ktvu tara moriarty is live near the evacuation center to tell us where people can go.t peacock tree drive and clayton. we are not too far from that evacuation. we spoke to officials that were in charge of the ground crew. they said last night the flames looked much, much worse. right now the humidity is higher. once the sun comes up it may flair up again. behind me up on the ridge there is a little bit of a flair up. it does look a little better than it did a half hour ago. we understand just before midnight there are more evacuations in place. people who live on trail ride road. russellman park road have all been ordered out by emergency crews. there are two dozen homes in that spot. earlier last tight we had 50-75 homes evacuated off of oak hill lane. curry canyon road. officials are advising those leaving the homes to take morgan territory road and bring essential items only. they should lock their windows and doors behind them. many people we spoke to said they were scared and surprised by the evacuation orders. not only for themselves but the animals. there are so

live from san ramon i'm tara moriarty. >>> time is 6:04. new this morning the chp says an intoxicated driver led them on a high speed case in san rafael. it ended when the car crashed into a house. claudine wong congress is is out there. >> we are in san rafael in this residential neighborhood. i want to show you where this ended here. take a look at the marks this car left behind when it jumped the curve, and then it hit that stop sign, went into the yard taking out part of the fence and the tree. the chp saying the tree saved this house. this all happened around 3:00 this morning. the chp says it started on highway 101. they tried to pull over the car but the driver took off. off the freeway into an industrial park and then into this neighborhood. when he tried to take the turn he didn't quite make it. crash into the home and waking up the family inside. >> we were all asleep. and we heard bang. and then we came out. and that's what happened. >> reporter: when we got on scene the driver of the vehicle was already in the back of a police c

tara moriarty has just heard from police chief greg suhr and has more information on what the chief saideal tails. tara? >> reporter: yes, that's right. chief suhr came out and he let us know there was a minivan with a woman and two children in it. they were waiting here at the stop sign at the stop sign when somebody in a mercedes came at speeds up to 80 miles an hour slammed into the car. it flipped and if you take a look behind me, you can see that everybody is still here on scene. we don't want to show too much here because 17-year-old in a minivan lost his life and his body is covered up by a tarp. we want to be respectful. you can see the impact of this crash, how -- the car on the left is the mercedes. that's the car they believe an elderly woman was driving. and she got out of the car wash without a scratch. she was transported to the hospital. two police officers witnessed her speeding at least two or three blocks away from here. so she had been speeding. the big question, why was she speeding? she hit a white catering van with three people in it. six people total were transport

tara moriarty is covering dozens of people forced out of their homes. we begin with alex savidge and alex has new information about the size of this out of control fire. it stands at 1500-acres that have been burned. where here where we are winds are very calm. hardly a breeze at all. let me show you too as we push over here. now that the sun is beginning to come up here. we are just outside of clayton this morning. . you see this large plume of smoke rising up. it's almost going straight up in the air. good indication it's not a strong breeze. the fire 100 acres and 10% contained. over night according to firefighters i have just been talking to essentially what the flames did up these steep canyons. the fire has almost burned close to the peek of mt. diablo. that is 3800 feet. that means about 100 more firefighters joining this receive fort. we are just outside of clayton and crews are trying to get a handle on the fire that started at 1:45 yesterday afternoon. throughout the day yesterday there were air tankers. it is threatening 100 or so. dry brush

tara moriarty is in oakland this morning. . >> reporter: gallo says unsupervised teens are contributing toward or being the victims of violent crime. he says we sorry about violent crime. we have prayed about it. gallo is introducing this proposal this week. it would actually ban youths under the age of 18. now if someone breaks the curfew they could face fines, community service, or jail time if they are found from 10:00 p.m. to 5:00 a.m.. the plan also bars minors from being out and about during school hours from 8:30 in the morning until 1:30 in the afternoon. parents even could be penalized if their children are found unaccompanied. this isn't the first time the controversial curfew has popped up. many say curfews don't work. they have proven ineffective in other city. gallo says they are not doing this to lock everybody up. he was elected in november and represents the fruitvale district. coming up find out who is supporting him and who is knocking him including what mayor jean quan has to say about a city wide curfew. li

