reporting live in oakland, christie smith, "today in the bay." >> that ground must be saturated out there as we have another tree down very close to where christie is. >> this is also on highway 13. we're getting more information. christy smith is southbound 13 at park boulevard and five minutes until the freeway will reopen. and we saw the progress there. the deadly accident caused when a tree came down across the roadway. your alternate is eastbound 580 but in the last five minutes i got a report from chp of a tree down northbound 13 right around 35th. that is not far from where christie is, we'll helpfully get more information on that and maybe christie will have to head to the other side of the freeway. we'll see how it develops. be careful in the oakland hills. four trees reported down from yesterday and today. another tree was reported down on the santa cruz mountains affecting both sides of 17. one of your southbound lanes is affected by that tree. the northbound side sounds like folks are getting by and they've been able to trim the branches. one of the southbound lanes will be sl

christie smith has been live on the scene. she's got the latest for us. >> reporter: i can tell you firefighters are still pouring water on this apartment building from the outside. i mean, this was a massive fire. they tell me when they arrived the flames were about 30 feet high in the sky. even right now there's a giant plume of smoke coming from the apartment building, so quite a scene. i can tell that you the red cross just got here. we have chopper pictures. this is a three-story apartment building burning about four blocks from uc-berkeley. firefighters tell me they really have to take a defensive stance staying on the outside spraying water because basically the roof is gone and they know now that a third floor has collapsed. the good news is that they tell me first they know everyone is out of the building. no reports of injuries this morning either to firefighters or people who live here. three buildings also evacuated here in the neighborhood. berkeley police basically went door-to-door telling people to get out. als

christie smith is there live with all of the latest details. good morning. >> reporter: good morning to you, john. right now just around the corner from where we're standing there's at least a half dozen residents standing around in their robes and blankets trying to figure out what was going on this morning while firefighters try to figure out how this started. i just spoke with a battalion chief and he says he thinks it started in the center of a car port where six cars burned overnight. this is in an apartment complex on adam street. i got cell phone video this morning from a neighbor who ran out and saw flames pouring from the garage area she told me. the residents ran right out. no one injured. the battalion chief says two units are damaged pretty bad and other has smoke damage. one woman told me it was a very scary wake-up call. >> all i know is i woke up about 4:00 and i was like, is something happening outside, didn't hear anything, i walked outside and that's when i asked the fireman what happened. man, we need you to step outside, the

today in the bay's christie smith live at city hall where major ed lee is expected to make some kind of announcement today. christie, good morning. what's up? >> reporter: good morning, mike lee is expected to talk about this domestic violence case and the future for sheriff ross mirkarimi, even though mirkarimi has said he wants to keep his job as sheriff and doesn't want to step down despite pleading guilty to false imprisonment after an alleged new year's eve altercation with his wife. mirkarimi was sentenced yesterday to probation, counseling, and a $600 fine. now a tape showed his wife bruised and tearful after this alleged incident. mirkarimi met with lee after the sentencing for about 15 minutes yesterday. but when he left, he didn't say what it was all about. what could happen here is that lee could start the process to remove mirkarimi from office but ultimately, it would be up to the board of supervisors. after the sentencing, mirkarimi said he's trying to regain the public's trust. >> and i'm going to devote myself to repair my relationship with my family, with the people o

christie smith joins us from milpitas with a look how the traffic is flowing. good morning. >> reporter: good morning. would you be willing to pay three bucks sitting alone in your car in traffic in a hurry just to use the car pool lane? drivers now have that option. they can have the money deducted from a fast track transponder, if they use highway 237, starting today, on four miles of converted car pool lanes, now express lanes. drivers on southbound 880 can get on 237 and go west to mountain view. eastbound commuters from mountain view to san jose enter at north first and continue on interstate 880. the price is 30 cents to 6 bucks, and suggested according to how busy. you can't duck in and out of the lanes when you feel like it. sfwl typically you can move in and out, but with the toll lane, you have to stay in the lane once in the lane. >> the eastbound commute hours 5:00 a.m. to 9:00 a.m., web to 10:00 a.m. afternoon, the same, 3:00 p.m. to 7:00 p.m., regardless of direction. something to note, if you're a regular car pooler with two or more passengers, m

christie smith is there, what's the latest? good morning. >> reporter: good morning to you. that is a good question. i can tell you we have good news to report and that is that one lane is back open on the on-ramp to eastbound 580 here at coolidge avenue and herald in oakland. after about 2:50 this morning, the rain has just been non-stop here in oakland and a 70-foot acacia tree just completely toppled over and blocked both lanes of the on-ramp. when we got here the chp was here, had a cruiser parked here just to make sure that no one tried to get by. of course we did see someone try to do that. they had to back right up. but since then what's happened is that caltrans has brought out just about everyone they've got working overnight here in oakland on this stretch of the freeway. they got a six-man crew out here. they brought out chainsaws and a wood chipper and they made quick work of this tree so that at least they've got the big part of it pretty much down to one lane and they're running the rest of the parks through the w

