argue is of the administration's own making. steve, ainsley and b.k. back to you. >> andy biggs said just saw in soundbite montage, introduced the articles of impeachment against mayorkas last year. he says the law is cheer. illegal aliens shall be detained. that's why they want to impeach him. but, you know what? it's going to be almost-oil it will be impossible. because, in the house, you can pass articles of impeachment by a simple majority. and they could do -- the republicans can do that come january. but, to remove him from office. you need. pause the democrats will continue to control the senate, it's going to be hard to get north of 60 senators to say yep, we got to boot him. he problem on our southern border. which a lot of people don't know about will they are watching other channels. >> ainsley: staggs gearing so far in face equal year

secretary mayorkas, and general, you -- the border is a fact not open.according to public data from the u.s. customs and border protection, which you yourself oversee, we had 227,000 migrant in quarters at -- and september this year alone, bringing the yearly total to almost 2.4 million, which is the highest number ever recorded. do you believe that indicates a border that is not open? >> congressman, thank you for. question please, it's very important that the american people understand that the individuals whom we encounter, who are not expelled under the public health authority of title 42 are placed in immigration enforcement proceedings, and are subject to removal if they do not qualify for the relief that the laws of this country vibe. >> respectfully -- >> i have a limited amount time, and several questions, if you just give me a quick answer, i would really appreciate it. among those, nearly 2.4 million encounters, we had 98 non-u.s. citizens listed on the terrorist watchlist who were caught trying to the homeland among ports of interest. this is

first question would be for secretary mayorkas. as you recall, mister secretary, in the last year, i place if you get concerns about the critical -- teams with customs and border protection, and their involvement with internal investigations of cbp agents. these units, as we understand, have been operating since 1987, but their investigations were never authorized, because they are not legitimate federal investigators, and their actions seemed to shield cpp agents from liability. so, i was pleased to hear commissioner -- directive to end the use of critical incidents teams by the end of the fiscal year, prior to his resignation. however, the existence of such an entity for over three decades is disturbing. it undermines the transparency needed with the nation's largest law enforcement agency. so, i hope you share my concerns regarding the protect the integrity of dhs, and all these components, to be there is no place for shadow policing within customs and border patrol as we speak to efforts the department is taken to ensure that a

secretary mayorkas, can you discuss how dhs is working to implement the national biodefense strategy. how is the creation of office of health security dhs efforts in the space. >> mister chairman, that strategy really speaks of a fall society approach, not something that the federal government can do alone, but, we need state and local partners, and private citizens, nonprofit organizations, academia. it is a very holistic, inclusive approach to the problem. that is the approach that we are taking and the department. through a sea wmd, the countering weapons of mass destruction office, the office of health affairs, and, importantly our office of science and technology with the research and development that it spearheads. i am grateful to this committee for really moving forward with the confirmation of dimitri -- as our new undersecretary for the office of science and technology. it is really a very all of society approach. our leader of the office of health affairs, our chief medical officer is a tremendous leader in identifying what are the greatest threats that are imminent, or upo

we just watched your colleagues talking about a move to impeach alejandro mayorkas.rtment of homeland security chief. what would be the grounds? how would you pursue that specifically? >> that's exactly the question. you have to think leader mccarthy said it right. he said in order to do an impeachment proceeding, first need to do the investigation. don't forget, there's standards for impeachment. it's called high crimes and misdemeanors. we have to build our case just like as we did as a prosecutor. you build your case and bring the charges. you don't bring the charges and build your case. >> martha: you think your colleagues are getting out over their skis on this and would you recommend that they pull back and wait for the investigation? >> i don't think they're getting out over their skis. they're expressing frustration with the madness at the border. one million got-aways under this administration. one million people that we have no idea where they are in this country. that is just the people that we're able to document through video. that's not all the others t