tara moriarty is joining us live to tell us more about why some say the law is changing the face of san francisco. tara. >> reporter: i guess the leads are supposed to be moving out of here at 6:00 this morning. we have been here since 4:00 and we have not seen any movement. if you take a look behind me this is -- they have a 48-year- old disabled daughter and have raised seven children here. they say they have tried to find another place to live and can't. this eight unit rent controlled complex is on jackson and larkin streets. matthew miller bought it last year and his plans is to -- the case is just one in a rising number of evictions using the ellis act. a state law adopted in 1985 that allows the landlord to evict tenants. according to the city's tenants union the number of ellis acts evictions have tripled since the beginning of the year. with high numbers in china town. the drop in a number of families and children in favor of the single white under 30 demographic. in june the board of supervisors voted for a ten year moratorium. now the state superior court cited with miller so

tara moriarty is joining us live with the very latest. >> reporter: good morning.e just received an update from firefighters and they say this fire is 70% contained. so that is fantastic news. joining me live is captain steve. some great news this morning. we understand the acreage is actually less than you first thought it was. >> yeah they were able to do better mapping overnight. so the acreage is 31-33. >> reporter: and how many firefighters do you have here? on monday it was like 500. and more than double that now. >> yeah i just got a new number. we are scaled back to a little over 1300 firefighters. we will start releasing a bunch more resources today back to their home units. >> reporter: and what is it looking like? i know you expect containment by friday. >> correct. we expect containment by friday. firefighters were able to put in more containment line last night. very successful with that. and then they will continue to improve that containment line and also start some mop up of areas today. >> reporter: for folks that don't know what mop up means expla

tara moriarty is out there now and tara, you can actually show us the arrest. >> reporter: yes. was pretty incredible the way officers found the suspect. joining me live right now is sergeant wilfred williams we have a bank and all we know this call came in after 4:00. an alarm was triggered? >> yes. we received a call of a silent alarm. first officers responded to the scene. we saw nobody on the inside. but we set up a perimeter and -- >> reporter: you found him in the vent right? did he try top sneak away from the vent in a couple houses down. >> it appears he possibly gained access through the roof of bank of america. he then left through the roof again and he then jumped a couple buildings from the side of bank of america and at that point we set up a perimeter. we used help of the fire department to gain access to the roof. and we were able to fish him out on top of one of the roofs where he actually fell through the top of the roof. >> reporter: wow. trying to get away but it didn't work out for him today. >> didn't work out today. >> reporter: do we know how old he is? wh

ktvu's tara moriarty joins us live from mt. ablo to show us what fire crews are doing now to get the fire completely under control. tara? >> reporter: we're close to the summit. crews have been schedule offing hot spots trying to make sure none of the flames re-ignite in the wind. if we take a look over here, you can see how it looks like no-man's-land and this tree, half of it was spared but the other half completely charred. over there, you can actually see where the fire stopped. right now, calfire is at 70% containment and hopes to have everything fully under control by friday. at 8:00 this morning, hundreds of firefighters left base camp in dublin and headed for the mountains. there are nearly 1400 firefighters. many will be released today, however. calfire has lowered the number as acreage burned 3,133 acres. it's lifted evacuation orders for dozens of families out of their homes. >> what our focus will be, keep it in the box. we have it pretty much contained, but it's not out. there's still a lot of interior burning going

ktvu's tara moriarty is on the scene and just talked to chp about how this happened. >> reporter: good afternoon. a lot of heavy hearts here. about four hours ago it was a very horrific scene. a woman was trying to make a right-hand turn turn when she was coming out of the school when she hit a boy right there. he was dragged for about 60 feet and now two families' lives will never be the scene. a smashed bicycle lay underneath this black suv off byron highway. >> he was crushed underneath the vehicle. >> reporter: the boy was riding his bike when hit and instantly killed. >> she felt she struck some sort of object and immediately pulled over. >> reporter: the chp said the woman who struck him had just dropped off her own children at the school at 8:45 this morning el. >> it's an unfortunate set of circumstances. our heart goes out to the family of the young boy. >> reporter: a parent told us the 7th grader made good grades and said her mother survived cancer. >> he was wearing his safety helmet and had a contra costa sheriff's department badge on top of it. it's sad. >> reporter: the