"today in the bay's" christie smith joins us with the latest. christie, not a good scene. >> reporter: no, it was really a violent accident, but the tow truck just arrived and the car was removed from the scene. but i want to show you the tree that that car smashed into. you can see some of the damage there on the bottom. and there are skid marks on the ground about 200 feet along, three people in that car, all of them taken to san francisco general this morning, two with life-threatening injuries, one nonlife-threatening injuries. i spoke with officers a little while ago, and they're telling me they may have been thrown from from the car. this is at brotherhood way. about 2:45 this morning, i spoke with a sergeant who says the driver was speeding and lost control, but wasn't racing another car. the impact so hard that the front of the car was completely smashed. when we got here, the front bumper was in the middle of the roadway. the three injured are men. i asked if they might be students at san francisco state because the campus is so close. b

today in the bay's christy smith live at the fairgrounds which is at the center of all of this legal argumenting. good morning, christy. >> good morning to you, john. a number of counties have laws on the books that don't allow the sale or possession of guns on government property, which essentially bans gun shows at what some consider some of the best places to hold them like fairgrounds. this is video from near the cal palace and now a couple is asking a federal appeals court in san francisco to take another look at their request to strike those laws down as unconstitutional. that according to it -- they're challenging alameda county's. the couple says the fact they can't have gun shows where they want to has really affected their lives tremendously. the decision could determine the fate of gun show regulations in california and a number of other western states. and some believe this could actually end up all the way at the u.s. support. the ninth circuit court of appeals is expected to hear arguments this afternoon in san francisco at 2:30. reporting live in pleasanton, christy smi

christie smith is live in san francisco with the newest defense tactic. good morning. >> reporter: a couple of things, jury selection continues after the jury pool was expanded but the state of a video that is the key to the prosecution's case, well, it's still up in the air after attorneys for san francisco sheriff ross mirkarimi, they are still fighting to have it kept away from jurors. a panel rejected a claim that mirkarimi's wife made the video with a neighbor who she thought apparently was a lawyer, the argument there that it should be kept out due to attorney-client privilege. the video show as bruise on her arm and accuses mirkarimi causing it. he has denied any assault and lopez has said she was not abused and refused to testify. his attorneys claim that an unavailable witness would violate his right to question his accuser a. ways to go in this. there are 144 potential jurors still to question. reporting live in san francisco, christie smith, "today in the bay." >> thank you very much. the fallout beginning in afghanistan after a u.s. soldier go

nbc bay area's christie smith joins us live with a look at how a routine meeting turned chaotic. christie, good morning. >> reporter: good morning, marla. uc police are standing by with their riot helmets on. and student demonstrators are outside listening to the meeting going on inside through a loudspeaker. they say they were kicked out and not being let back in. the regents meeting earlier was packed but uc police tried to clear the room after students wanted to keep speaking about the budget and the governor's proposed tax increase, possible tuition hikes. that's when the whole thing turned sideways. demonstrators were detained in the hallways after pushing and shoving going on. police gave them several warnings to leave the meeting. but one demonstrator said, if you treat us like children, we'll act that way. they pulled out beach balls, played music and were dancing in the meeting. the regents, including lieutenant governor gavin newsom, was present. the governor's proposed tax increase was supported. students believe that tax revenue would come with no assurances that they'

nbc bay area's christie smith joins us live from the superior courthouse in oakland. good morning, christie. >> reporter: good morning. a special report on that pepper spray incident at uc davis was supposed to be released online by the university in about an hour with a press conference to follow but instead the matter is caught up in court here in oakland. what's happening the union representing the police officers believe there's likely too much personal and private information about those uc police officers contained in that report, and they requested a temporary restraining or t ining order. the office is located in oakland and they decided to file here in alameda county. the task force looked into the incident where students and others pepper sprayed on the quad dur a demonstration in november. the video grabbed international headlines. the police chief and two officers have been on leave since the incident. at the heart of what's going on today what can legally be released. the aclu is trying to step in on behalf of the pepper sprayed student. >> the report as i

christie smith joins us live. they're putting out $3.5 million for a complex makeover. >> reporter: good morning. the teams have played in oakland for so long that for a lot of people who call oakland home they just can't see them playing anywhere else, even if it's right down the road in another bay area city. the oakland city counsel is taking some steps to get them to stay, approve dlrg 3.5 million on plans for a new stadium. their website says the oakland raiders played their first game here against the chiefs in september of 1966 and this the arena opened two months later. of course there was a big renovation in 1995. but the planned overhaul of the coliseum is really aimed at getting the raiders, a's, and warriors to stay put. the rais and raiders want their own stadium, the a's eyeing san jose, and it includes renovating the area between 880 and airport with shops, a conference center, hotels and entertainment. the plan pays for a study and the city council approved this last night. but the big question is

