>> reporter: according to the university, that student was immediately interviewed by san jose state police and san jose police. more than a month later, it appears he has left the country. the two women who say they are sexually assaulted are spartans themselves, they say thar were sexually assaulted by that freshman water polo member at a party between september 3rd through september 5th. that was labor day weekend. the team had a match in santa clara that saturday so they were in town. a university spokesman told us the students were not notified immediately again because the accused attacker was identified and interviewed by police, though not arrested. >> i feel like the school has failed, failed to notify us and it's concerning. we should have been notified from day one. >> if you hear about it, you stay on guard, knowing these kind of things were happening around here, i would have felt safer. >> the university has not released the name of that student who is accused because he has not been charged, but there are 19 water polo players, five with hometowns out of the country. th

san jose state water polo player accused of assaulting two fellow students is no longer in the country. we're told the school and san jose police have been investigating these accusations since the report first came in a month ago. the crime allegedly happened at an off-campus party over the labor day weekend. the university is not releasing the name of the male water polo player accused because he's not arrested or charged. a spokesperson told nbc bay area the player is an international student. a san jose state university water polo player has left the country just days after being accused of sexual assault. maria medina is live at sjsu with more. >> reporter: good morning. not only is the student under investigation, he is also banned from campus here. now, we're not naming him because he hasn't been charged with any crime. he is accused of sexual assaulting two women at an off- campus party over the labor day weekend. the first woman came forward last month. the second woman came forward two weeks later and campus leader removed from him campus. students responded to the allegations. >> when you come into the school as a transfer student or freshman we go through orientation and they talk about things like sexual assault and going to parties and drinking and it's not okay.

any student at san jose state university should expect to face some difficult classes along the way. what brandon didn't expect, though, was having to make such a difficult decision before the school year even started. >> i had so little saved up. so i get a room to stay in? or do i pay tuition? >> reporter: this all goes back to the death of his father earlier this year. brandon had to shift his attention and his finances to helping take care of his family. still, not going to college was not an option. he had promised his dad. >> his last minutes, i promised him i'm going to get my degree. >> reporter: which explains why brandon began the semester staying not in a dorm but in the front seat of his 1992 honda accord. >> i pulled up to a curb, locked the doors, rolled up the windows, pulled the blanket over me, and slept. >> reporter: in spite of his circumstances, brandon's journalism professor lisa fernandez says he started the year strong but soon was missing classes and failing to turn in homework. >> i was wondering why someone like that wouldn't have turned in two or three assi

here at san jose state university, the concern is campus alert. the big question is when should students be informed of an alleged sexual assault? campus safety is a top priority. >> downtown is not known as really safe. >> reporter: when she found out san jose police are investigating two alleged sexual assaults involving students off campus, she became really concerned. >> usually we get an alert on our phones, but this time we didn't get an immediate alert. >> reporter: they found a san jose water polo player is accused of sexually assaulting at a college campus this weekend. >> i feel like they're not hiding information but not letting students know. >> reporter: a letter went out telling everyone while a criminal investigation is underway, it's clear that we need to better connect the dots between resource providers. they're calling for improving communication and the administration plans to reevaluate protocols for determine when campus crime alerts continue. >> it's good to hear feedback from the administration that they're taking steps to

san jose state university president released a statement reading, quote, i know some are wondering why campus crime alert was not issued sooner. the totality of information available at the time including the fact the suspects had been identified and was being closely monitored led to the determination that there was no imminent safety threat to the campus community. students may be outraged, but technically san jose state university officials did follow the rules knorr reporting on campus crime. nbc bay area investigative unit reviewed the details of the clary act. it requires colleges to inform the public about crimes on or near campus. it says schools have to let people know about crimes in a timely manner. that's only if those crimes pose an ongoing threat to students or employees. it's up to campus police to determine what is considered an ongoing threat. university officials told nbc bay area they did not send an alert in this case because they interviewed and investigated the suspect right away. >>> a correction on information we reported during yesterday morning's newscast. our

. >>> a san jose state university water polo player is accused of sexual assault. but a new development could make the case challenging for investigators. kpix 5's maria medina joins us live from the sjsu campus to explain. >> reporter: kenny, the student is under investigation as well as banned from campus but the big question is, where is he? campus leaders have not said what country he is from but they do say he is out of the u.s. now, we are not naming the student because the student has not been formally charged of a crime. he is accused of sexual assaulting two women at an off- campus party over the labor day weekend. one woman came forward early last month but it wasn't until two weeks later when the second woman came forward that campus leaders banned the water polo player from campus. now students were not alerted of the alleged crime but we them to and now they are reacting to the allegations. >> it's sad because after the whole brock turner thing there was a huge uproar in just -- everywhere you looked. it was made apparent that look that is not okay. >>
