i'm kristen sze. >> and i'm cheryl jennings. the police tape is around the area of a home on drakes bay avenue in los gatos. matt joins us live with the latest. matt? >> reporter: cheryl, this has become a big crime scene. drakes bay avenue is blocked off several hundred yards all the way to where the street actually turns south. crime scene investigators are here as this investigation heads into its tenth hour. the first 911 call came in about 1:00 a.m. a 50-year-old man reported someone was injured in front of his house. when police arrived, that 34-year-old man was inside the house, he was taken to the hospital. the 51-year-old was taken to the police station to be interviewed. one neighbor described what she heard. >> one of the guys said they had seen an accident, that's how he described it to us. >> reporter: a los gatos police sergeant says the 34-year-old man was alive when he was taken to the hospital but did not know the man's current condition. the sergeant says they're not revealing how the man was injured and whethe

with as kristen welker just reported the u.s.etly going to release more detainees from guantanamo bay, cuba. senior administration official confirms there is a renewed push to clear prisoners out of guantanamo, particularly with republicans set to take control of the u.s. senate with only two years left in the obama presidency. six more detainees have been released just over the last nine days. this is a remarkable shift from nothing to, well, something. as kristen welker just said, many are wondering if this has something to do with it. by law as defense secretary, chuck hagel has to sign off on any transfer out of guantanamo bay. as many have been reporting in the days since his departure was announced early in the week, administration officials have privately complained that hagel has moved too slowly to certify detainees for release. aides to hagel counter that he makes a point of thoroughly reviewing all of the evidence before signing off but it's a major policy difference between the white house and the man who won't we in

kristen welker is covering a closely watched senate race in georgia and then some for us tonight. kristin, good evening. >> reporter: brian, good evening. that's right. georgia is pivotal. it could be the democrats' best chance for picking a ining up a from the republicans. if michelle nunn beats republican david perdue, it would increase the magic number that republicans need to win the senate from six to seven. but our polls are showing that a runoff is likely here, brian. that is because in order to win this state outright, a candidate would need 50% plus one vote. that's going to be really difficult because there's a third party candidate here who will pick off some of ethos votes. we're watching a similar scenario in louisiana where mary landrieu is facing a tough fight from two republicans including u.s. representative bill cassidy. now a runoff in louisiana would take place in december. a runoff in georgia would take place until january, which as you said, brian, would mean we might not know who controls the senate until next year. >> kristen welker in the south tonight cov