christie smith is live in berkeley where hundreds will demand education reform. good morning. >> reporter: good morning. when we were here earlier for the occupy cal encampments the students told us it was leading up to this day. students and some faculty going to be rallying, they are going to start around 7:30 this morning to support public education. and they really are saying they want to come out strong against any state budget cuts that would affect education and make it really unaffordable with the tuition hikes going on and causing outrageous student debt. activists plan to start with a protest this morning outside of california hall where they say many upper administrators are working, planning teach-outs as they have done, holding classes outside near sprawl hall. then a big noon time rally and a march a little later to oakland to meet up with other east bay schools that are participating in this. similar actions again starting at dozens of other east bay schools. this kicks off an ambitious march from the bay area all the way to sacramento where an eve

today in the bay's christie smith is live in san francisco. she joins us now with the very latest.> good morning to you, laura. well, we were at the accident scene a little bit earlier and we came here to the hospital. i spoke with police this morning and they're saying that there were three people including the driver riding in this car. the driver lost control, skidded, slammed right into a tree, the car spun around. all three people injured. they were taken here this morning to s.f. general. all three of them male, police are telling us two had life threatening injuries, one was nonlife threatening injuries ranging from back trauma to head trauma. this happened around 2:45 this morning on brotherhood way. the car lost control, it left skid marks about 200 feet long on the street slammed into that tree, spun around and then ended up on the sidewalk area. the bumper when we got there was just sitting in the center of the road. and police say at this point it's too early to say if alcohol was a factor. the wreck very close to s.f. state. i asked them if any of these people might be

reporting live in walnut creek, christie smith, "today in the bay." >> thank you very much. as many as 50 people had to spend the night away from their home in berkeley after a massive fire left an apartment building in danger of collapse. investigators say the fire started with a hot water heater in the closet on the ground floor. all three floors containing six apartments were gutted. residents in four surrounding buildings also had to evacuate. they have to stay out until crews can shore up the walls of the building. that is expected to happen today. >> tempers flared at a meeting focused on the beating of a man. demanding why police didn't respond immediately when they were called. peter called the nonemergency line to report a man trespassing. his wife called 911 to say the man was beating her husband with a flower pot. he died from the injuries. police didn't get to the house until 14 minutes after the first call. they say if he conveyed an emergency situation officers would have responded. while the incident was tragic he believes the call was handled correctly. >> we

christie smith live in the bay. good morning. >> reporter: as you can imagine, students and teachers are absolutely grief stricken over this. student athlete, he was playing a sport he collapsed and died. he was taken to eden medical center and pronounced dead there. today there will be grief counselors here for the students as well as teachers who might need it. also, students are being encouraged to wear blue. that's the school color to honor the memory of the 14-year-old. he collapsed while playing basketball during pe. friends are changing their facebook pages in his honor. he's the youngest of ten children. he was a hard-working student with a bright future ahead playing football and the loss is just heartbreaking. >> it is hard. hard. because -- you don't expect it. you don't see anything like this come -- you never want to expect anything like this where a child -- someone so humble and just so respectful, just gone. >> firefighters say the distress call first came in as a seizure. they came but just weren't

today christie smith has the latest. how bad is it out there? >> reporter: good morning. i can tell you water has been pouring out of the streets here since 3:00 this morning. at the intersection of 7th and addison. i will pull the tape down so you can get a better look. it is coming from four mall holes in the street. water pouring down the street and down the gutters here on addison. what stands out is there is a section of the street right at the front of all of this where the road is lifting right up. maybe a five-foot long section. will is a utility worker out here trying to cap the line off going in from power different streets. berkeley police tell me that he basically got three different sections shut down. he has one more to go before the water might stop flowing. exactly when that might happen, though, still unclear. he is here by himself doing the work. another manager just showed up to help him out a couple of minutes ago. tried to ask exactly how big the line is and how many homes or businesses might be affected. don't have an answer for you just yet. i do ha

nbc bay area's christie smith is at the shelter.ç good morning. >> talk about dedication.ven in the wind and rain, animal welfare lovers came out. they just wrapped up a press conference right out here in front of the county building in the rain. pets in hand. they're trying to save a state law, hayden's law. they say if it were repeal, that it would basically set california back about 15 years to a time when stray animals that landed in local shelters didn't get the care that they need and pets that were lost were not held long enough for their families. a resolution is now being presented inside at the board of supervisors meeting urging the governor not to repeal the 1998 law. hayden's law ensures veterinary treatment for sick and injured animals at local shelters and keeping strays for four to six days in the hope they might find a home. the state reimburses those shelters. to save $23 million, the governor is proposing repealing parts of hayden's law. allison lindquist fears the worse. >> that goes off the map if the bill is repeal and the shelters will not be eligibl
