if all this weren't enough, dh dhs tackle some of the more thorny issues, immigration disaster response, just to name two. it is a lot of. one of his trips was to the port first of los angeles which with the port of long beach is the nation's largest container port. surely the challenges there are huge. i joined him on that visit and we did a helicopter flyover. then the marine layer role then -- in and we were unable to land. what a metaphor. navigating through the fog. of course we persevered, and so has dhs, ably led by jeh johnson. it is our honor to have them at the wilson center for the 2nd -- the second time to address the state of homeland security. please join me in welcoming the secretary of homeland security. jeh johnson. . >> to be clear, i think dhs will be funded. you'll never get the paper down two weeks before. this is how congress worked as long as i know it. the president made a decision on executive order which is un popular with the public base, and they are going through extraordinary measures to show discomfort. i don't think using the process in a partisan way works. you want to find bipartisan solutions to this. put the democrats on the spot and build up a case to be made to repeal the order, not do it in a short circuit way, in a way that conservatives will do it. you have the judiciary to eliminate this. this is not the right way to do it. sometimes the leadership has to demonstrate that they are at one with the followership. this is a way to do that. >> you heard brad miller talking about the outcome and you talked about how much they hate this thing. can't they see instead of painting the president. >> a corner, he seems to have painted them into one. >> i think mitch mcconnell when elected did say we are not going to have a shut

while dhs had components in place before prea to prevent sexual abuse, the dhs regulations created uniform effective safeguards against sexual abuse in i.c.e. and cbp custody. my colleagues will discuss implementation of regulations within their components in more detail. from my office's perspective, we operate a department-wide working group to facilitate consistency in implementation where that's appropriate, and we assist the components on various prea issues where we can. crcl was also involved in the development in isis 2008 and 2011 performance-based standards or pnds and family residential standards which accomplish most of the safeguards enumerated under prea. i.c.e. is also revising its standards to incorporate additional prea requirements, and my office is providing technical and other required assistant. i emphasize we understand and take seriously our responsibility to ensure not only that the right policies in place and prea and the detention standards are real improvements over their predecessors, but also that we follow the policies and practice and that we have the right m

the house could easily pass clean bill to fund dhs for the year. it will take only a few republicans to join us and pass it. a woman who identified herself as a dhs employee tweeted, good thing i've been saving money to buy a car. now when the government stops paying me come friday i'll still be able to pay my bills. a blog on the official homeland security website claims that over 90% of tsa workers, about 50,000 employees, would continue to report to duty in the event of a shutdown. the blog entry impacts of a potential continuing resolution or lapse in appropriation say 6,000 civilian employees of the coast guard, three-quarter of its total civilian force, would be furloughed with no guarantee of pay. we have that one-week extension, but it is just one week. and it does affect a lot of people in this area. >> you've talked to federal workers who have gone through this furlough thing before. for working families even missing a week or two of pay can be dire. >> that and again what we saw tonight wee saw things we haven't seen before. that's the c

i am a total dhs groupie.past lives. when secretary johnson was first nominated, some didn't know what to expect didn't know how coming from the defense department, he would approach the broader homeland security mission. well today, a little more than a year later, no one would think twice about his leadership. secretary johnson has more than one the trust the washington, of law enforcement around the country, and that his department staff. he is a rock star at this job. he is led dhs through stiff challenges focusing on major strategic priority with mike cyber, dressing with compassion the child of migrant crisis. at first and foremost, protecting the homeland against a very sophisticated terror threat. the threat we face today is very different from the one that we confronted on september 11. it's less hierarchical, more diffuse come anyways more innovative. that's the new danger. the new jihad is collaborate opportunistically across organization lines. some have cyber skills, some of social media savvy. ma

dhs funding not the only issue facing the white house. president obama is seeking congressional authorization for the war against isis. he is confronting rebellion for the three-year authorization for the use of force. the many democrats say they are weary of another war in iraq. they don't want to give the president and more importantly, his successor, they say, a blank check. later today, two meetings are set to give the president high-level feedback on isis. one is the amir from qatar and the other is ash carter. >>> the weather is nuts. i took a picture. minus 1 degrees when i got in my garage. it is not just here in the northeast. it is also the south getting hit by widespread school closures and icy conditions. schools from arkansas to carolinas will not be in session because of bone-chilling temperatures. some places could get snow and freezing rain. to make it worse, airlines have canceled more than 600 flights across the country. look at this. passengers on board the american airlines flight in ft. worth. the ice just made it sli

