ktvu fox 2 news' janine de la vega has the story. >> reporter: his name is phillip watkins and she watched as he was shot on sherman street. >> he was disstressed. something i had never seen before. i didn't think things would get to this point. he was upset. he felt things weren't going right. >> reporter: buchanon called the suicide help line worried about her future son-in-law. then, there was a 911 call saying someone was locked inside an upstairs bedroom. it was watkins who called 911 and it was his way of calling for help. the radio captured tense moments when they arrived. >> male walking towards us. >> reporter: they ordered him to drop the weapon, so he fired. >> shots fired! >> they shot him. and i begged the policemen not to shoot him. that he needed help. they could have tazed him. >> reporter: watkins was taken to the hospital where he was pronounced dead. a police spokesperson says the officers were in fear for their life and they are trained to stop a threat. watkins was 23 years old, attended san jose high school and deanza college where he played football. he was engaged t

janine de la vega is live this morning along interstate 880 in fremont. t a truck in half janine. >> yeah it did. pretty incredible footage. very devastating. a female driver in one of the cars did not survive. three others are in the hospital. it happened all here on the southbound lanes of 880. you can see traffic is back to normal but all the lanes were shut down earlier this morning. the chp says at 12:30 a.m. a sedan got on to southbound 880 but it was heading the wrongway. it traveled northbound for three miles before crashing head on with a pickup truck around thornton avenue. the sedan burst into flames. the firefighters rushed to the scene to extinguish it and treat the victims. it was a mangled mess of twisted metal. the impact was so powerful that iter to the pickup truck apart. >> upon collision, the cab of the truck the quad cab. the quad cab of the truck it completely separated from the chias city and the bed of the truck. it landed probably 10-15 feet in front of the chias city. >> the female who was in the sedan traveling the wrong way died

janine de la vega is joining us live now. you're in menlo park. what is that warning janine? >> reporter: well, first off let me tell you cal train just passed by here. so the schedule is back to normal here. i do want to show you the repair crews that are here because again this was badly damaged in the accident late yesterday afternoon. cal train says the woman most likely had cars in front of her and she got stuck at the tracks here. cal train officials say oftentimes traffic gets back up at the location all across the railroad tracks and drivers stop on the tracks. they say this happened just before 5:00 p.m.. a southbound train coming from san mateo hit the woman's suv sending it 40 feet through the intersection. the suv was totaled and the woman was rushed to sanford hospital. she died of her injuries. >> our heart goes out to the family, of course. this is a tragedy. we just want to remind people, don't stop on the tracks. people have to understand that it's not safe to do that. even with all the safety devices we have in place. and don't go across the tracks until you

ktvu's janine de la vega reports on what led up to the latest violence. >> reporter: drinking andhaingd hanging out with friends ended with gunfire. it started at 10:00 p.m. last night when an argument escalated and someone pulled out a gun. the owner called 911. >> couple people saw the guy -- [ indiscernible ] shoot and run. >> two men were wounded and taken to the hospital. >> one of the victims was in critical condition. he has been stabilized. we just keep monitoring the situation. the second victim is expected to survive. >> police roped off the area and detain witnesses. police confirm they did arrest a man with assault with a deadly weapon but they are still looking for a second suspect. this is the 4th shooting that occurred at or near a vietnamese bar or restaurant. on saturday night a security guard was shot and killed trying to help stop a robbery suspect. and a few days before on the same street another man was killed in a shooting. on new year's day gunfire in the parking lot and a man was killed. >> something that is on our radar. as far as the police department is conce

janine de la vega is joining us from campbell. >> reporter: we are here in a neighborhood. the fire scout but a battalion chief told me that they believe this is suspicious so an arson investigator has been called out to the scene. it was three cars that was on fire. now let's go to video we shot earlier. you can see it was smoking but when firefighters first arrived all three of these cars were on fire. one of the questions i did ask this battalion chief was did the fire start with one car and spread to two other ifs he said no, they were all on fire. they aring look to see if these were all purposedly set on fire. this happened at 4:30 this morning. there is no businesses in the area that are open. that is very early in the morning. nobody was around. nobody near their cars. that is why they think this is suspicious. when they pulled up the police officer said it sounded like a bunch of explosions. one of the person that heard the explosions is a resident that lives nearby and his name is terry glasco. tell me what you heard. you were sleeping. >> yes. in the middle of th

janine de la vega joining us live now. upertino where a rally is going on and this is aimed at getting those drivers a union contract, janine? >> reporter: yes, it is, dave. the teamsters are standing out here in front of the apple headquarters. you can see them they are holding up signs, trying to get the attention of the bus drivers who shuttle the tech workers who come through here. they want them to vote to join the union tomorrow. they pick up and drop off workers have complained they don't make enough money and are struggling to support their families. they make around $40,000 and work for compass transportation which contracts with the tech companies. union leaders want to negotiate better pay and benefits for the drivers. if the drivers do vote to unionize, it's a possibility that certain tech companies may not want to pay higher wages. we asked the teamsters about that. >> i don't think they need the bad press of stepping on the little people that make the companies work. i doubt that will happen. >> reporter: what

