good morning. >> reporter: good morning, marla. well, an effort to reduce crime fremont police are asking the city council to approve surveillance cameras. there is nothing new about surveillance cameras as a crime fighting tool but what is you? that the fremont police accident asking they be put up in low to moderate income neighborhoods based on u.s. census data. the neighborhoods include the arden wood neighborhood, central downtown t south donedale and the niles district. the request is in response to an increase on home burglaries. it's part of a larger plan to put these cameras up around the entire city. they say there is proof these type of cameras do help solve crimes. the police department plans to pay for the cameras with grant money. the start-up cost for the system will run about $450,000 and police will have to find a way to fund it. some residents are voicing concerns that the surveillance cameras, how about feeling of big brother watching. they fear that the city could invade their privacy. the council is going to lo

i'm marla tellez. >> i'm jon kelly. federal investigators hitting the ground in walnut creek looking at what led to the deadly accident involving two bart workers. the investigators spent the night on the tracks trying to piece together exactly what happened. nbc bay area's damian is in the area. >> reporter: people have been placing flowers and candles along this chain-link fence. we're near highway 680. on the other side of this fence, the tracks that claimed the lives of two bart workers. investigators dressed in what looked like hazmat suits told me they spent the night on these tracks. they used huge spotlights so they could gather evidence at the scene. bart says two workers were on the tracks inspecting them when an approaching train hit them. they are identified as chris shepherd and larry daniels. the train was an auto and was making routine runs during the strike to keep the system working properly. the federal investigators are scheduled to talk to the driver today. they will also analyze other systems data o

i'm marla tellez in for jon kelley. let's get right to christie smith live at caltrans headquarters in oakland with the latest. any signs of life this morning? >> reporter: well, i can tell you talks broke off about 3:00 this morning so about 90 minute ago both sides walking out. the unions saying they will be back here later this morning and later this afternoon to look at b.a.r.t.'s offer. trains rolling this morning but b.a.r.t.'s gm did issue a strong statement saying the transit agency has presented its last best and final offer. this is the union members and goshtsers filtered in and out of the building where negotiations have been going on for hours. b.a.r.t. says that its last offer is more than the one that was on the table on friday. a 3% raise per year, 12% total, 4% pension. 9.5% medical. the unions have two weeks to vote on it. both sides facing the fact this is their sixth strike deadline in four months. >> for all intents and purposes that was the last one. we have done everything that we can, we have giv

good morning. >> reporter: good morning to you, marla and scott. they went well past that midnight deadline and still no strike so the good news is that the b.a.r.t. trains are rolling again. and b.a.r.t.'s union telling us they will be back here a little bit later today to look at the proposal that was presented to them. but b.a.r.t.'s gm made it clear on her way out that this is their best last and final offer. while they talk one more day for hundreds of thousands of commuters it's another day to wait about what's next. the marathon session finally broke off just before 3:00 this morning here in oakland while members of atu one of b.a.r.t.'s largest unions stood outside waiting for word. the best last and final offer according to b.a.r.t. means they upped their offer to 12%. we'll talk more about that in a minute. b.a.r.t.'s chief negotiator says that unions have not looked at it yet. earlier a spokesperson said they were cautiously optimistic. then the tone changed. >> if the district rescinds its last best and final offer and continues to nego

good morning to you, marla. that is a tell-tale sign according to police in addition to the woman's behavior, that alcohol was involved. we're at a townhome complex. if you look down you can see that silver suv. that's the suv that was used, allegedly, when it hit and killed, ran over a woman. it happened around 2:30. police telling us there was a 27-year-old woman the driver who has been arrested on suspicion of dui and vehicular manslaughter. there was another woman possibly late 20s, early 30s who was hit and run over, possibly pinned against the garage door. what appears happened is the suv backed into the woman and hit the garage door, could have been her friend. we spoke with a mayber around 2:30. he heard a loud crash, then these words coming out of one of the women's mouths. >> she was saying something to the effect of follow me, come on come on follow me. and then boom, you know. that's all i heard at that point. >> reporter: police are trying to figure out if the one woman was perhaps telling the other

i'm marla tallez in for laura garcia cannon. new details about a deadly shooting involving two sheriff deputies yesterday afternoon. we are now learning the suspect, both sheriff deputies shot may have been a 13-year-old boy carrying a replica gun. bob redell is in the newsroom with what we are learning. >> reporter: according to the samoa county sheriff's office, deputies thought that this gun was the real deal, thought it was an assault rifle, did not realize until after the fact it was a replica. not clear whether it shot bebes. the person carrying it was according to the santa rosa. this is in a field in santa rosa. the sheriff's office said the deputies called for backup and repeatedly asked the subject to drop the gun. when he refused, they shot him several times, handcuffed him, began first aid, called paramedics who declared lopez dead on the scene. deputies eventually realized his gun was a replica. they also found a plastic handgun in his waistband. they do not identify him but only i.d. him as a male subject. his fath

