you hear andy biggs talking about war and an eye for an eye, it's not just what message does that say. does the fact that it is coming from elected representatives in any way open the door even wider or allow and encourage violence even more? >> absolutely. and this was part of the playbook that stewart rhodes employed with working with local officials, grooming people to run for local office. because it gives a sense of legitimacy and authority to some of the more violent rhetoric and extremist views out there. and these words are more dangerous than bringing weapons to something, because they inspire, they go on. it's hard to counteract words calling for violent action. it's much harder to defend against that than it is to harden up a building like a federal courthouse. so -- and no one has really been held accountable. we've seen this type of rhetoric coming up to january 6th. we're just now beginning to see some sort of legal account being held. but, largely, politicians that have been using this rhetoric to get elected and increase their following and what not, they really haven'

these republicans could vote for a different republican, andy biggs from arizona put his name forward. a republican could vote for bob smith, pick any name out of a hat. the problem for mccarthy is the balance right now is there's 222 republican members elect, 212 democrats. this one vacant seat, a democrat who passed away after the election and before today. that means if all republicans, all democrats do cast votes here in the next hour, we expect, there will be 434 total votes. you need 50% plus one. a majority. in this scenario, it's 218. that would be what mccarthy needs on this first ballot. if you need 218 and you are kevin mccarthy, you have already got these five republicans who for weeks now have been adamantly saying they are no. if they vote and they vote for somebody besides mccarthy, if they voted for biggs let's say, then mccarthy best case is at 217. then if every democrat is voting, we said the magic number in that scenario is 218. these are the five most obvious. there are other republicans, including within the last hour, who sent signals they seem likely to vote no

there will be 10 to 15 members vote against him on the first ballot tomorrow that will vote for andy biggs mccarthy can only lose four votes and still prevail. mccarthy is desperately making concessions. >> do you think the rules package you released last night has moved any votes to yes. >> yes. >> and what will you do if you don't have 218 on the first ballot? >> mccarthy finally agreed to one demand. he would lower the bar to hold a new confidence vote for speaker if members don't think he's doing a good job. but that didn't satisfy mccarthy detractors. >> there is nothing that indicates to me that he is going to change his pattern since he has been in leadership where he is part of the swamp cartel. >> the house is paralyzed until it elects a speaker. it can't even swear in members. and a nancy pelosi appointee house clerk holdover cheryl johnson is in charge until republicans finally pick a speaker. >> you could have total chaos. i mean, i think the republican party right now is in the greatest danger of meltdown that it's been since 1964. >> the house is supposed to vote continuously