live from san francisco, i'm tara moriarty, ktvu channel 2 news. >> all right. thank you, tara. >>> a san ramon starbucks will not be opening for business today after being damaged by a fire. it started after 4:00 this morning at the starbucks near the crow canyon common strip mall on crow canyon place. when firefighters arrived, flames were coming from the back of the coffee shop. smoke was coming from two neighboring businesses, a restaurant and a bank. extra police had to be brought in to secure the area. firefighters had to bank in to see if the flames extended into the businesses. >> we made access to the bank and that business and cleared out the smoke and found there was no fire in there, it was just a smoke extension, no fire extension. >> the banks and restaurants sustained smoke damage. no one was injured. the cause of the fire is under investigation. >>> a homeless man is now in jail accused of starting a grass fire yesterday that forced evacuations in san anselmo. newschopper2 flew over the fire scene shortly after the fire started along sunnyhills dr

tara moriarty is live in the newsroom with more including a dramatic rescue. >> good afternoon. we'll show you the video in a minute. people who live in colorado say they are stunned, rockslides and flash flooding have taken out homes and put dams at risk forcing hundreds of people to evacuate. boulder county has been the hardest hit area with up to 6 inches of rain falling over a 12-hour period. a 20-foot wall of water was reported north of boulder. there have been many 911 calls for help. some dramatic video we want to show you a man submerged in a car was caught on tape. he was one of three drivers trapped when rushing water washed out a road. >> the road was eroded from all of the raining through the drainage area. so we're able to save the lives in the cars. there was a victim in each car. >> this was a devastating overnight storm in the dark. i anticipate as the day goes on, we're likely to find other people who are victims of the storm. >> reporter: volunteers are trying to help stranded people until emergency crews can arrive because so many roads are impassible. an emer

tara moriarty is live with more. >> reporter: the dodger fans were coming out of a bar near the ballpark when they ran across the giants' fan and there was some sort of a confrontation. it escalated. by the end of it, a 24-year-old had been stabbed. he was ultimately killed. this is a dmv photo she want to show you. 24-year-old jonathan denver. he was with the dodgers' group with his father, his father's girlfriend and brother and a friend. they just left the giants' game in the 8th inning and went to the bar. after 11:40, that's when they left, they crossed paths with the giants' group near harrison and third street. >> officers were still in the area from our ballpark deployment and two suspects were taken into custody at second and howard streets. we do not have the weapon in custody. we are canvassing the area for that now. we're also looking for the two other suspects. we would request from the public and/or any business in the area if anybody has any video with regard to this, we would like to have it. >> reporter: we know that the suspect vehicle is registered out of lodi. we do k

tara moriarty is at san francisco's hall of justice. and the medical examiner just gave you new information, tara. >> reporter: yeah, the medical examiner has just released the identity of the victim. he's described as a 24-year- old, onthin. we don't know what city he's from. greg suhr says two suspects have been arrested. we know three people had been detained and brought here to headquarters. but again, two people arrested. we want to show you some video exactly where the fight unfolded. just blocks from at&t at third and terry, police say that a group of people confronted the dodger fans wearing blue and white gear. someone stabbed the victim who was also with his father and brother at the time. he was wounded in the upper body. transported to the hospital where he later died. now, the giants/dodgers game had just ended about an hour or so before the stabbing. the giants won 6-4. we don't know if the suspects or if denver had attended the game or a bar nearby. police will not confirm what the suspects were wearing, if it was giants'

we begin our coverage with tara moriarty who joins us live near the fire lines in clayton. good afternoon, tara. >> reporter: good afternoon. we're at the end of curry canyon. you can see the ridge up there. we've noticed flames leap up over the ridge several times since we've been here for the of past couple of hours. now it seems it's quieting down. the smoke is a whitish color. it appears things are getting better. it's lows smoky than it was a couple of hours ago. the wind had picked up. it's erratic. a care caravan of air strikes. 500 firefighters are now tackling this fire that doubled in size overnight. >> i'm not leaving. i'm staying. >> reporter: jack wilson knows he should leave but says he can't. >> i've got a brand-new house that i've built here. you can see it. i've been working on that for three years. i have to protect it. >> reporter: wilson says crews have bound to take a stand near his home. he's not worried but others are not taking chances. >> got a couple of lamas. i have to let them loose. it's the worse i've had. >> i have horses, dogs, cats. you do wh