bob, good morning. >> good morning to you, marla. the principal and most of the teachers here at hayes elementary in san jose have agreed to cancel this year's halloween parade because in years past they argue it's taken way too much time away from the classroom time. kids are hyped up during the day about the parade. there are sometimes issues with them getting their costumes on. so much of a distraction, and teachers say it basically turns into a nonacademic day. a lost day of education. with the added challenge of implementing common core standards, it's just too much. some parents feel that this is an overreaction to take away what they say is a fun tradition for their kids. one mom has gone on-line to try to convince the school to change its mind by creating a petition on change.org. so far about 190 people have signed in for their support, though it appears those minorities are actually a parent in the school. the school did offer the kids the option of having the parade after class, but parntsdz say no because it's not fair to

. >> i'm marla tellez. laura and jon are off. we want to get to christie smith live at caltrans headquarters in oakland where these negotiations are taking center stage. good morning to you. >> reporter: good morning to you. despite all of the warnings yesterday about b.a.r.t. trains not rolling today possibly they are rolling for your morning commute. what's different today, a short time ago a federal mediator came out of the caltrans building here in oakland and said that talks were ongoing. this is a marathon session going on since yesterday. before the clock ran out on the midnight strike deadline, and again, 400,000 riders riding a wave of back and forth. yesterday b.a.r.t. came out with a best and final offer to its two largest unions. 12% increase over four years, but with that tensions increased and the unions felt that signaled a sudden and surprising end to the talks. then before that midnight deadline the president of seiu said that the union made a counter proposal of its own, and of course as i said, that mediator sa

good morning, christie. >> good morning to you, marla. yeah, we're learning a little more about what happened here. that man was actually locked out on a fifth floor stairwell, an exterior stairwell. when he got back in after banging on the door, told the nursing supervisor that there may have been someone laying down or sleeping below. four days later the body of 57-year-old lynn spalding was found in that same exterior stairwell on october 8th. nearly three weeks after she disappeared from her hospital room at sf general. there were no signs of foul play. she was being treated for a bladder infection, and that man may have been the last person who saw her. ucsf police and san francisco police are trying to find him. he may have had on a ucsf name badge, possibly a resident or other worker. now here at sf general they're checking through hundreds of hospital id's, but so far no luck finding him. a spokesperson for sf general shared this morning what he told that supervisor when he got back inside. >> then he said, bowe, by the way, it lo

marla tellez is live at the scene. what do you know now? >> reporter: i can tell you that firefighters have done a fantastic job, wrapping things up coming out of this two-story home. this is on foothill koufrmt it's a cul-de-sac at the top of the hill it's a large house, it's 2500 square feet to 3,000 square feet. it is a family of six that live here. a couple, and their two young kids and then also a set of grandparents. the best news is that they are all okay. in the last 30 minutes we saw the couple actually come by to survey the damage. they are staying with a neighbor next door and the captain tells me that they are emotionally shook up. according to officials the mother smelled smoke about 2:30 this morning when she called 911 on her own. firefighters arrived within five minutes to find the flames in the attic where this started. at one point flames shooting through the roof. the captain says it was tough to battle because of the weather conditions. >> we had a lot of heavy wind conditions when we got here, the

i'm marla tellez in for jon today.ppening now, snow is falling in the sierra even though it is only october. take a look from the caltrans camera. you can see all of that snow coating the area. there is the first dusting of the season. brian hickey is up in the sierra with a look for us. >> reporter: interstate 80 where drivers are required to chain up here in the sierra. you can see the roadway, that is interstate 80 there covered in a pretty good dusting of snow though the plows have been coming through and scraping that down every 20 to 30 minutes. the snow continuing to come down here, light fluffy flakes here at kingvale. around the 4500 foot level just below blue canyon ond the my yak area. at one point chains were down to my yak. they moved them up. let me show you how much snow we have a. good four to five inches, fluffy powder this morning. gives you an indication of how cold it is here in the sierra. a look at some of the web cameras, sugar bowl's web camera, there is a solid foot of snow on the park benches

marla tellez is live at hayes elementary in san jose with what's next. good morning. >> reporter: good morning. it was earlier this month that parents here at hayes elementary received a school letter from officials notifying them that the annual halloween parade was not going to be happening. it was going to get canceled. officials citing academic reasons saying it was taking too much time away from the class. one mother took to facebook and also change.org, she started a feet save the halloween tradition saying how important it is for kids to make these memories. close to 200 signed the petition. on facebook parents posting comments like, quote, there are just so many solutions here that could have been used and weren't, as they say in hayes, not cool. the school motto, sort of ironic quist, is be cool help our school. even a high school student chimes in saying i don't think it's fair to take this away from the students, besides i turned out fine, college bound, bright future, well educated, happy, even with those annual parades. despite all of this t
