ambulance to clay county west virginia. there was a note work of e-mails that went out that indicated the suffering that west virginia was going through and in that it was indicated that they had lost at least one ambulance, it had been totaled in clay county and they were desperate to get a replacement ambulance. we recognized that the ambulance was something that we could help them with very quickly. the west virginia fire mens association thanked wheaton on its facebook page. civil rights act advice and former d.c. delegate reverend walter fount roy was out of jail. fox5 was there when the 83 year old walked out of jail and hugged his wife whom he hasn't seen since 2012. he was charged with writing a bad check for $55,000 for an inaugeral party. today a judge recalled font roy's arrest want and ordered his release. the law worked. he was charged with want for being a fugitive. that want was release by the courts in maryland, so therefore the jurisdiction here in virginia ceased to exist and that's why the judge allow him

we begin with the former virginia governor's case. after more than a year of appeals, the supreme court has weighed in on this. >> it appears that former virginia governor bob mcdonnell may be getting a new trial. julie what does this mean? >> this was the last ruling to come down so we're still sorting through all of the details but the jury instructions in this case, the supreme court has ruled, were flawed in the way that official acts were flawed. bob mcdonnell will not have to report to prison to serve his two-year prison sentence today but it doesn't mean that he's completely clear yet. the justices found that the constitutional official act is too broad. that means that governor mcdonnell's conviction is overturned but it's going to be up to the u.s. attorney's office to decide if he will be retried. there's a challenge for the prosecutors because the supreme court ruled that what prosecutors maintain that mcdonnell did, bribes that they say he accepted, they completely ce i just talked to nbc pete williams a short time ago and

we could start to virginia.t's down in this area now, flash flood warnings ongoing where they have already seen so much flooding over the past couple of weeks. notice the flash flood watch in the dark green here. that includes shenandoah county. more now to the south and this is the area that's been so hard hit in west virginia. they are once again under flash flood warnings so we hope that they are okay and they are going to make it through tonight's storms. there they are right there. it's a front. you can see that front clearly defined here. the northern portions spinning off towards the east but down to the south, this area is kind of stalling out. that's what will happen tomorrow and that will lead to another round of storms tomorrow. this evening, tracking a couple of storms and showers that move through. 10:00, most of them out of here. watch what happens tomorrow morning. not much. just cloud cover. tomorrow afternoon, a few storms fire up at 3:00, 4:00. one or two could be on the strong side. not expect

the images out of west virginia are haunting. a muddy mess where there once were homes. at least two dozen people lost their lives and many residents have lost everything. thousands remain without power tonight. the president today declared a major disaster in that state. >>> and out west, it's fire causing the heartache. the erskine fire in california has scorched 36,000 acres and as of this morning, was only 10% contained. we have both disasters covered starting with morgan radford on the ground in west virginia. morgan? >> reporter: kate, 300 national guard troops are already on the ground here in west virginia and we are standing in the heart of it. you can see crews toiling away behind me and this mud having washed up into that home and that home, kate, is one of 500 all across the state that has already been damaged or completely destroyed. tonight, floodwaters receding revealing what looked like a ghost town, roads caked in mud leaving families like this one who have lost everything.