new at noon, tara moriarty was there as pleasanton police announced who they are questioning and joins us live where the neighborhood happened. >> reporter: good afternoon. police have not made any arrests but they are questioning some people of interests, they say, they won't tell us how many they are talking to but we know they are students that go to two different high schools in pleasanton. we've been talking to neighbors. they say they are absolutely shocked. it's a very quiet area. they do say the teens will come to this cul-de-sac to hang out and drink. saturday a group of teenagers was being busy on middleton court next to the victim's house. dave lamont, the homeowner, came out, told them to quiet down. a quite broke out. that's when his wife stepped outside and saw her husband was lying unconscious on the ground. >> we don't know exactly what occurred except for the injuries sustained to the victim. according to witnesses, a dark- colored suv was seen leaving the area. the victim is currently at a local hospital where he's in a coma and unable to communicate wve -- with our i

tara moriarty joins us now from san francisco and firefighters talking about whether or not this is susk. tara? -- >> this is suspicious? >> reporter: an arson investigator was called out to the scene. we're on the back side. you can see a grove of trees and on the other side of that is where the fire was. we're also near a park that authorities say homeless people are known to frequent. authorities have already questioned some of those folks and they -- about what they saw around 1:30 this morning and then they're going to be talking to them a little later as well. around 1:30 the flames broke out along 101 southbound just before the cesar chavez off ramp. two engines responded and crews were able to snuff out the flames within 15 minutes. we're very close to what is known as hospital curve. it's a very dangerous bend in the roadway. chp had to shut down the southbound lanes of feetway while firefighters got the flames under control. >> it looked a lot bigger than it was. it came in as a small grass fire. when we got there it was probably about ten yards by ten yards and it did catch a

ktvu's tara moriarty was the first reporter on the scene and she's back now live with a look at all of damage there. good morning, tara. >> reporter: you can see where the fire started. you can see how the crews ripped up the stucco and all of the installation really dissecting it to make sure the fire didn't ignite nearby business. it broke out at a starbucks. the worker called 911. firefighters busted open the stuck ke on stash bucks off crow canyon road and 680 and they made a very aggressive attack. >> we did have fire in the rear walls of the complex and had smoke in several of the units. from what we can tell, there was no extension in any of the units. >> reporter: crews were concerned at first because this is a strip mall. flames can spread quickly. there is a cheesesteak shop, a bank and a pizza place nearby. crews busted through the glass doors of the bank to gain access. there's a very heavy police presence here. firefighters were able to squelch the initial fire within minutes no. a lot of damage. but that could change because they are really riching this -- ripping this ap

tara moriarty joins us live from the scene where european learned the victim was a professor. >> reporter: that's right. right now investigators are sifting through evidence to try to figure out how this fire started. you can see them up. they think that they can rule out electrical at this point. neighbors say that the man who lived here was known to burn candles, incense and he smoked. neighbor -- a neighbor's cell phone video shows the smoke. police knocked on this woman's door this morning. >> i was like holy crap. i thought it was the neighbor's. i rushed out. oh, my god. >> it was pretty spectacular. it already bended it outside. >> reporter: seven people made it outside from the building on oregon street. one man was trapped on the third floor where the fire broke out. >> on the third floor level, the door was locked and dead bolted. they had to force entry. >> reporter: crews found andrew goodwin shown here. he was rushed to the hospital but later died. he was a ten-year professor of media studies and pop culture originally from england. >> i will remember his goofy sense of humor

ktvu tara moriarty is there, just arrived on scene. what can you tell us? >> we are getting ready to do a live shot at the bay view police substation. we saw four cop cars whiz buy. we discovered there is a burglary in prospect. right at the corner of filament. we are parallel to 101. if you take a look behind me you can see the fire department has been called in. a couple police officers went on top of the roof to look for the suspect. we are told that he is dressed in black. he has a hoody on and possibly carrying a crowbar. we don't know if he is armed with anything else. we did speak to an officer who said he hadn't been inside the bank to see if there was any type of damage. obviously the call came in from someone that was concerned. you can see we have the street blocked off right here on the 2400 block of san bruno. a bunch of officers came down off the roof. we don't know if they didn't find anything up there. they will be continuing their search and talking to possible witnesses. but we will keep you posted. live in san francisco i'm tara moriarty