janine de la vega is joining us live from sunnyvale with the latest on the investigation. >> reporter: police have cleared the scene here at wolf road and elle camino but they are keeping their eyes open for a white mercedes sedan. they made it stop at el camino at wolf when an officer exited his vehicle and approached the mercedes the suspect sped toward the officer and that is when the officer made the decision to fire his weapon. >> during the attempt to stop the vehicle, the vehicle drove toward the officer at a high rate of speed. officer fearing for his life fired several shots at the vehicle. the vehicle was last seen northbound on wolf road. the officer was not injured. >> the other officer in a marked patrol vehicle chased the mercedes on wolf road in the northbound direction but lost the vehicle. sunnyvale department of public safety is heading up this investigation. they are unsure how many were in the mercedes and working to see if they can provide us with a license plate number. it's unknown if anybody in that suspect vehicle was injured. the detectives are also looking t

ktvu fox 2 news reporter janine de la vega is near the house. you just talked to one of the man's loved ones. what did she say? >> reporter: well, yeah, we just spoke with her. she lives in this corner home. she says the man that police shot also used to live in this home. she is upset. she said she begged police not to shoot this man who is engaged to her daughter. now, let's go to a picture of him. she identified him as 23-year- old phillip watkins. he grew up in gilroy. police say at 5:00 yesterday afternoon, they received a 911 call from someone inside the home on the 1300 block of sherman street. who told them that a man carrying a knife had entered the home. the caller also said that the person needing help was locked inside an upstairs bedroom. officers arrived at the scene and found watkins outside of the home armed with a knife. they say they ordered him to drop his weapon but instead he charged at them. that's when the officers opened fire. watkins was taken to the hospital where he was pronounced dead. here is what we were told by his

janine de la vega joins us live with the warning for other drivers now.d morning. >> reporter: this was a dev dating accident. the vehicle involved in it was stopped here. that's a situation you never want to be in. you can see crews are out here working to replace those crossing gates right now. the accident happened before 5:00 yesterday afternoon and an suv was stopped on the trucks when a southbound train coming from san mateo crashed into it. it sent the vehicle who feet across the intersection, totaling it. the female driver had to be extricate and was taken to the hospital and died. it's like lick the woman got stuck on the track -- likely the woman got stuck on the tracks because of the traffic backed up ahead of here. >> sometimes at peak commuter hours, traffic will back up across the railroad tracks. that's what happened. somebody stopped on the tracks. >> reporter: trains are back to running on schedule through the ray venswood crossing. crews are working around them to repair the warning gates and lights. cam trains said their thoughts are wi

janine de la vega joins us live from sunnyvale to tell us how this all unfolded. >> reporter: police had this intersection at el camino real and wolfe road closed for several hours gathering evidence that they hoped would lead them to a white mercedes sedan. >> the roads are reopen. but officers are hoping any witnesses will come forward. it started at 6:00 in the city of santa clara, where two officers were investigating auto burglaries and found a suspect. they followed the suspect vehicle, that white mercedes sedan into the city of sunnyvale. when the sedan pulled over on el camino there wolfe road. one officer got out of the vehicle and approached the mercedes. police say that's when the mercedes sped toward the officer and that officer feared for his life. >> i wish we had more details on the vehicle. obviously, may have bullet holes on the right side. we're continuing to investigate and look into the matter and see what else we can find out. see if there's additional witnesses. if somebody witnessed something, i would appreciate a call. >> reporter: the second officer chased th

ktvu fox 2 janine de la vega is there. and what it means for the case. janine. >> the timing of this suspects death is strange. there is no official word on how he died. and now with the suspect gone, it will make things more difficult. we have learned the suspect checked himself into a local hospital on saturday and died that night. his death comes just over a week after he was arrested. the district attorney did not prosecute andres saying there was no enough evidence. they spoke briefly but not about the case. >> he seemed he was in jail for a couple of days. and he took off. >> reporter: police continue to work on gathering evidence to push the investigation forward. legal analysts say even though there are still a lot that needs to be answered, is there a second suspect in this case? did police arrest the wrong person? who was the person in that suitcase? there is still forensic work to be done. pam, back to you. >> all right the investigation will certainly continue. thank you. >>> 5:37 is the time. one of two men arrested in connection with a stre

