joining me now to discuss, lisa rubin, msnbc legal analyst, and joyce vance, msnbc contributor and formere university of alabama, school of law, and co-host of the hashtag sisters in law podcast. lisa and joyce, thank you so much for joining me. we saw, i want to start with you. why might the manhattan da have a hard time convicting trump on these charges? >> well, one of the reasons has to do with the specific legal theory. falsification of business records in new york is a misdemeanor. but it can become a felony where it's used to defraud and conceal another crime. the question here is what is that crime? that's a question that's been haunting the manhattan da's office for sometime. it's unclear whether as a matter of new york law, that underlying crime, which you're looking to conceal, can be a federal claim. and we all know from the michael cohen conviction that it was a federal election law crime here. the question is whether they can find an equivalent new york state law crime. the other reason it might be difficult this just because of the passage of time. you, i, and joyce know th

let's bring in danny cevallos, msnbc legal analyst.d for you the way one lawyer put it. donald trump called on patriots to stop the steal. we're calling on donald trump to take the stand. well, clever turn of phrase, but what chance do they really have of getting donald trump on the stand? >> the chance of issuing the subpoena is 100%. in most jurisdictions an attorney like me can take a form and sign it for the clerk, where the clerk's name is, we'll sign our name, and the season is issued. we just need to get it served. it's enforcing it and getting it quashed will be the challenged. for the former president, challenge number two will be actually personally serving it. normally, i would get a process server or investigator to knock on the door and leave the subpoena with the person. you can't do that with the former president. that's why they're going to need the help of doj, even if the judge allows the subpoena, which as many have observed is a long shot. >> we've got a long shot there. there's another defense strategy at play that