tara moriarty is on scene where officers go to great heights to camp him. good morning tara. >> we have just learned that the burglar was trying to get to the money in the atm here at the bank of america on san bruno avenue. you can see police are still guarding the bank here. the suspect broke through the building in order to get to that atm, and he used the roof to do it. he tripped a silent alarm, so when police arrived, he used an air vent to escape. after an hour search, police finally caught him. here's how they zeroed in on him. they knew they were looking for a man in a black hood i de, armed with a crow bar. the officers called the k-9 unit and the fire department to climb on the roof and do a search. they ended up tracking on the suspect the roof of an apartment building two doors down. as he was surrendering, he fell. >> i responded to several different calls of silent alarms at banks but i think this might be the first time that i witnessed somebody actually falling through a roof. >> reporter: the suspect did not appear to be hurt. he is describ

tara moriarty joins us now to talk about the new problems that the fire is creating. tara?ter: , you know, the rainy season is just around the corner, and with the rain comes the potential for landslides, mudslides. so people around here, you could just add it to the list of things they have to worry about. we spoke to state park officials, and so far they have no plans to ask a special landslide team to evaluate mount diablo. cal fire told us they need to recede the grass. the fire kills the roots -- retardant does contain fertilizer, but grasses may not grow in time. >> feeling like so in the safe zone at this point. feeling like we're back to normal. but i just didn't even consider that. >> experts say, in a burn area, just the type that create debris flows. >> that won't move rapidly down the channel, carrying boulders, debris with it. can be, you know, very hazardous. >> reporter: mountain managers right now are finding the bearest spots of dirt so they can be covered with bidegradable shooting. state parks hopes to have the park open by monday. officials say that the

tara moriarty joins us live with what neighbors are saying. >> reporter: i think outrage would be an under statement here. it was a gorgeous day here yesterday in san francisco. and this woman 35 years old was simply out enjoying the sun with her eight-month-old baby and dog. she was lying in a grassy area when somehow a city worker driving a pickup hit her. you can see the flowers there that people left in her memory. luckily the baby was not hurt. this all happened just before 2:30 yesterday afternoon. witnesses say the mother was lying on a blanket sunbathe when the driver hit her and took off. crews rushed the woman to san francisco general hospital where she later died. a neighbor say they don't understand why a city employee would drive on the grass in the first place. especially when it's typically filled with parents, children, and dogs. >> it's sad. you know it shakes you up. because i bring any son up in this park and just to know that park arrest has been reckless or not paying attention. you have to pay attention to see what is around you. >> reporter: police found the ma

ktvu tara moriarty is joining us thousand from the jail where the 21-year-old is being held. tara. >> reporter: yeah. michael montgomery is being charged with suspicion of murder. the 18-year-old who was questioned here, he has been released without any charges. remember police are still looking for two other people who fled the scene of the crime. michael montgomery's father told a newspaper that his son and friend were with two women attending a ray party in san francisco wednesday night. he says his son acted in self- defense and the victim 21-year- old jonathan denver hit montgomery over the head with a chair. denver grew up in fort bragg where the small tight knit community is reeling. he was at the ballpark with his father and brother just hours before he was killed. authorities believe montgomery stabbed denver outside of a bar. after a fight provoked by team rivalry. denver and his group were wearing dodgers gear. they were celebrating denver's brother's birthday with their dad. >> i gave him a big warning before because i knew what happened down a couple years ago in

ktvu's tara moriarty is at the police station to tell us why the owners of the liquor store say they are used to this thing happening. tara? >> reporter: the crazy part of this story is this isn't the first time someone has crashed into this particular liquor store, and there are actually barriers in place where its happened before, but that didn't stop the suspect from causing a lot of damage. take a look at this video, you can see the mangled car here. this happened after the suspect slammed into a store on the corner of 98th avenue. police pulled him over around 11:00 last night at the corner of 10 eighth and then as soon as officers gout out of the patrol car the suspect sped off. 10 blocks away the driver slammed into a car with a woman inside and then knocked over a light poland crashed into the liquor store. onlookers wondered why the man try to evade police on such a simple traffic stop. >> we're still investigating that part of it but he's got some history, some criminal history, so we're looking at all those factors. >> police arrested the man, oakland police are handling th

