christie smith has been live on the scene. she's got the latest for us. >> reporter: i can tell you firefighters are still pouring water on this apartment building from the outside. i mean, this was a massive fire. they tell me when they arrived the flames were about 30 feet high in the sky. even right now there's a giant plume of smoke coming from the apartment building, so quite a scene. i can tell that you the red cross just got here. we have chopper pictures. this is a three-story apartment building burning about four blocks from uc-berkeley. firefighters tell me they really have to take a defensive stance staying on the outside spraying water because basically the roof is gone and they know now that a third floor has collapsed. the good news is that they tell me first they know everyone is out of the building. no reports of injuries this morning either to firefighters or people who live here. three buildings also evacuated here in the neighborhood. berkeley police basically went door-to-door telling people to get out. als

christie smith is there, what's the latest? good morning. >> reporter: good morning to you. that is a good question. i can tell you we have good news to report and that is that one lane is back open on the on-ramp to eastbound 580 here at coolidge avenue and herald in oakland. after about 2:50 this morning, the rain has just been non-stop here in oakland and a 70-foot acacia tree just completely toppled over and blocked both lanes of the on-ramp. when we got here the chp was here, had a cruiser parked here just to make sure that no one tried to get by. of course we did see someone try to do that. they had to back right up. but since then what's happened is that caltrans has brought out just about everyone they've got working overnight here in oakland on this stretch of the freeway. they got a six-man crew out here. they brought out chainsaws and a wood chipper and they made quick work of this tree so that at least they've got the big part of it pretty much down to one lane and they're running the rest of the parks through the w

christie smith is live in oakland.n showers just started. we have a lot more on the way and we're already dealing with significant aftermath. what do you have out there? >> reporter: good morning to you. we have been standing on this corner here in oakland since about 4:00 this morning and i can tell you that the rain has not let up at all. the reason why we came here is that the ground was so saturated that a 70-foot tree just toppled right over on to this freeway on-ramp, 580 eastbound at coolidge avenue. that happened about 2:50 this morning and the chp was out here blocking the lanes making sure that no one tried to get on the freeway. then caltrans came out. they brought a six-man crew. they told me -- i was speaking with one of the supervisors and he says basically in these situations, the phone rings and they bring out everyone they can to try an remove these trees. they got a six-man team out here, brought out chainsaws, wood chippers. they got one lane open, then a second lane open. so everything back to norma

nbc bay area's christie smith joins us live from the superior courthouse in oakland. good morning, christie. >> reporter: good morning. a special report on that pepper spray incident at uc davis was supposed to be released online by the university in about an hour with a press conference to follow but instead the matter is caught up in court here in oakland. what's happening the union representing the police officers believe there's likely too much personal and private information about those uc police officers contained in that report, and they requested a temporary restraining or t ining order. the office is located in oakland and they decided to file here in alameda county. the task force looked into the incident where students and others pepper sprayed on the quad dur a demonstration in november. the video grabbed international headlines. the police chief and two officers have been on leave since the incident. at the heart of what's going on today what can legally be released. the aclu is trying to step in on behalf of the pepper sprayed student. >> the report as i

today christie smith has the latest. how bad is it out there? >> reporter: good morning. i can tell you water has been pouring out of the streets here since 3:00 this morning. at the intersection of 7th and addison. i will pull the tape down so you can get a better look. it is coming from four mall holes in the street. water pouring down the street and down the gutters here on addison. what stands out is there is a section of the street right at the front of all of this where the road is lifting right up. maybe a five-foot long section. will is a utility worker out here trying to cap the line off going in from power different streets. berkeley police tell me that he basically got three different sections shut down. he has one more to go before the water might stop flowing. exactly when that might happen, though, still unclear. he is here by himself doing the work. another manager just showed up to help him out a couple of minutes ago. tried to ask exactly how big the line is and how many homes or businesses might be affected. don't have an answer for you just yet. i do ha
