if you missed any of this, let's get you caught up with scott mcgrew. you've been following this closely. >> reporter: you remember attorney general bill barr told the american people more than once the mueller report exonerated the president and did so before any of us were allowed to read it. that set the tone for many americans. the president was off the hook, he said. but we now know, mueller sent barr a letter warning the attorney general he was sowing confusion and undermining public confidence in the report. and indeed the whole purpose of the special counsel with his erroneous conclusions. so it's in that context barr faced a senate committee hearing today asked by democrats, why did you tell us in previous testimony you didn't know what mueller thought of your statement to the american people? he wrote you a letter saying you had issues with them. here's that very simple question, simply asked and barr's response. >> why did you say you were not aware of concerns when weeks before your testimony, mr. mueller had expressed concerns to you? that'

scott mcgrew joins us to explain what it means. >> the whiou government, the executive, owns the unredacted mueller report, and congress can't have it. in a letter to congress, the white house says the unredacted mueller report contains information about investigations the justice department needs to keep secret. it's not entirely uncommon for a president to claim executive privilege. nixon, reagan, both bushes, clinton, obama, they've all done it. what we don't know is how the white house will plan to defend his refusal to let former white house counsel don mcgahn testify. here you'll have a tougher time claiming executive privilege because the white house already allowed him to talk unrestricted to the special counsel. so what now? the house can find barr and mcgahn in contempt. there's a committee vote right now, in gto the courts and rely on the courts. there are times in the trump administration to put it mildly that we've been in uncharted territory. this is not one of them. we've been down this road with ags and contempt and executive privilegbeood deal. thank you. >> turning to our

scott mcgrew, so what happens now? >> that's actually a really good question, marcus. theoretically, congress could have mcgahn put in handcuffs, but that's not at all likely. the scene from capitol hill this morning with an empty chair where mcgahn would have been, he had been told by the white house, the justice department, don't show up. now, it's likely congress will go to the courts, have the courts order him to testify. the white house says mcgahn shouldn't have to answer questions for two reasons. first, it's reasonable for the president to expect some privacy, that his legal staff shouldn't have to talk about private conversations in the white house. second, mcgahn did talk to mueller over and over. but that was not enough for democratic chair jerry nadler. >> when this committee issues a subpoena, even to a senior presidential adviser, the witness must show up. our subpoenas are not optional. mr. mcgahn has a legal obligation to be here for this scheduled appearance. >> now, again, this may end up in the courts, but there is another option, and that's impeachm