live in san francisco, i'm tara moriarty, ktvu channel 2 news. >>> 8:35. birthday party in golden gate park yesterday afternoon took a dangerous turn when some children found a loaded gun. the kids reportedly found it as they played in the bushes near the conservatory of flowers. no one was hurt. investigators have not said how that loaded gun got in the park. >>> a new report in the new york times shows the number of accidental gun deaths in the children in the u.s. could be twice what the officials figure show. for example, in california, the time says the official count shows 11 children under the age of 15 killed in shooting accidents from 20007 to 2011. but the paper found another 16 children who died in shootings that were not classified as accidents. the paper says it's important to have correct statistics with the current debate over gun control laws. >>> tonight, pleasant hill may become the latest california city to impose tough new restrictions. the city council is set to require an ordinance requiring a police permit for gun dealers. under the

tara moriarty joining us live. you're at the tow yard where most of those cars were taken. >> four of the five cars involved in the accident were brought here. behind me is the jaguar that the chp believes initially crash setting off a train reaction. you can see the front here. it's completely mangled. the air bags deployed. we saw the chp combing through the car earlier looking for evidence. witnesses say the driver of this car lost control on 8830 northbound near baskin avenue. at 2:15 this morning. witnesses say he ended up causing four other cars to crash. one car hitting the concrete barrier wall. neighbors could hear the screams and called 911. luckily the chp says it sounded a lot worse than it was. all people received only minor injuries and were taken to valley regional and medical regional. only one lane was open for an hour and a half. so the backup wasn't too bad given the hour. now officers are looking for the man who ran off. his car appears to be newly bought. there aren't any license plates on the

ktvu channel 2 reporter, tara moriarty, is live with the big backups drivers are seeing and what may be to blame. tara, good morning. >> reporter: good morning. the metering lights went on a little after 6:00. it's backed you. we're sort of timing it here. you can see the congestion. there was a truck at the west grand overcrossing it took him ten minutes to get to the toll plaza in the fast lane. a lot of traffic here. that's nothing new. but what is new, yesterday, the traffic never let up. dozens of drivers were taking cell phone video as they went through there. the chp was issuing plenty of warnings for distracted driving. motorists experienced congestion all way. many came out of town to gawk at the bridge. the chp says after the long holiday weekend, we saw a lot of cars because it was the first day back to school, back to work. in san francisco, at about 5:30 last night, drivers were trying to get onto the bridge. the ramps were extremely backed up. drivers grew frustrated saying the congestion lasted all the way past market street. keep in mind, the new bridge has the same nu

tara moriarty joins us live now from the fire command post in dublin. tara?base camp where nearly 1400 firefighters are and about a half-hour ago, crews had their briefing before heading up the mountain. they had a moment of silence to pay tribute to the victims and firefighters who lost their lives on 9/11. now, we did receive an update this morning. we want to pass that along to you, as tori mentioned. this fire is 70% contained. they have lowered the number of acres burned as well to 3,133 acres. calfire has lifted the evacuation order for dozens of families out of their homes and yesterday on mt. diablo, we got a much closer look at the blackened hillsides an downed power lines. right now, crews are in the mopup stage. >> within the containment lines there will be hot spots on the ground and so sometimes it's just little pockets of ash that are super hot. so the crews will make sure all of those are picked up. so that way if we have any more winds that it doesn't blow across the containment lines. >> reporter: at the summit, the fire stopped just shy of t

tara moriarty is in oakland. says it is not the first time this has been proposed. orter: that is right. city councilman is pushing for it. some say it isn't fair. say a teenager wants to go to a movie on friday night and lets out after 10:00, he or she could be punished. this has long been a very controversial issue. but oakland city councilman noah gallo says he's had enough violence and wants to do something about it. he will present the proposal to the council tomorrow. the ban would penalize kids under the age of 18 and their parents if they are caught out in public. most children being targeted don't have true adult supervision to begin with. oakland leaders tried in 2011 to enact a youth curfew. the mayor has not said if she will support the curfew only that she is considering. we have put a call into gallo this morning. we are waiting to hear from him a little bit later. live in oakland i'm tara moriarty ktvu channel 2 news. >>> time is 6:36. new this morning a san francisco strip club is suing the software giant oracle. the san francisco chronicle reports or

ktvu's tara moriarty, you've been on this since 4:30. what can you tell us right now?reporter: well, the video that we have this is pretty spectacular. the photographer was able to get to the scene before the fire crews did. it's something that you rarely see. we do know that an investigator was called out to the scene. they believe this was some type of arson. we're on the back side of the fire broke out over to the left. it's through the grove of trees. that's where they say the fire started. we are next to a park where a bunch of homeless people live and authorities have already questioned some of them about what they saw around 1:30 this morning. that's when the flames broke out on 101 and southbound before the cesar chavez offramp. they were able to snuff out the flames within 15 minutes. we're on the hospital curve. it's a very dangerous bend in the freeway. chp high pressure to shut down part of the highway while they got the flames under control. >> no structure there. a cement retaining wall in the back. no structures to burn. the chp did a great job protectin