house dhs funding bill has failed. dhs funding is still set to expire at midnight tonight. -- let's go live to chris hollins hollins. the clean bill never came to the floor for full funding on this over the long haul and now the short-term bill has failed. where to you go from here? the house is in recess now. what's plan "b"? >> the speaker has run out of excuses for not bringing that bipartisan senate bill that provides full funding for the department of homeland security not for one week not for two weeks, not for three weeks, but through the whole fiscal year. that bipartisan senate bill is right here in the house of representatives. all the speaker has to do is bring it up for a vote and it would pass tonight and it could go to the president's desk for the president's signature. >> why didn't he do it? why didn't he bring up that clean bill? >> he didn't do it because he wants to keep this uncertainty going with respect to the department of homeland security. he has a lot of members in the republican caucus who want to play games with the funding. he was catering to hi

this new plan by senator mcconnell does noga lone to deal with dhs funding.t's a whole separate issue. the idea here by stripping out this immigration issue that conservatives really want to see coupled with the dhs bill by stripping it out as a separate bill and requiring a vote on that it could give room to then later pass a clean -- so-called clean dhs funding bill that doesn't have any strings attached doesn't have these immigration provisions attached. the problem is that even this new bill bringing it up for a vote that takes a lot of procedural hurdles that it has to overcome. the first vote wouldn't even be until friday and that of course is the deadline for the dhs to remain funded. so this is one step a long the way but it still doesn't make it clear at all that dhs is going to be funded. part of this move by senator mcconnell is also to try to put some pressure on democrats who have questioned the president's ex executive actions but haven't split from their party when it comes to blocking their votes on the dhs funding bill. the bottom line is it'

and insisting any dhs funding bill gut the president's executive action on amnesty. for their part, senate democrats are filibustering the bill. tonight, they successfully blocked it for a furth time. tonight, we'll talk with one of those fighting the president's order in the court. the attorney general of state of oklahoma scott pruitt. oklahoma one of 26 state that have sued president to stop him from unilaterally implements amnesty through fiat. and obama administration often down plays threats of what they call remnants of al qaeda, they are trying to excite the american public about the al qaeda afilliated group, al shabaab. this was dhs secretary jay johnson warning americans after al shabaab put out a video threatening attacks on the mall of america and other shopping centers in a number of western nations. >> i would say that if anyone is planning to go to the mall of america today they have to be particularly careful as statement you read indicates there will be inenhanceed security there that will be apparent. to people -- >> federal security. >> enhanced s

>> the governors came up with the dh -- dhs issues but their number of governors want to make sure that funding continues. i would say almost all governors want a solution to this as quickly as possible. the president made a robust defense of his executive effort around immigration. his point was essentially that the number of people coming into this country illegally is at the lowest level. addressing the most serious issues and that is what his point was executive efforts to really say it's ridiculous if we deported all of these people. it would have a negative sense on our economy for a variety of reasons the unthinkable. as we are limited by resources for people that they feel are the highest priority than 300 to 400,000 people a year why haven't those other people unable to have a driver's license, not be able to in an accident feeling like they have to flee to make sure the guilty parties are brought to justice. all of those he is trying to address by executive order. he was not backing away in any sense from what he sees as a failed system and again from the beginning he has main

>> guest: of the -- >> host: dhs. uh-huh. >> guest: you know, there are the inherent qualities, inherent things that are built into the dhs like the inspector general. of course, every federal agency has one of these inspector generals that does look at the problems that are happening internally at various respective agencies. clearly, they have things that have been done. the inspector generals have launched investigations about different problems and programs that were happening at the agency as well as the government accountability office, of course, the investive arm of congress -- investigative arm of congress continually looks into things happening at the agency not to mention the oversight committees in congress. there are those aspects of oversight that do happen at the homeland security department. the question is, of course, is it enough? that's a constant thing that congress and these inspector generals deal with on a regular basis. >> host: let's hear from pat from south carolina longs south carolina. hey,

we thought we would give you a sense of what dhs's unique contribution, what we see dhs's contribution is. of course many organizations in government and outside that have an important role to play, we're just talking breakfast about the national association of directors. we thought we would emphasize the three areas where dhs pay as unique contribution. first is dhs has a strong record of imbedding privacy and civil liberty into its programs. dhs had the first statutory called officer. when the department first started, the home hand security act incorporated a number of interests endeavors first and one of them was to create these two positions civil libertarian positions that reported directly to the secretary. many of us may know i was the first officer at the department so i started the first day with the chief privacy officer. connor kelly is the center for democracy and technology. we looked at each and said, what do we make for each other now and we had officers next to one another and tried to figure out where to go. i was at dhs until 2009 and left and returned a couple of ye

