kris sanchez joins us from the san jose diocese with that reaction. good morning, kris. >> reporter: hi there, marcus. people reached out immediately, some of them really shocked to hear that some of these priests served in the parishes where they grew up, particularly after they were convicted. now, of the 15 priests who were on the diocese list of accused priests, only five are still living. we talked with one who maintains that he is innocent and that he left the ministry of his own accord. another, lionel noya was convicted in 1976 and went to jail for three years, but then still went on to three different churches in san jose between 1978 and 2002. toro was a registered sex offender in 1983, if you can believe that, and yet still served in several parishes in morgan hill and palo alto four years after that. vicky nguyen pushed the bishop at wednesday's listening session about whether he personally helped cover up reports of abuse by priests. >> that's absolutely untrue. absolutely. >> so you're saying the church is not sheltering any other priests

"today in the bay's" kris sanchez joins us live in danville. what are you seeing there, kris? >> reporter: well, it's always tri tricky to shoot wind when it's dark but we found flags at the veterans memorial building here in danville. you can see they're whipping pretty good. the biggest concern though is the wind whipping through the diablo range and the hills there. cal fire says this is the time it is critical to be aware. they say 95% of wildfires are started by people and most of the time it is inadvertent. cal fire reminds us that you should not mow anything today because of its winds and the high fire danger. if you have car trouble, make sure you don't pull over in dry grass. if you're hauling something, check that trailer chain, that it's not dragging and creating sparks, and if you smoke, make sure you put those cigarette butts out completely but never out the window, and though today is not a good day to create a defensible space, you want to do that as soon as you possibly can. i'll be posting wildfire prevention tips all morning long. also any wildfire danger and

kris sanchez is live from cupertino with how fast the rest of this project will go for us, chris. >> reporter: we don't know how fast the rest of the development will go at this point because there's still two options on the table and the city council has to pick which one will go forward. all this heavy equipment is here, ready for demo day. they'll take down empty parts of the mall and mall parking structure. they can move forward with this part because of sb-35, which is a state law enacted last year to streamline the approval process for projects that include affordable housing. under either development plan, enough of the units will be affordable housing to trigger that streamlined approval. both the city's valco specific plan and sand hill property plans will mean 2500 units of housing, 2 million square feet of office space. where they differ is in the benefits to the school districts here and also the requirement for open space and traffic mitigation, among other points. the next planning commission is a week from today. meanwhile, the cupertino group, better cupertino, contin

kris sanchez is live in cupertino. >> reporter: they have gathering signatures to put a referendum on the ballot before the voters. you can see the demolition here at vallco is already under way, and the heavy equipment moved in basically the same day that the city council approved a move to accept that development deal from sand hill property company. the group better cupertino says this is happening too fast. it announced it has enough voters to decide.that issue on this is the same group that sued the city of cupertino over this same issue. but in the time that it will take to qualify those signatures and perhaps get that issue to the voters, construction he affordable housing. it allows projects with a certain level of affordable housing to bypass some local ordinances. so the developer now says that instead of the community plan, which it had been working on with the city, it will now focus on that plan that is fast tracked by sb35. in a statement, the sand hill property company managing director says "this latest obstruction and the two-year delay it causes gives the community p

"today in the bay's" kris sanchez joins us live from san jose's alum rock neighborhood. , what can we expect to happen today? >> reporter: well, at 8:45, the two parties have a date with the judge, and the superintendent here of the alum rock school district. we'll find out whether that judge will order a trustee to stay away from her permanently. this is video from the last time they were in court over the issue back in september. the judge extended an existing temporary restraining order on that day. bauer requested the order after tran allegedly threatened her in a closed door meeting. tran is saying his words were taken out of context. this is impacting district business as that restraining order, ordering him to stay away from bauer means that tran cannot attend a school board meeting in person unless there is a police officer present. he has to dial in otherwise. the board meeting two days after that prior court appearance had to be canceled because there was no quorum, there weren't enough school trustee board members present. tran is running for re-election here i

nbc bay area's kris sanchez joins us live at the scene this morning. the fire is now out. look at the damage behind you, though, kris. >> reporter: yeah, they're still putting water on it, because there are still hot spots. oakland fire thinks the fire started here on this corner of holly avenue. you can see some of the power lines that came down that crews found when they first arrived. now, because of the wide open nature of this warehouse, the fire just ripped virtually all the way across the block. you see homes in the distance. oakland fire did take a defensive position to try to protect those homes. and then here to the other side, you'll see, this is a parking lot for the coliseum b.a.r.t. station. this was half shut down throughout most of the morning, creating a lot of frustration for commuters, as well. that was closed because of the fear of flying embers. now, at this point, the fire is still putting out some smoke, and that's because oakland fire doesn't want to send firefighters in. they want to bring in some heavy equipment to take it down. >> having firefight

"today in the bay's" kris sanchh sanchez joins us live from downtown san jose, with the noy process up to now. kris? >> reporter: hi there, marcus and laura. the diocese promised the list by mid-october. here we are october 17th. the families say this is really just a start. bishop patrick mcgraw says the same thing. he told us after the first two listening sessions that the process has been informative but also painful, but one that he hopes will lead to some sort of healing. at the same time that he and other diocese leadership had been listening to victims and their families, a former fbi administrator has been looking through diocese records to see how allegations were handled in the past and how they should be handled in the future. we talked with a survivor, and a sister of a survivor at the first two listening sessions, and they had differing opinions on whether it's enough. >> i think this bishop is trying to do the right thing. part of the healing for me is to have a voice. >> the diocese has a lot to do. the catholic church has a lot to do. i don't think they satisfied anybod

thanks for joining us, i'm kris sanchez. >> i'm marcus washington. this is happening on 880 and oakland. bob redell is live with the latest. bob. >> reporter: good morning, marcus and kris. chp has taken into custody a 25-year-old man who had been brandishing what appeared to be a handgun. we're on northbound 880, 66th avenue ramp. he had been driving a white van. this is what the scene looked like when chp surrounded the van and took him into custody. the call came across that he had a handgun, that he got out of his van and started pointing that gun and shooting that gun towards the side of the road. when police arrived, they did not find any shots fired. they weren't able to confirm anyone was hurt or that the building or any property was damaged. and they found that weapon. they believe it is now a pellet gun, not a handgun. at one point, the man was on top of the van, yelling at traffic. police were -- chp were able to take him into custody. they are now taking him to john george hospital, where he'll be placed on a 72 hour psychiatric hold. they

. >>> "today in the bay's" kris sanchez joins us live with what students wanted and how the city council listened. good morning, kris. >> hi there. i'll get to the proposed ordinance changes in a moment but some of what the city council is considering tonight is what morgan hill teenagers called for after a gunman killed students just like them at marjory stoneman douglas school in florida. it has been a real livive ikz lesson for the students that started with the walkout back in the spring in which morgan hill students joined young people from across the nation walking out of class, observing one minute of silence for each person killed in parkland, florida. then the morgan hill community took it one step farther, holding a town hall meet being school violence and gun control for about 150 students and elected leaders. i talked with one of those students about this lesson in change. >> it definitely makes me feel more like i can do something in the future. >> we had many high school students coming to city hall and talking about what they wanted to see from the city council. i think it