[ music ] >> reporter: groups showed their support for them and their disabled daughter. their case is one in a rising number of evictions using a law adopted in 1985 that allows a landlord to evict to get out of the residential housing market. >> what happens when it becomes 4,000? do they just move out just because somebody else will pay more rent? >> the new landlord offered buyouts to the residents here but they refused to budge. >> reporter: they spent hundreds of dollars on fees applying for low income housing. they are on the waiting list but there are thousands of people ahead of them. they are willing to go to jail to draw attention. these type of evictions tripled since th

tara moriarty joins us live where neighbors are outraged. >> reporter: they tell us that truck driver daughter had died. thousand he is facing felony hit and run charges. if you take a look behind me here i don't know if you can tell, these are the tire tracks here on the grass. and this is where it appears that he took off after striking the woman up where the flowers are. that is where the woman had been sunbathing with her baby and dog. the 35-year-old woman was lying on a blanket in holly park enjoying the sun on a beautiful san francisco day when somehow a city worker driving a pickup truck hit her and then took off. luckily the baby was not hurt. this all happened just before 2:30 yesterday afternoon. crews rushed the woman to san francisco general hospital where she later died. they want to know why a city worker was driving on the grassy area that often filled with people and pets. >> it's sad. it shakes you up. i bring my son up here in this park and just to know that park and recreation is reckless and not paying attention. you have to pay attention to see who is around you.

ktvu's tara moriarty is there with some new video of the home tenants say they woke up to streams. tara? >> reporter: that's right, screams and police knocking on doors. such a frightening morning for them. you can see that investigators are here on scene trying to figure out what started the fire. the home is divided into seven apartments. we know that officials are trying to get ahold of the family of the man who did not survive the fire. he lived alone on the top floor where you can see most of the fire damage. let's take a look at video. we just got this in. the fire broke out at 1:30 this morning on oregon near regent, about a mile from the uc berkeley campus. tenants say they were lucky to get out alive but they couldn't believe it when a man described being in his 50s did not make it out. crews had to bust through a dead bolt door to get him out but it was too late. >> pretty spectacular when they came out. the fire already bended it to the outside on the thid floor level, on the ground level, you know, smoke hadn't made its way all the way down to that part. but on the third

tara moriarty is joining us now from the jail where the 21-year- old is being held. >> reporter: michael montgomery's father told a newspaper his son acted in self- defense when the victim hit his son over the head with a chair. now we have also learned here that the 1-year-old that had -- the 18-year-old that had been detained for questioning, has been released without any charges. we want to show you a picture of the victim. 21-year-old jonathan denver from fort bragg who was at the ballpark with his father and brother. authorities believe he stabbed denver outside of a bar. blocks from the ballpark wednesday night after a fight provoked by team rivalry between the giants and dodgers. denver and his group were wearing dodger's gear. we spoke with one of denver's friends. >> he's always laughing and making jokes and stuff like that. no instigator on anything. >> reporter: denver was an apprentice training to become a plumber. he grew up in fort bragg. his brother has told friends that the first scuffle was over dodger's gear. the second deadly altercation was an ambush by the attackers

live from san francisco, i'm tara moriarty, ktvu. >>> 7:33. a big rig driver is recovering from severe burns after his truck caught fire near fremont. it happened at 8:00 last night on interstate 680 near shareton road. flames engulfed the cabin, sparking a grass fire on the side of the highway. the chp shut down two lanes and it took five hours to clear the mess. the driver suffered burns to his face and hands and was air lifted. >>> a suspect has been identified as the victim's family makes arrangements for the funeral. law enforcement sources say the suspect is a 43-year-old man named oscar aiolla. they did not say what the relationship was to the victim to reina figueora. she was found dead inside her minivan. her son is glad a suspect has been caught. >> he's going to be behind bars, hopefully for the rest of his life. but it's never going to bring back my mother. >> reina figueora worked at an elementary school, where students have drawn up posters in her honor. >>> time 7:34 and the sheriff's office in east contra costa county is warnin