however, dhs -- while dhs has taken implementation seriously, many transgender detainees still face that untenable choice. remain silent when they're fearful of their own safety or speak out and risk segregation. in addition to the 2013 directive, i.c.e. has made some progress to the goal of providing detainees with protecting from sexual assault with its 2011 performance based national detention standards. unfortunately, implementation has been slow. in aday the office of civil rights and liberties has identified a system to identify, track and investigate claims of sexual violence and provide avenues for redress including monetary compensation. however, the problem is not statistics, it is not procedures in place for reporting and tracking sexual assaults but it is the slow pace of policy changes and education that would address these needs of the lgbt detainees detainees. to that end we urge swift progress. first dhs must fully implement detention standards. this means dhs should ensure that all facilities comply with the agency's regulations are including private contracting faciliti

everyone understands if the dhs shuts down even if the dhs has a continuing resolution with continue resolutions, you cannot fund the states as they do presently today. all of our funding at our -- for us at the department of management sheriffs localities, all of our first responders that we deal with training all gets shut off. even with the continuing resolution, and i don't think many folks realize the i canplications for every state because every state is impacted. i think secretary johnson said $2,000,000,000 went to the states in grants and emergency management. >> gets stopped. so, the dysfunction here in the dhs makes this whole issue that for partisan political reasons, you are going to shut down a vital government entity which has an important purpose and innocent people -- as governor of virginia many employees who will be furloughed live in the commonwealth of virginia. it has a dramatic impac. we don't have time for partisan politics. i have to create economic activity. the disif you knew today, they are doing a real disservice to constituents? >> it's striking we are t

is it essential to have dhs? also regarding the executive orders can't congress pass a constitutional amendment as to what the president does with the executive order. there is a lot of wishy-washy talk. it is not defined in the constitution. is that something that congress should look at? if so, what should it look like any constitution? guest: as far as a constitutional amendment, that is not something that republicans have really been talking about. certainly, if they were to propose that, chances are it would be very difficult for it to get enacted. you would need a two thirds majority in congress, as well as the senate. i certainly think there has been a concern when george bush was president, increasingly with republicans with obama as president, that the president have been taking liberties on executive action and going around congress. it is what they view as an unconstitutional matter. i'm not sure there's anything they can do to rate him and. certainly, the department homeland security was created by ge

roll call says what is next on dhs funding? some members speculate they could have a one-week continuing resolution or want to just last through the weekend. the conservative caucus within the gop has made their offer -- a three-week continuing revolution -- resolution that expires in one week if the senate refuses the conference. jake sherman writing the senate has said they are not going to conference. it will be interesting to see if leadership takes this freedom caucus offer. julie pace -- obama administration circulating a 46 page shutdown plan for the department of homeland security ahead of the midnight deadline. let us know if you are with the department of homeland security, expecting to go to work over the weekend or onto monday and at this point, facing a few hours before your agency does not have any more funding. on the line from georgia. republican lines, go ahead. >> absolutely right. is this where i can voice my opinion? >> absolutely, you are on the air. >> republicans need to hold the line and make sure we don

and so political peril for republicans if the dhs shuts down, how does that work. >> the republicans are the party of national security. they want to be tough on national security and tough on terrorism. in light of those threats that the united states has received from the somali terrorist group al shabab about possibly attacking shopping malls, with operatives within republican circles if anything were to happen with the lapse of the funding and attacks on mall it could stain national security for a long long time. so that is the thinking on the senate side. you see mitch mcconnell putting this forward and stepping up and allowing the republicans to step up against the president's immigration actions and a clean bill for dhs. some like manchin said they would support that if the clean funding of the department of homeland security went first sox they are having a lunch right now, the senate republican side and still unclear what the plan is going to be. whatever happens in the senate over the next few days the clock is ticking for what will happen in the house. john boehner once ag

i know the senate just passed a bill to keep dhs open.oes it mean anything given that it's not going to pass the house? >> it's a big signal where the senate thinks this should go, to try to keep the department open for longer than you're talking about in the house. what was not as successful for the senate plan was the second part of what they had been talking about, which was to put forth a separate bill that would deal with just the november piece of the president's executive action on immigration. and that failed even though three red state democrats sided with republicans. so the mcconnell plan of doing it in two steps only went 1 for 2. they are sending a message but what really matters now is what the house can do. there is a sense around here that the department won't shut down it has a different feeling than in some of the brinksmanship moments we've seen before. maybe it's a bit of shutdown fatigue or because of some members think there's a way out here and it may be that short term extension. our sense is that that could get th
