ktvu fox 2 alex savidge is there in berkeley.o just learned that some or all of the victims in this case were young irish citizens. i want to show you a statement from ireland's foreign affairs minister. it reads my heart goes out to the families and loved ones of the deceased and those that have been injured in this appalling accident. the 911 calls started coming in just after 12:30 this morning. police got here and found the balcony on the fourth floor came down toppling. alto fall of five people were killed in this collapse and eight others were hurt. some of the people that were hurt have life threatening injuries. berkeley place are still searching through evidence. and maybe the most surprising part about all of this is that this is not an old structure. this building was built just about ten years ago. it has residential units, a number of them up above and it has retail down below encolluding a cafe. very popular here with many of the college students that live close by. at this point other people living in this building

ktvu fox 2 brian flores is joining us live at the scene. what is going on? >> reporter: good morning to you. that person taken to a nearby hospital. he did suffer second and third degree burns but behind me is what is left of this early morning fire. this is what is left of the garage area. the front of the home damage to several items inside the garage that were taken out by firefighters as well as by a car. but as we go to the video from earlier the fire started just before 12:30 this morning and from what we understand from firefighters the flames got so intense that fire crews had to cut holes on the roof using chain saws. the preliminary information on the investigation at this point according to firefighters is that this was some type of welding accident. we are hearing the man inside the garage was welding a gas tank on to the car. that is when the fire got started. sources say the man again did have second and third degree burns to his torso. he also lives at the home with his wife and a cat. both of them were able to get out of the home safely. we u

that's where we find ktvu fox 2 on this tragedy. >>reporter: we know at least five people are confirmed dead, eight injured. some of them so severely that those injuries are considered life threatening. now, it happened around 12:40 this morning. a balcony fell off the apartment complex that you see behinds me here four stories up. it can fallen and is resting on top of the balcony below. there are family members here on scene and waiting to hear if their loved ones are okay. the victims are scattered at area hospitals. this apartment building again is on kittridge. it's a complex called library gardens, and according to the website for rent.com, the building was built in'76. we spoke to a man coming out f of a nearby movie neither after this happened -- theater after this happened and said he gave victims rides to hospital. he said many of them were texting and informing family of what happened. the identities of the victims have not come out. berkley police have launched a full investigation. they've informed the people in the uni

ktvu fox 2 reporter janine de la vega is live in san jose and say there is is a plan to crack down on people who use illegal fire works. good morning janine. >> reporter: good morning, alex. on the fourth of july you can hear many illegal fire works being set off in various neighborhood throughout the the account. but the county supervisor wants to curb much of that as much of possible. under the new rules the board would lot vote on. they would penalized people who store or discharge illegal firearms. in the board president is concerned about the safety of the people and property. recently the u.s. determined that children under 15 years old suffered 45% of all injuries from fire works. and last year in the county there were four injuries involving fire works. property owners who are not aware or present when they are being discharged will be sent a warning letter. guests could be fined $350 for the first violation, $700 for the second, and $1,000 for the third. the county has attributed $70,000 to the rotary club is sponsoring a big display in the city of san jose for the fourth of

ktvu fox 2's tara moriarty is there at the scene. the police for the past several hours have sealed off a home. it's a very tense situation, tara. >>reporter: yes. sources tell ktvu that someone entered the home and fired several rounds, killing one of two brothers. we are here at the home which is off of saint maritz drive and meadowbrook circle, and you can see that they have crime scene tape up and the csi van is parked in the driveway. we know that investigators are inside the home gathering evidence and police i am told are looking at whether drugs or gangs were involved. the 911 call came in just before 1:00 this morning. according to a family member someone came into the house and shot both of the brothers, one in the leg, and he is now at the hospital. the other man, not sure where he was shot on the body, but he was killed. family members were too distraught to talk to us on camera. we know that a dog was out here trying to pick up a scent for the suspect, but at this point police are remaining tight- lipped about whom they a

ktvu's fox 2 tara moriart. it's neighborhood north of bisune city. that's where tara is this morning. what can you tell us about what happened, tara? >> reporter: neighbors say they can feel this explosion up to a half a mile away, and the bomb squad has been there all night removing all of these firew from inside the garage. if you take a look sort of behind me, you can see where they have -- where that sort of happened and that fence seems damaged. we know part of it was on fire at one stage. at last check, the neighbor was in critical condition. neighbors said they started calling 911 after 5:00 last night after hearing the explosion. when police arrived, they found anthony stew art on the ground in front of the house on catlin drive. he suffered life-threatening burns across his body. he was rushed to a local trauma center, and then air lifted to a sacramento area burn unit. investigators believe -- installing fourth of july fireworks inside his garage. several streets were shut down in the neighborhood. people had to be evacuated while the bomb
