scott mcgrew is joining us now. scott, i have some questions here for you. so why is uber making this threat, and why for this specific period of time like till the end of the year? >> reporter: well, basically they're trying to run out the clock, marcus. this all started with the passage of ab-5 in the california statehouse forcing companies like uber and lyft for that matter to go from using so-called gig workers to employees, all of the drivers must under law become employees. but there is a ballot measure in november that would overturn ab-5, and that's what uber wants to wait for. uber's saying we may have to just wait it out and while you're waiting it out with us, remember to cast your ballot to get us back. the fact that few people are using uber in the pandemic may actually work in the company's favor. it's not giving up huge amounts of money if it turns off our uber app. now we first learned about this proposed plan from the uber ceo to spoke about it on msnbc this morning. he says he understands suspending service will hurt both drivers and passen

scott mcgrew, i know president trump's former national security adviser michael flynn back in court today. >> reporter: back in court. you remember flynn. he lied to the vice president about talking to the russians. he lied to the fbi about talking to the russians. he admits all of this. president trump fired him for lying to vice president pence. and the justice department prosecuted him for lying to the fbi. then even after he admitted it, after he was convicted, that same justice department said never mind we're going to drop the charges which never happens. a judge told prosecutors you can't do that. and today the full panel of the appellate court heard arguments from both sides from the prosecutors who don't want to prosecute and from the lower court judge who said it's just not something you can do. it is truly one of the most strange legal cases we have seen in a very long time. adding to the strangeness today, one of the prosecutors for the justice department seemed to hint there was secret evidence that somehow influenced their decision to ask that the prosecution be withdrawn bu

i'm scott mcgrew.file for the first-time unemployment claims last week. that's the second week in a row that we've been at a million or more. >>> right now, let's get a look at the forecast and meteorologist kari hall and another cool start. kind of refreshing. >> it's been refreshing because we had the fog building near the coastline and that westerly wind coming into the improved air quality. some of the worst air quality in san rafael as well to the south county and also pushing some of the fire just to the west of those communities into the valley. so, as we go into today, we'll see the fog clearing up and the smoke settling in, once again. so, our smoky conditions will return by this afternoon for the inland areas as our high temperatures reach into the upper 80s. reach 90 degrees while san francisco will see a high of 80 degrees. some in the 70s for oakland and san francisco reaching 65 degrees. mid 80s today in napa and as we go through this forecast, we'll see our temperatures spiking tomorrow
