abc 7 news reporter vic lee live outside safeway in pa torero center with the new development. vic?d you about this story in march when it happened here at this safeway store. last night the former security guard was arrested in oakland and he was booked at santa rita jail. he'll be transported to san francisco where he faces felony animal cruelty charges and misdemeanor battery assault on the dog's owner. on the morning of march 16", charles moore worked security at the safeway in pa torero center. harn acy says moore exchanged words with him when he used a smartphone to record a scuffle and the man young accused of shoplifting. he said moore suddenly slapped the phone out of his hand and minutes later attacked him. captain vicki goldbeck says security cameras attacked the brazen assault. >> we went to his vehicle and actually changed and covered up his uniform, came up from behind the dog guardian, whacked him in the back of the head. >> reporter: goldbeck says the security camera also recorded the attack on hard city's 11-year-old chihuahua mix roscoe. moore is accused of kicking

abc 7 news reporter vic lee has the story you'll see only on 7. vic?awyers, there is a term they use for this. instead of testifying they call it test i lying. that's apparently what happened in federal court yesterday at a hearing. then came a video which the san francisco public defender's office gave to the suspect's federal lawyers. federal prosecutors had no idea that lawyers for brandon simpson, the suspect arrested with a loaded gun, had the security video, evidence that would result in a dismissal of the case. officer nicholas buckley had signed this sworn declaration detailing the arrest last december in the tenderloin. he was testifying yesterday in federal court before judge charles breyer. he repeated what he said in his declaration, that he and his partner had just broken up a dice game on eddie and taylor streets, that he engaged simpson who looked suspiciously at him, ignored his commands, acted aggressively, and tried to sprint away up the hill. buckley and other officers took him down and arrested him. that's when they found a gun. pub

vic lee talked to one of the volunteers who tried to prevent this from happening. >> reporter: james vargas' fellow volunteers and staffers at meals on wheels are calling him a hero. and rightfully so. he didn't even think about the risk to his own life when he took down one of the carcarjack. this is how it ended. the meals on wheels van upended off highway 580 in castro valley. this after a police chase from fremont. the two carjacking suspects seen here were put on gurneys and transported to a hospital. the chain of events started at smart and final in fremont. a security guard here thwarted the couple's attempt to steal a car. they ran to the parking lot of a city office which houses meals on wheels. volunteers were unloading coolers filled with meals from the van so they could put it into their own cars for delivery. the couple jumped into the van. >> i'm about to grab my koom cooler and i hear, they're taking the truck, they're taking the truck. >> reporter: volunteer james vargas went into action. >> all i see at this point is a big red jacket and stuff. i grabbed this person