janine de la vega joining us live now. you are in exam cam pell -- you are in campbell. >> reporter: i headed inside a little bit earlier. this nob hill, part of raley's, there already taken their cigarettes off the shelves. by end of the month, tobacco products will be gone. the grocer which is based in west sacramento says its decision was base odden the health and happiness of the customers. they targeted cigarettes in particular because they say the evidence was too hard to ignore. a spokesperson said there's less evidence to indicate that eating shoe are snacks poses a significant health threat. this decision comes several months after cvs stopped selling cigarettes at its stores. >> i think it's a great idea. i think a grocery store that will promote health and where you can go and teach children about healthy eating habits and lifestyle choices. i think it's a good idea to pull tobacco off the shelves and not make it readily available or visible to our young children. >> reporter: it's unknown how much of an impact

a bay area pet owner is taking legal action and ktvu fox 2 reporter janine de la vega is joining us tolawsuit that has been filed. janine. >> reporter: pam, this is a brand that everybody has heard of. purina. and the dog food is beneful. the lawsuit claims over the past four years there has been more than 3,000 online complaints of dogs getting ill after eating it. >> reporter: a man from discovery bay is a plenty in this class action lawsuit. he says his bulldog was found dead in his yard after eating beneful dry dog food. his other two dogs became ill at the same time. caused international bleeding, liver failure, vomiting, and kidney failure. and says purina needs do go through more adequate testing because beneful contains an antifreeze components. purina is fighting back saying the lawsuit is baseless and the company intends to vigorously defend itself and plan. and bottom line it is still on the shelves at pet stores. cetaben you can still buy it. there has been no recall. and when the sun comes up, we hope to talk to some dog owners because we are here at a dog park. hopefully

janine de la vega joins us live now. you are at a sunnyvale dog park and i know you are talking to it pet owners, janine. >> reporter: one of the dog owners that we did speak to says he doesn't feed his dogs the purina brand beneful. they choose another dog food. but hearing about this lawsuit surprised him push a man from discovery bay is a plaintiff in a lawsuit filed in northern california. he says his bulldog was found dead in his yard after eating beneful dry dogs food. he claims the other two dogs became ill at the same time. the lawsuit state eight kinds of beneful dog food has caused internal bleeding. it contains, he says, antifrez component and toxins. attorneys say there's been complaints that dogs have gotten sick or died after eating beneful. >> clearly there is enough evidence that it need to be investigated about what's going on there. we've seen -- i don't know where they make their foods and i don't know what ingredients they put in the foods but somebody need to take a look. >> reporter: purina is fighti

ktvu fox 2 janine de la vega is joining us live now. you're at a dog park in sunnyvale.out a claim of toxic ingredients. what did you find out? >> that spokesman from purina told me this lawsuit that is filed against the company is completely baseless. this involves the beneful dry dog food line. but there is a man that says beneful dry dog food is why his dog died. that dog owner is the plaintiff in a class action lawsuit that was filed in u.s. district court in northern california. it states that the eight kinds of beneful dog food has caused internal bleeding, liver failure, vomiting, diarrhea, and kidney failure. the dog owner says he started buying beneful in late december or early january this year and gave it to his dog. soon after he says all three of his dogs became sick and his bulldog died. the suit says that toxins in the dog food are to blame including propylene glycol. in the past four years there has been more than 3,000 online complaints with dogs becoming ill or dying after eating beneful. they say there is nothing wrong with beneful and millions of dogs

janine de la vega is joining us now from campbell to talk about the move to stop selling tobacco products. >> reporter: pam, by the end of the month knob hill which is a part of raley's stores will stop selling cigarettes. the store has already discontinued ordering the tobacco products. they said the decision was based on the health and happiness of their customers. there is less evidence that indicates eating sugary snacks and drinking alcohol in moderation poses a threat to adults. it may be part of a grow trend for certain retailers. this decision will effect all 128 raleys, nob hill, and belle air stores in northern california and nevada. this nob hill store opens within the next 30 minutes and we plan on talking to customers to get their take on it. >> thank you, janine. that is a very interesting story. >>> 5:38 is the time. two water treatment plants are shut down and hundreds of families are out of their homes because of that train derailment in west virginia. 27 tanker cars carrying crude oil jumped the tracks 30 miles outside of charleston. at least 14 of the rail cars caught f

janine de la vega is joining us live now. you're along interstate 880 where some of the lanes were shut down. what is the situation out there now? >> reporter: all lanes of southbound 880 are open but earlier this was a devastating scene. [ inaudible ] officers were called in at 12:30 a.m.. and was heading northbound just before thornton avenue. it collided head on with a pickup truck carrying three men. the chp says the impact was so powerful that iter to the truck in two. the sedan burst into flames. a female driver died. the three in the truck were all rushed to the hospital with serious and possible life threatening injuries. officers have not released any names of the victims. there is still a lot of investigations. why was this woman traveling the wrong direction? and was alcohol a factor? this is a very tragic accident with deadly results. dave. >> thank you. we'll talk toulater on that situation out there. glad the traffic is back and moving again. thank you. >>> time 16:06. in other news people around the bay area fe
